Chairman Klein stated that he has a conflict in this matter, and passed the gavel to Mr.
Skidmore.
Mr. Hank Flores presented staff comments. He stated that the proposed project is located
in the southwest comer of the intersection of West Prima Vista and Airoso Boulevards. He
stated that staff finds that this request is inconsistent with Future Land Use Objective 1.1.8,
which seeks to protect residential areas 'from the encroachment of inappropriate land uses.
Mr. Flores stated that the proposed zoning designation could result in an orderly and logical
development pattern if it is planned in a manner which recognizes its potential impact on
the area. He added that commercial development on small lots adjacent to major
intersections present unique problems which should be addressed prior to zoning approval.
Mr. Flores stated, that the proposed amendment without additional detail conflicts with the
public interest and is not in harmony with the purpose and intent of the St. Lucie Land
Development Code.
Mr. Flores stated that the petitioner is requesting a change in zoning from Commercial
Office to Commercial Neighborhood. He added that apattern of Planned Non-Residential
Developments has been established on the comers of the intersection of Prima Vista and
Airoso Boulevards. Mr. Flores stated that staff recommends that the applicant re-sUbmit .
when he has an idea of what he wants to build on this site, and that this petition be
forwarded to the Board of County Commissioners with a recommendation of denial.
Mr. Terpening asked whether this applicant has been informed of the firm position this
Commission has had regarding PNRD and the other actions of previous petitio/~s'. "-
Mr. Flores replied yes.
Mr. Harold Melville, representing the applicant, appeared before the Commission. He
stated that'this property is currently zoned CO, it is in a Commercial future land use area,
and his applicant is requesting CN zoning. He stated that this particular parcel is different
and unique from the other parcels on this corner. He stated that there is no residentially-
zoned property adjacent to this parcel.
Mr. Melville briefly explained the location of the applicant's parcel while referring to the
zoning map on the overhead projector.
Mr. Melville stated that in 1990, the same property owner owned the property and wanted
a rezoning from RS-4 to CG. He said this Planning and Zoning Commission unanimously

voted to deny CG zoning, but recommended to the Board of County Commissioners that
Neighborhood Commercial or CN zoning be approved, and that is the exact zoning that is
being asked fOr this evening.
Mr. Melville stated that there was staff memos dated February 14, 1990 and March 9, 1990,
and at that time staff recommended denial of CG, but also recommended approval of CN;
the same zoning the applicant is seeking tonight. He stated that staff's memo of March 19,
1990, that went to the Board of County Commissioners after Planning and Zoning review,
stated that the Commission voted unanimously to recommend denial of the'petition for CG,
but to recommend to the Board that the property be zoned CN.
Mr. Melville stated that in staff memo, it was stated that CG would be inconsistent' with the
comprehensive plan for this parcel and it would violate the spirit intent of Future Land Use
Objective 1.1.7 of the comprehensive plan. He added that staff went on to say that
Objective 1.1.7 would be supportive of neighborhood commercial in the area.
Mr. Melville stated that it is now four years later and the only thing that has changed is that
Prima Vista Boulevard has been widened; yet now, staff believes that CN zoning is
inconsistent with Future Land Use Objective 1.1.8. He stated that Objective 1.1.8 is the
same as Objective 1.1.7: four years ago, but that it was re-numbered.
Mr. Melville gave a brief presentation expressing his disagreement with staff's comments.
Mr. Terpening asked Mr. Melville if he was familiar with the draft Prima Vista corridor
study ~_
Mr. Melville repled no, he was not.
Mr-. Terpening stated that~ if Mr. Melville were to look at the plans and objectives of that
study, that have been based on recommendation of this Commission and the-Boal, d of
County Commissioners, he would understand the objectives this Commission has regarding
the Prima Vista corridor.
Mr. Walker stated that st~ recommends denial based on code, therefore, is staff in error
or is it a matter of interpretation.
Mr. Melville stated that he believes staff is in error.
Mr. B.J. Davis appeared before the Commission. He asked if Mr. Bauer has told anyone
in the county what he intends to put on his parcel if the zoning is changed?
Mr. Skidmore replied no.

Mr. Davis asked if this Commission has the authority to approve something without the
people of the neighborhood not knowing what is going to happen?
Chairman Skidmore replied yes, a regular straight rezoning can be approved or denied
without knowing exactly what is going on the property. A PNRD is different.
Mr. Davis stated that from the comments alone, he feels' that this petition should be denied.
Mr. Thomas Castle appeared before the. Commission. He stated that what he said before,
goes for the same thing on this petition, proceed a little slower.
Mr. John Salerno appeared before the Commission. He stated that he represents lots 35,34,
and 33 on the zoning map shown on the overhead projector. He stated that without lot 2,
he did not feel that someone could build on that property.
ltearing no other comments in favor or in opposition to ihe 'petition, Chairman Skidmore
closed the public portion of the hearing.
There was a general discussion among the Commission and staff regarding the uses of this
petition.
After considering the testimony presented during the Public Hearing, including staff
comments, and the Standards of Review as setforth in Section 11.06.03, St. Lucie County
I_and Development Code, Ms. Calabrese moved that the Planning and Zoning Commi.qsion
recommend that ~the St. Lucie County Board of County Commissioners deny the application
of Edward Bauer, for a change in zoning from CO (Commercial, Office) to CN
(Commercial, Neighborhood) for the following reasons:
CN zoning for the property in question is incompatible with the existing
residential area; and . . - ., .
2. CO or PNRD would be the logical zoning on the property in question.
Mr. Walker' seconded the motion, and upon roll call, the Commission unanimously voted in
favor of the motion, with Chairman Klein abstaining.
Chairman Skidmore stated that this petition would be f°rwarded to the Board of County
Commissioners with a recommendation of den/al.
A break was taken at 8:53 p.m. and the Commission reconvened at 9:03 p.m.
Mr. Skidmore returned the gavel to Chairman Klein.

