Admn. Lewis explained a series of events relating to this petition saying that when the petition was first heard on J~n. 8, 1980, the Church south of the area objected, not to the horses but other uses and since the revision of the Zoning Resolution would be simultaneous with the adoption of the Land Use Plan, thought to be completed prior to July 1 the matter pr~sentWas tabledto representt° July 1,the1980,petitioners,hOwever, when the matter was brought up on July 1, no' one was thought . . nor was anyone present the following week so it was ' the pet!t~oners was satisfied with their present status since they could still keep two horses. Nevertheless the County has learned that the petitioners are still seeking the A-1 zoning. Mr. Barbel!a was present and stated this was the case. No one was present to object to the rezoning. Moved by Com. McCain to approve the recommendation of the Planning & Zoning Commission and grant the petition, by Resolution No. 80-59 which was seconded by Com. Enns, and upon roll call, unanimously carried. BOARD OF COUNTY COMMISSIONERS JULY 8j 1980 ZONING. ~ PUBLIC HEARING Petition of Victor & Joan Barbe!!a for a change from R-lC (residential single family.] to 'A~i Cag'r'i'~ for property located on the south side of Tumblin Kling Road. Petition was first heard on Jan, 8, 1980, and tabled until July !~'' 1980 because GMPP was expected to be adopted. However, no one was present at the July 1 meeting~ so hearing was continued until today to p~ovide an opportunity for owners to indicate whether they wish to proc.eed with the rezoning. Mr. Thomas advised that his office contacted the petitioners to inform them of today's meeting, He added that in January, 1980, petitioners obtained a building permit for a residence and a stable. However, he has had no in- dication as to their willingness to proceed, so he assumes there is no pro~ btem with the current zoning. Com. Enns commented that it appears they do not need the rezoning; he then moved to deny the petition which was seconded by Com, McCain. Com. McCain questioned the time period for refi!ing if the Board denies the petition. Mr. Thomas stated that because the Planning & Zoning Commission recommended approval, there is no time limit. Roll was then callad and the motion carried unanimously. Later in the meeting, Mr. Thomas advised that he had spoken with Mrs? Barbel!a after Board action to deny and she was quite upset and indicated that she still would like the rezoning. She had evidently understood incor~ rectly when contacted previously that the petition had been tabled indefinite~ ly. Mr~ Thomas asked the Board to reconsider its action. Moved by Com. Enns~ seconded by Com, McCain and, upon roll call, carried unanimously, to reconsider action denying petition of Victor & Joan Barbe!la. Moved by Com. Enns, seconded by Com. Petition was heard of J~- 8, 1980 and tabled until today _ At the Jan. 8th meeting Mrs. Barbeiia said s~e wanted to build a barn on her property large enough to house several horses. Under present zoning she was limited to two. At that meeting there was considerable opposition, not to the hourses, but to the other uses ~nich might be permitted in A-1. Insasmuch as the Zoning Resolution will be revised and adopted when the land use plan is adopted, the petition was tabled until today. Admn. Lewis reported that the Growth Management Plan h~s' been delayed with a completion date now set for 1981; however, ~s. Bathe!la was permitted to build her barn and keep 2 horses, Com. Enns moved to contact Mrs. Barbe!la to see if the problem has been solved, with a report at next Tuesday's meeting, which was seconded by Com. McCain, and upon roll call, unanimously carried. BOARD OF COUNTY COMMISSIONERS JANUARY 1980 Petition of Victor and Joan Barbella for a change from R-!C (residential single family) to A~i ~agriculture) for property located on the south side of Tumblin Kling Road. The Planning and Zoning Commission recommended approval, Mrs, Barbella was present on behalf of the petition and stated that they are requesting the rezoning because they wish to build a home and 5~sta~l horse barn simultaneously and expect to have more than the two horses allowed in an R~iC zone, She said eke had been t01d a barn could not be constructed in a residential zone, and wh~!e~_theY may never hav~ 5 horses, the~ do_~o_w their animals and need the A-1 zoning to enable them to have more than two. Mr. Anthony Carson, Pastor of the So~ Side Baptist Church which is lo- cated on a 5 acre tract immediately south of the proposed rezoning, was pre- sent to object to the peition. He stated that the church does not object to the ho~ses, but is concerned about the other permitted uses in the classifi- cation for :h the property could be developed if sold at a later date. Mr. John McCreary, owner immediately adjacent to_ the west of the church~ concurred with Mr. Carson's statements. Upon a question from Com. Green, Mr, Thomas stated that normal setbacks in an A-1 zone are 25'; however, structures for the housing of livestock are to be ~t least 100' from any property line. Mr. Thomas also read the list of permitted uses in the A~I category. Com. Enns commented that he did not see why there would be any objections as the undesireable uses are permitted only by Special Exception.