PUBLIC HEARING:
Petition of Wilson D. Biggles and Shirley M. Biggles by agent
Phyllis Center for a change-in zoning from R-lC (single family dwelling)
to A-1 (agricultural) for property located on McNeil Road between Edwards
Road and Okeechobee Road.
Mrs. Center and Mr. Biggles appeared before the Commission and Mrs.
Center stated she is representing Mr. and Mrs. Biggles who have a contract
for sale with Donald and Judy ~Peterson contingent upon~.th~ rezoning of-~
the property. The Peterson'.s want to operate a wholesale nursery business
on th'e' front part of the property~ Mrs. Center said, and she presented
photos of the surrounding area. She further stated-the area appears to
be agricultural property at this time, there are t~i-l~e~s, dump trucks
and animals in several of the pictures. She said the business would not
generate any additional traffic and there would be no signs as Mr. Peterson
will be selling wholesale only.
Mr. Peterson told the Commission he has a contract, from year to year
only, with High Point to maintain the lawns. He said he has 108 buildings
and two club houses to take care of and often has to replace plants on the
grounds, which he buys. He stated he would like to have the nu~s_~ry to
fall back on if he should loose his contract and to raise plants to-be used
in connection with his landscaping business.
Mr. Robert Sallette spoke i'n opposition to the petition. He said he
did not have a dump truck or a trailer and had been_.adv~sed by real estate
.people that the rezoning would lower, his property-value. He said his
neighbor to the south also objected to the petition.
Mr. Scott asked Mr. Kelly if this property is rezoned to agriculture
now and the new zoning maps come out in August, as proposed, would the
property revert to residential zoning if the maps indicate residential for
that area.
Mr.-Kelly advised Mr. Scott the new zoning regulations would take into
consideration recent action by the Commission.
Mr. Carman referred to Mr. Ament's Comments and said the proposed
use of the petition could be considered inconsisten~ '

Comments: The proposed site contains approximately 3.7 acres.
There is existing significant residential develop-
ment in the area. Consequently, the proposed use
as a wholesale nursery could be considered to be
inconsistent with ~xisting and proposed future land
use in the area. However, in the past, A-1 zoning
has been deemed to be not. inconsistent.with any future
land use classification.
Mr. Kelly stated that agriculture zoning is consistent in any land
use catagory. Most agriculture zoning does not allow commercial, except
at a very low level, but it does allow residential use at one dwelling
unit per acre.
Mr. Carman stated this could be Spot ~oning .........
Mr. McIver said there is lots of agriculture in this area, horses and
so forth, the total picture is not totally inconsistent with agriculture.
Mr. Carman said there-are-several nice homes in the area.
Mr. McIver said there are nice homes with horses and he did not think
the area would be damaged by permitting a wholesale nursery~
Mrs. King said she concurred with Mr. McIver.
A motion was made by Mrs. -King to approve the petition and it was
seconded-~by Mr. Wetherin§ton.~ Upon vote Mr. Coulson, Mr. Scott, Mrs. King,
Mr. McIver, Mr. Wetherington and Mr. Sciturro voted in favor of-the petition
and Mr. ~Carman and Mrs Fawsett voted against the petition.
Mr. Sciturro stated the~petiti~n will be recommended to the Board of
County CommissiOners for approval.