Based upon the results of the hearing before the Planning
and Zoning Commission on February 24, 1994 relating to this
rezoning, we are asking that the matter not be put on the County
Commission agenda until May 1994. The applicant: is requesting
that. the matter be deferred so that we can have ~ further .
opportunityt0 .study,the proposed rezoning and to determine 'how"
the PNRD applications filed by Bishop and Amin progress.
During the course of the Planning and Zoning Commission
hearing on this matter, Mr. Terpening made reference' to a draft
Prima Vista Boulevard corridor plan being put together bystaff.
I was unaware of the existence of this draft pla~ and,
accordingly., would appreciate your sending a copy of that draft-

Based upon the results of the hearing before the Planning
and Zoning Commission on February 24, 1994 relating to this
rezoning, we are asking that the matter not be put on the County
Commission agenda until May 1994. The applicant is requesting
that.~the matter be deferred so that we can have a further
opportunity to study the proposed rezoning and to determine how
the PNRD applications filed by Bish0pandAmin progress.
During the course of the Planning and Zoning Commission

This correspondence is in response to the proposed re-zoning of
the property located at the southwest corner of Prima Vista
Boulevard and Airoso Avenue, Port St. Lucie, Florida.
As the property owner of the property located at 125 SE Airoso
BOulevard, I wish to object to the proposed re-zoning of the
above referenced property from CO to CN.
At the present time this area of St. Lucie County is used for
residential purposes. The CN zoning presents too many building
options which might be inconsistent with the surrounding
residential properties, public service activities, community
activities, schools, and traffic patterns.
It is therefore requested that the petition by Mr. Edward Bauer
for rezoning the property from CO to CN be denied.

2. Children at the park across the street will be crossing the
street. Neighborhood convenience stores carrU cigarettes and
beer, which should nob be available to this age group.
3. This is an active school crossing and the traffic is verM
heavM without putting in anM commercial businesses.
~. There is no need for convenience store. This neighborhood'
has gone without such for 30 some wears. Ue now -have Publix
within 8 miles and do not need strip stores to deteriorate the
neighborhood, with stores that will be vacant in a few wears,
River Park has maintained a clean, familM neighborhood and does
not need the encroachment of commercial propertg.

to protect residential areas from the encroachment of inappropriate land uses.
The only means of providing sufficient protection and to allow commercial
uses is through the PNRD (Planned Non-Residential Development) process.

The recently completed widening of West Prima Vista Boulevard from US 1
to Airoso Blvd and the planned widening of West Prima Vista in 1997/98
between Airoso Blvd and Bayshore Blvd. are changes in the area. These
changes do not "require" this amendment.
Whether and the extent to which the proposed amendment would result in
demands on public facilities, and whether or to the extent to which the
proposed amendment would exceed the capacity of such public facilities,
including but not limited to transportation facilities, sewage facilities, water
supPly, parks, drainage, schools, solid waste, mass transit, and emergency
medical facilities;
Th/s rezoning is not expected to create significant additional demands on any
public facilities in this area. The property is located at the intersection of two
minor Arterials.
Whether and the extent to which the proposed amendment would result in
significant adverse impacts on the natural environment;
The proposed amendment is not anticipated to create adverse impacts on the
natural environment. Any future development of this site will be required to
comply with all federal, state, and local environmental regulations.

The proposed zoning designation could result in an orderly and logical
development pattern ff it is planned in a manner which recognizes its potential
impacts on the area. Commercial developments on small lots adjacent to
major intersections present unique problems which should be addressed prior
to zoning approval.

interest, and is in harmony with the purpose and intent of this Code;
The proposed amendment without additional detail conflicts with the public
interest and is not in harmony with the purpose and intent of the St. Lucie
County Land Development Code.
COMMENTS
The petitioner, Edward Bauer, is requesting a change in zoning from CO
(Commercial, Office) to CN (Commercial, Neighborhood). The applicant believes that
rezoning from CO to CN would allow the use of the property for its highest and best use.
The subject parcel is located on the southwest corner of the intersection of West Prima
Vista Blvd and Airoso Blvd. This'corner has previously been rezoned from RS-4 to CO.
If approved, the proposed zoning would allow the parcel to be used for CN (Commercial,
Neighborhood) uses rather than the CO (Commercial, Office) uses currently permitted.
A pattern has been established on the corners of the intersection of Prima
Vista/Airoso Blvd., an area located in the neighborhood of River Park. This pattern suggests
that it is preferable for anyone requesting a change in zoning on this intersection to apply
through the Planned Non-R~esidential Development (PNRD) process. This process is
preferred over a straight CN zoning change, because the PNRD would allow staff to
recommend conditions prohibiting certain uses that would be deemed inappropriate. Staff
prefers to limit uses that encroach upon residential neighborhoods. The PNRD requires an
applicant to specify exactly what it is they want to build and operate. Staff is recommending
that the petitioner resubmit when he has an idea of what he wants to build on this site.
Staff finds that this does not petition meet the standards of review as set forth in
Section 11.06.03 of the St. Lucie County Land Development Code and is in conflict with the
goals, objectives, and policies of the St. LUcie County Comprehensive Plan. Staff
recommends that you forward this petition to the Board of County Commissioners with a
