The Pledge of Allegiance was led by APPROVAL OF PLANNING AND ZONING COMMISSION/LOCAL PLANNING AGENCY MINUTES OF APRIL 27. 1989: Mr. Robert Carman made a motion that the Planning and Zoning Commission/Local Planning Agency approve the Minutes of the Regular Planning and Zoning Commission/Local Planning Agency meeting on April 27, 1989. Mr. Pruit~ seconded the motion, and upon roll call, the Board unanimously voted in favor of %he motion. PUBLIC HEARING-CARRIAGE DEVELOPMENT OF ST. LUClE COUNTY, INC.- FILE NO. RZ-89-020 Petition of Carriage Development of St. Lucie County, Inc. for a change in zoning from AR-1 (Agricultural, Residential - 1 du/ac) to RS-2 (Residential, Single Family - 2 du/ac) for property located on the east side of South 25th Street, approximately 1/4 mile south of the North Fork of the St. Lucie River. Mrs. Ernestine Ryder presented the petition. She said the subject property is north of Midway Road, on the east side of South 25th Street, across from Immanuel Baptist Church. Plans are for an up-scale community with homes in the $100,000 to $150,000 price range. A security gate for the front of the project is also proposed. She said that the Edwards Company of Okeechobee will be in charge of the land clearing. Mr. Frank Evans, owner of Parcel 10 on the overview, said his property; which has been in his family since 1952, has been kept in its natural state as much as possible. His family entered into an agreement with the County to keep the property as green space~ It is currently used for scientific research. He had no objection to the owners of the subject property making reasonable use of their property. However, he felt there should be -some reasonable separation between the wild-lands and the residential development. _ He said the wild lands support all.. type's of wildlife. Parcel 1t was donated as an audubon preserve, as well as another piece of property to the north (but not shown on the overview). He stated concern for the rapidly disappearing natural habitat ~for.wildlife and asked that developers do all they can to preserve the character and natural beauty of the area. He informed the Board of luxuriant growth of old oak trees near the river and a small section of the original St. Lucie River, rather than Canal 71. Mrs.. Patricia Ferrick .said she was'not in opposition to the petition; however, she did have some concerns. She said her first question, whether or not the property borders the North Fork of the St. Lucie River, had been answered. She then questioned if the property owners or their agent have been informed that~.a recommendation for the draft Comprehensive Plan has been made for lands along the North Fork.to have a land use category of Conservation, Private? Mrs. Ferrick also addressed the vested rights issue and felt if a specific property with a particular proposed development activity in mind is rezoned, the County's affirmative governmental act might be supporting a claim of vested rights. She -felt the County will have to apply Conservation, Private for those lands bordering the North Fork across the board, or let it go. She stated concern for the natural hammocks in the subject area because fast-tracking an ordinance for land clearing or tree protection is not being accomplished. Mrs. Ferrick submitted a written copy of her comments and concerns. Chairman Terpening made the written copy a part of the record. Mr. Carman asked Ms. Storey if it is legal for the petitioner to apply for the change in zoning at this time, and if it is legal for the County to approve or deny the petition at this time. On both counts, Ms. Storey replied in the affirmative. Regarding Staff comments, Mr. Murphy said Staff has reviewed the petition and determined it to be compliant with the Future Land Use Maps of the Growth Management Policy Plan. The rezoning request is consistent with previous requests in this area. In response to questioning by Mr. Pruitt regarding the Conservation, Private future land use designation, Mr. Murphy said the draft Future Land Use Maps of the St. Lucie County Comprehensive Plan indicate a split on this property of RS and a conservation classification. However, the entire North Fork strip is being reviewed and there will be some recommended alterations along the entire North Fork corridor at the LPA's Comprehensive Plan hearings in June. Mr. Pruitt questioned if Staff had any idea what will be recommended for this particular piece of property? Mr. Murphy replied not speCifically, because actions taken will affect the entire Five Mile Creek and Ten Mile Creek streambed areas. It maybe addressed through a combination of land use classifications and overlays designating enviror~entally unique areas, as well as addressing the issue through Land Development Regulations. Mr. Pruitt questioned requirements regarding a 50 ft. buffer. Mr. Murphy said that St. Lucia County has a 50 ft. river protection requirement. That requirement entails that any development along the North Fork must either preserve the existing vegetation, or.if ~ny alteration of_-the property is intended, a management' plan must be filed with and approved by the Soil Conservation Service. This is intended for erosion control, and not necessarily habitat preservation. Mr. Murphy felt this will be enhanced by the new Comprehensive Plan's Conservation Element and the Land Development Regulations. In response to questioning by Mr. Carman, Mr. Murphy said additional restrictions cannot be imposed through the rezoning process. Mr. Terpening questioned Mr. Murphy if the petition is ultimately approved by the Board of County Commissioners, and if the proposed Comprehensive Plan is adopted which would designate the 6 land uses which would split the property, would this not make the zoning designation nonconforming to the land use designation? Would the property owners be able to build at two units to the acre with that overlying land use? In simplistic terms, Mr. Murphy replied that they would not have the zoning classification on that part classified more restrictively by the land use plan. It would have to be administratively rezoned to a one unit to the acre zoning designation. Such action would most likely be initiated by the County. Regarding the overall issue of what is vesting and what is not, is an issue that the County Attorney's office is formulating and will be presenting to the LPA in June'. Mr. Terpening asked if ~this Board informs the petitioner of- the pending land use changes, does that action support the vesting or support the County's position of Conservation, Private. Ms. Storey said the issue of 'vesting, simplistically, is related to such issues a~ permits. Just mentioning that the possibility that this may be designated as Conservation, Private should not have any legal effect on· the vesting issue.at this time. Vesting is usually determined in terms of permits for specific development In response to questioning by-Mr. Carman, Ms. Storey said the Coun~ has an existing land use plan and an existing zoning ordinance in effect at this time. This Board'S consideration of this petition should be directed to the existing land use plan and zoning ordinance. There is no way to be positive what will be transmitted to the State or ultimately approved by the Board of C6~nty Commissioners. Mr.. Scott Cross questioned when the Land Development Regulations would be implemented? He also said that the Standards of Review deal with existing and proposed land uses. He felt this ~Board should take care to assure that whatever is.~approved in the subject area is compatible with both the existing and proposed land uses. Mrs. Patricia Ferrick said her information for her. submitted written comments regarding the 'vesting issue came from information that was prepared by several large law firms for counties in the Sarasota area. '~ Mrs. Ryder said she is a long-time resident and expects to continue residency in St. Lucie County, meaning she is not a "fly-by-night" operator. She said she did not want 'to see the river destroyed and wanted to save all the trees possible ~hat are in the grove. Her family planted-the grove~ The area to the rear of the subject property is virgin land and is gorgeous. In that that area is dense, plans ~are .to clear out the underbrush and save as many of the trees as possible. She-stated.that she is not frightened should the.property ultimately be limited to one unit per acre because it would make t~homes and the land 7 more valuable. She asked to be kept informed of any future land use issues.. She also stated that her intent is for the betterment of St. Lucie County, not the detriment.
