On Tuesday, May 23, 1989, you will be asked to review a petition on behalf of American Financial Life Insurance Co., for a change in zoning from AR-1 to RS-2, for property, located on the west side of South 25th Street, directly .south of Ten Mile Creek. The rezoning will single family permit, residential development at a density of 2 du/ac. County staff has reviewed this petition and determined it consistent with the Future Land Use Maps of the- St. Lucie County Growth Management Policy Plan. On Thursday, April 27, 1989, the St. Lucie County Planning and Zoning Commission held a public hearing on this petition. The petitioner's representative stated the rezoning request was compatible with the RL land use designation, surrounding properties, and recent rezonings in this area. The project is planned to be an upscale d~velopment with homes beginning at $150,000. After hearing no further ~ublic -comment in favor or opposition to the petition, the Planning and Zoning Commission voted to forward this petition to the Board of County Commissioners with a recommendation of approval. Jackson, for a change in zoning from AR-1 (Agricultural, Residential - 1 du/ac) to RS-2 (Residential, Single Family - 2 du/ac) for property located on the west side of South 25th Street, directly south of Ten Mile Creek. Ms. Genevieve Jackson presented the petition. She said the property involves 42.65 acres. She also said that the request for RS-2 zoning is compatible with the RL land use designation, the surrounding properties and recent rezonings in the area. Ms. Jackson contacted some of the property owners who live along 25th Street. She said she would submit letters in support of the requested zoning change to Staff. The project is planned to .be an up-scale type development that will more than likely have a guardhouse or gate-type structure at the entrance for privacy. The density will be low and the price range will begin at approximately $150,000 per home. Mr. David Reid, a resident on Isola Bella Drive, stated that he and his neighbors would like to see the subject property remain in its current AR-1 zoning classification. He said the petitioner had applied a couple of yea~s ago for a change in land use to 11 units per acre under the Planned. Unit Development zoning designation. The Subsequent public hearings for that request had a room full of opposition. Mr. Reid said he had researched the zoning designations around his property prior to purchasing it. He purchased his property believing that the surrounding properties would remain AR-1. The properties on Isola Bella Drive all involve in excess of one acre. He felt that the current designation of AR-1 suitably enhances the area. He said that Isola Bella Drive is actually a small island', which has a %oral of five homes. Mrs. Mr. Terpening pointed out that the area across the street from Mr. Reid is zoned RS-3, with-R$-2 zoning also nearby. He felt that the request is consistent With uses in the neighborhood. Mrs. Patricia Ferrick said that the lands bordering the North Fork of the St. Lucie River are proposed to be designated as CPvt (Conservation, Private) in the Future Land Use Element of the draft Comprehensive Plan, with development in that area being restricted to one unit per acre. She stated her concern that any disturbance of the bank of the North Fork at the subject location could result in the flooding of her property to the south. She felt that if this petition is approved for RS-2 zoning, and then the CPvt land use is adopted in this area, that would make any development above one unit per acre nonconforming. Ferrick exhibited an aerial photograph of the subject area which indicated a beautiful oak hammock. She stated her concern that, since the County has not yet adopted a Tree Protection Ordinance, if the trees are removed it would accelerate erosion. Ms. Storey said .that Staff will be coming fOrward with language regarding development rights as part of the draft Comprehensive Plan. The Board of County Commissioners certainly do not wish to increase nonconformities. Staff is aware of this and will be coming forward soon with language and policies to address this issue. Mrs. Ferrick stated that she hoped the draft Comprehensive Plan will include a footage designation for development away from the river bank. Mr. Gary WOrth, owner of Lot 10 on the overview, stated his concerns regarding flooding. During the last flooding, his. yard was waist deep in water. Mr. Reid's house was flooded half way insids the house. Regarding Staff comments, Mr. Murphy said'Staff has reviewed the petition and determined in complaint with the Future Land Use Maps of the Growth Management Policy Plan. The request is consistent with the properties lying to the east (Sweetwater Subdivision) and recent actions along the North Fork area. Mr. Sciturro determined that there is a regulation that requires no development within .50 ft. of the river bank. Mr. Murphy said the way the ordinance, is currently written, vegetation can be altered within 50 ft. of the river. However, there must be an approved management plan. from the Conservation Service to assure there will be no uncontrolled erosion into the river. The intent is to maintain as much of the native shoreline as possible. In response to questioning by Mr. Sciturro regarding the first floor flood elevation in the subject area, Mr. Terpening' said it is close to 11 ft. in that area. Mr. Sciturro questioned if holding ponds are proposed for the development? Mr. Murphy said that any development that takes place on the property, regardless of its density or intensity, will have to comply with all stormwater management criteria. This would include at least one retention area, the size of which would be determined by the amount of impervious surface. Hearing no further public comment in favor of or in opposition to the petition, Chairman Terpening closed the public portion of the hearing. After considering the testimony presented during the public hearing, including Staff comments, and the Standards of Review as set in Section 5.3.300, St. Lucie County Zoning Ordinance, Mr. Pruitt made a motion that the Planning and Zoning Commission recommend that the St. Lucie County Board of County Commissioners Grant approval to the petition of American Financial Life Insurance Company for a change in - zoninG from AR-1 (AGricultural, Residenti al - 1 du/ac ) to RS-2 ( Residential, SinGle Family - 2 du/ac). Mrs. KinG seconded the motion. Upon roll call, Mr. Carman, Mr. Sciturro, Mr. Pruitt, Mr. McCain, Mrs. King, Mr. Flowers, Mr. Skidmore and Mr. TerpeninG voted in favor of the motion. Mrs. Allen voted against the motion. This resulted in eight votes in _favor and one vote against the petition.
