A RESOLUTION CHANGING THW. ZONING CLASSIFICATION
OF CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St.
County, Florida, has made the following determinations:

1. Rudy Andrae presented a petition for a change in zoning
from RMH-5 (Residential Mobile Home - 5 du/ac) to CG (Commercial
General) for the property described below.
2. The St. Lucie County Planning and Zoning Commission,
held a public hearing on the petition, after publishing notice at
least fifteen (15) days prior to the hearing and notifying by
mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board approve the
hereinafter described request for change in zoning classification
from RMH-5 (Residential Mobile Home - 5 du/ac) to CG (Commercial
General)for the property described below.
3. On April 25, 1989, this Board held a public hearing on
the petition, after publishing a notice of such hearing in the
Fort Pierce News Tribune on April 5, 1989, and notifying by mail
all owners of property within 500 feet of the subject property.
4. The proposed zonin9 change is consistent with the St.
~ucie County Growth Management Policy Plan and has satisfied the
standards of review set out in Section 5.3.300 of the St. Lucie

Petition of Rudy A~drae, for a Change in Zoning from

On Tuesday, April 25, 1989, you will be asked to review a
petition on behalf of Rudy Andrae, for a change in zoning f-rom
RMH-5 to CG, for. property located on the northwest corner of the
intersection of North US ! and Naco Road, directly north of
Ridgecrest Mobile Home Park. The rezoning will allow the
construction of additional parking spaces for a proposed shopping
.... center along North US 1.
County staff has reviewed this petition and determined it
consistent with the Land Development Policies of the St. Lucie
County Growth Management Policy Plan.
On Thursday, March 23, 1989, the petitioners representatives
presented this'petition at a public hearing held by the St. Lucie
County Planning and Zoning Commission. During the public comment
portion of the hearing, a request for an additional landscaped
buffer along the southern border of the petitioned property was
made by the Ridgecrest Mobile Home Park. The petitioner agreed
to review this matter further with the Ridgecrest representatives
prior to the presentation of the petition to the Board of County
Commissioners. The Planning and Zoning Commission then voted
unanimously to recommend approval of this petition.
Attached, you will find a copy of Draft Resolution $89-110,
our original staff report, and the minutes of the March 23, 1989,
Planning and Zoning Commission meeting. If you have any questions
on this matter, please let us know.

Regarding the Minutes of the February 23, 1989 Regular Meeting of
the Planning and Zoning Commission/Local Planning Agency, Mr.
Pruitt made a motion to approve the subject minutes. Mr. McCain
seconded the motion, and upon roll call, the Board voted
unanimously in favor of the motion, with the exception of
Patricia King and Douglas Skidmore who were not present at the
subject meeting.
PUBLIC HEARING - RUDY ANDRAE - FILE NO. RZ-89-89-004:
Petition of Rudy .Andrae for a change in zoning from RMH-5
(Residential, Mobile Home - 5 du/ac) to CG (Commercial, General)
for property located on the northwest corner of the intersection
of North U.S. 1 and Naco Road, directly north of Ridgecrest
Mobile Home Park.
Mr. Rudy Valisalo presented the petition. He said that Mr.
Andrae's intent is for the project to be attractive from all
sides. He noted the area between Taylor Creek and St. Lucie
County Canal Right-of-Way is lar§er than 20 ft. and will serve as
a beautiful, natural buffer from properties to the west. He also
said that the petitioner will work with the property owner to the
south of the subject parcel to come to a reasonable resolution
regarding the buffer.
Attorney Burr 'Bitten chose to stand upon his comments made in the
previous petition, File No. PA-89-001. He stated that Ridgecrest
Mobile Home Park would prefer that the developer leave the
natural vegetation on the southern boundary as a buffer.
Regarding 'S~aff comments, Mr. Murphy chose to stand on comments
made in the previous petition, File No. PA-89-001. Staff
recommend approval of the change in zoning.
Hearing no public comment in favor of or in opposition to the
petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including Staff comments, and the Standards of Review as
set ~n Section 5.3.300, St. Lucie County Zoning Ordinance, Mr.
Flowers made a motion that the Planning and Zoning Commission
recommend that the St. Lucie County Board of County Commissioners
grant approval to the petition of Rudy Andrae for a change in
zoning from RMH-5 (Residential, Mobile Home - 5 du/ac) to CG
(Commercial, General), and included in the motion a
recommendation that the petitioner and the property owner to the
south of the subject property come to an agreeable resolution
regarding buffer on the south property line. Mrs. King seconded
the motion, and upon roll call, the Board voted unanimously in
favor of the motion.
Chairman Terpening informed the petitioner's agent that the
petition will be forwarded to the Board of County Commissioners
with a recommendation of approval.

In reviewing this application for the proposed amendment to
the Growth Management Policy Plan, the Local Planning Agency
shall consider and make the following determinations:
Whether the proposed amendment is in conflict with
any applicable portions of this Ordinance;
The proposed change in land use is consistent with
the Commercial Development Policies of the St.
Lucie County Growth Management Plan. Specific
policies which support this amendment are $34, and
$43.
Whether and the extent to which the proposed
amendment is consistent with existing and proposed
land uses in this area;
The proposed change is generally consistent with
Commercial Development Policies of the St. Lucie
County Growth Management Policy Plan and desired
uses along the North US Hwy. 1 corridor.
Whether there have been changed conditions that
require an amendment;
Within the last year-there have been several
rezonings and development proposals for commercial
purposes along the North US 1 corridor. A shopping
center is being proposed for the property directly
to the east. This land use change will allow the
construction of a additional parking area for that
shopping center.
Whether and the extent to which the proposed
amendment would result in demands on public
facilities, and whether or to the extent to which
the proposed amendment would exceed the capacity
of such public facilities, including but not
limited to transportation facilities, sewage
facilities, water supply, parks, drainage,
schools, and emergency medical facilities;
The proposed development is not expected to create
an excessive demand on public facilities in this
area.

COMMENTS
The petitioner, Rudy Andrae, is proposing to. change the land
use designation from RM to CH for the purpose of constructing a
parking lot for a proposed shopping center directly to the east
of this property, along the US Hwy $1 frontage.
Staff has reviewed this proposed amendment and found it
consistent with the standards of review in the St. Lucie County
Growth Management Policy Plan. Staff recommends that you forward
this petition to the Board of County Commissioners with a
