Petition of Charles Baum and Jean Guterl for a change from R-lC (residen
tial single family) to M-2 (manufactUring) for property located on the south
side of South Market Ave. about 675 ft. west of U.S. 91 for the purpose- of
establishing a warehouse business.
By a 4-3 vote, the Planning & Zoning Commission recommended denial of
the petition. At that meeting objection was voiced by Mr. & Mrs. Kuhns who
live opposite to this property and concern was expressed by Planning & Zoning
member Moore about the heavy commercial traffic now on this dirt road with-
out anymore being added.
Com. Price asked about the chances of paving So. Market Road but Mr.
Lewis reported that there was insufficient R/W.
Letter was read into the minutes from Mr. Baum urging support of the
petition on the basis that the area is contiguous to a M-2 parcel and that
because of the industry there now it isn't likely anyone would want to build
a home.
Mr. Baum was present and said this was the best use of his property
and he requested the rezoning.
Com. Park stated that the residents already in the residential part
also needed adequate protection from industry.
Moved by Com. Price to deny the petition was second by Com. McCain.
Mr. Baum said the property was unuseable as it now stands and since the
area will go to industry, as voiced by the Planning & Zoning Commission,
warehouses were better than other things which might go in.
Gary Ament reported that although the Planning & Zoning Commission
informally discussed the future of the area, they took no official action
on the matter. ~

The attached drawing shows the location of the property which has been
petitioned for rezoning as well as the surrounding area. Jean Guterl
would like to. have a warehouse constructed on this property for which
aB-3 orB-4 zoning would probably be sufficient, but because this
property is contiguous to an M-2 zoning, that is the only change in
zoning that would be permitted on a property of that size.
As shown on the map there is quite a bit 'of property zoned R-lC in
the surrounding area and there are a few houses on this street. But
.a large area zoned R-lC is vacant. It is difficult to imagine any-
one that would want to use any of this vacant property for use as a
residence. So to refuse a change inzoning of any of this residential
zoned property would probably render it unuseable.
As far as the present residents in the area, it would seem that to
oppose the construction of a warehouse now, could leave the property
open to a less desireable structure in the near future.

PUBLIC HEARING: DECEMBER 7, 1978
Petition 'of Charles W. and Winifred M. Baum and Jean Guterl, for a change
in zoning classification from R-lC (residential, single-family) to M-2 (manu-
facturing) for property located on the South side of So. Market Avenue
approximately 675 ft. West of U. S. #1. '
Mr. Baum was present representing the ~t~tion and he stated ~that South
Market Avenue is primarily business, with this parcel of land adjacent to a
business.
Mr. & Mrs. Kuhns of 430 S. Market presented a petition opposing the
rezoning. Mr. Kuhns said that there are residences on either side of the
property in question and that they live opposite the property.
Gary Ament's comments were read int$ the public record by the Secretary.
Mr. McIver asked for comments or questions from the Board. Mr. Davis
stated that at the last meeting they opposed rezoning on this road. The
road conditions are bad and will not improve with additional traffic, adding
that this is not the right place for manufacturing.
Mr. Tiernan asked Mr. Ament that although you say consistent with future
land use, how far into the future are you speaking of? Mr. Ament replied
that the entire area will have to be looked at as a whole. For the few
scattered residences in the area, rezoning is creating a hardship at the
presen~ time. Rezoning should go slowly in this area at the present time.
Mr. Moore stated that the traffic is extremely heavy now, with commercial
refrigeration and repair depot, warehouses and storage for Southern Bell truck~
and some residences on the road. This area is destined to be industrial in
the future and we have already started this trend. If we continue on this
line, the residential property values will have to go up.
Mr. Baum again stated that this would be making ~he best use of the
property, and although the traffic pattern is heavy, the property to the
rear ms already rezoned for industry. As it stands now, this land is not
compatible for residences, either.
Mr. Davis asked Mr. Baum what the intended use for the property was, to
which Mr. Baum replied, warehouses.
Mr. Kuhns again stated that until the last meeting, everything East of
the canal was residential, then the property next to the canal was rezoned
for a cabinet shop. This was the first step of business zoning into the
residential area. Now this one is the second. We are objecting to putting.
th~s business right in between two residences and furthering business en-
croachment into residential areas.
Mr. Davis stated that M-2 is not light manufacturing, but that M-1 is.
He further stated that B-4 zoning would take care of warehouses.
Motion by Mr. Tiernan and seconded.by Mr. Scott to approve the petition.
The Board was polled and the following votes were cast: Ayes: Mr. Scott,
Mr. Moore, Mr. Tiernan; Nays: Mr. Davis, Mr. Ebner, Mr. Skeffington and Mr
McIver. '
By a 4 to 3 vote, the Planning and Zoning Commission will recommend
to the Board of County Commissioners denial of the petition to rezon~.

Existing Land Use:
The site is currently vacant. Light manufacturing and heavy
commercial to the west toward Oleander Avenue with Iow den-
sity residential development adjacent immediately on the
east and west and Iow density residential development to the
north across Market Avenue.
Future Land Use: Light industry.
COMmeNTS:
Even though the proposed rezoning is consistent with future land use
plans in the area, it is potentially incompatible wiih existing resi-
dential uses along the eastern portion of South Market Avenue. In
addition, it should be noted that South Market-Avenue is unpaved and
contains substandard right of way where it passes the proposed rezon-
ing. Consequently, it is doubtful whether the proposed rezoning
should be ~ranted at this time because of potential land use conflicts
and the fact that South Market Avenue is currently inadequate
to serve ~xisting manufacturing/commercial activities.