- Mr. Carson stated that the church would be opposed to a private club wherein alcoholic beverages would be served as such an esta- blishment would not be in keeping with the quality of life the church is try- ing to maintain in the community, He added that the church had sent a let- ter to the P & Z Comm; which advised that they are against any commercial ven- ture being established in the future, and most of the residents were opposed to a stable-type operation. Admn. Lewis read this letter into the record. Com. Park commented that this has been a longtime problem with rezonings, especially in this category, and he asked if the planned revisions to the Zoning Resolution would address the situation. Mr. Thomas advised that it would as intentions are to eliminate uses permitted by Special Exception as well as to create more specific districts within zoning categories. Com. Enns felt that the specific problem of private clubs- in A-1 could be solved immedi- ately with the Board taking action to eliminate the use from A~lo This would end the objections from neighbors and allow Mrs, Barbella to go ahead with her plans. Com. Park felt that the petition should be tabled until the Zoning Resolution is revised. He asked Mr. Thomas if Mrs. Barbella could build her home and barn under the present zoning. Mr. Thomas advised that the structures can be built simultaneously; however, the barn cannot be higher than the house. Com, McCain asked if petitioners are ready to build. Mrs. Barbella stated that they are; the house and barn pads are in, but they have been waiting for the results of this hearing before continuing. Com. McCain then asked if the pro~ perty is rezoned today, would it have to abide by the new distri.ct regulations. once adopted. Mr, Thomas advised that it would; however, if a use now permit- ted is established prior to the adoption of the revised Resolution, that use would be granfathered in. Mrs. Barbella stated that she does not intend to establish a business nor will she have a private club, and she only requests the~rezoning so she will not be restricted to two horses. There was some discussion relative to the completion date of the zoning revision. ~r. Am~nt advised that the final draft will be completed in April; however, since adoption will be simultaneious with the Land Use Plan, this will not be done prior to July, Atty. Adams stated that July would be the earliest possible date in view of the fact that the Land Use Plan schedule is already two months behind. _Moved by Com. Park~ seconded by Com. Mrs. Barbelta was present and stated that because the property across the street was A-1 and because they would like to put horses on the property, they are requesting a change to A-1. Speaking in opposition to the petition were William Dowling of 203 Tumblin K!ing Road, Matt McLaren of 196 Jeffrey Lane, Arthur Polk of 200 Jeffrey Lane and John McCreary of 318 Weatherbee Road. They were opposed to the rezoning because they felt that two'horses were allowed in a resi- dential area, that a barn could be built after obtaining a special exception, that this area is mainly residential and that allowable uses under agricul- ture zoning would not be compatible in a residential area. Mrs. Barbella stated that she was under the impression that she could not build a nice barn in R~!C, and that she may have as many as four horses, as that was the size of the barn they would like to build. She also stated that aside from their residence, nothing else is being considered. Upon questioning by Mr. McIver and clarification by Mr. Thomas, it was stated that accessory uses are not permitted in a residential area until the permitted use is constructed, however accessory uses in agriculture areas are permitted prior to the permitted uses. Mrs. Dowling stated that they were not against horses or the barn, asked Mrs. Barbella what her relationship with Casa May Stables was, and stated that what she intends to do now and what she will do in the future is their main objection, fearing increased traffic on their unpaved road. Mrs. Barbella answered that they have two horses now and possibly in the future two more, but no boarders, and that 'not having a business there will not increase any traffic on the road. Mr. Scott asked Mr. Thomas if based on what they have heard, could Mrs. Barbe!la do what she wants to do in an R-lC zoning. Mrs. Thomas stated that in R-tC an owner of property that resides thereon may have two horses, but they are restricted to two horses. Motion by Mr. Tiernan and second by Mr. Skeffington to approve the petition. The Board was polled and the motion passed unanmmously. The Planning and Zoning Commission will recommend to the Board of County Commissioners approval of this petition.
