RESOLUTION NO. 79-101
WHEREAS, the St. Lucie County Planning and Zoning Commission,
after holding a public hearing of which due notice was published
at least fifteen (15) days prior to said hearing and all owners of
property within 300 feet were notified by mail of said hearing, has
recommended to the Board of County Commissioners of St. Lucie County
that the hereinafter described requests for changes in zoning classi-
fication be GRANTED, and
WHEREAS, the Board of County Commissioners held a public hearing
on November 6~ 1979 after publishing a notice of said hearing in the
News Tribune on October 22, 1979.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-

Petition of Villager Development, Inc., by Samuel Aurilio, for ach~nge-in
zoning from B-4 (general business) to R~4E (multiple dwellings) for property
located 181 ft. to the east of So. 7th St., directly east of Francis Lane.
Mr. Aurilio was present and requested approval of this downzoning from the
business to tho residential category which he stated is consistent with the
zoning to the north, west and south of his property. He owns t'he property im-
mediately to the west on which he has two quadraplexes (one completed and one
under .construction) as well as the business property to the east. He intends
to construct a 6~unit residential building (site plan approval to be requested
subsequent to rezoning) on the .8 acre now up for rezoning and feels this will
act asa buffer to the business to the east which, since he owns, he can con-
trol so will create no conflict.
Mr. Douglas E. Gonano was present in opposition to the rezoning and stated
that he represents 86 area residents who have signed a petition opposing the
.rezoning and site plan. The objections, as stated on the petition, were based
on the inability of Francis Lane, an unpaved road and the only means of ingress
and egress for all roads in the area, to handle the construction truck traffic
or ~he volume of traffic resulting from the influx of new permanent residents
occupying the new housing units. Mr. Gonano went onto say that'the petitioners
represent 141 drivers with 99 children, and they are requesting either the
paving of Francis Lane or some other way to divert traffic off the road, which
he stated is in shabby condition most of the time and impassable after a rain.
Com. Green pointed out that surrounding zoning is R-4E except for the B-4
property to the east owned by Mr. Aurilio. Mr. Gonano replied that the real
objection is not with the zoning classification but with the proposed develop-
ment which will create even more of a burden on the already over-burdened Fran-
cis Lane.
Mr. Aurilio stated that he appreciates the concerns raised and has already
instructed his commercial construction vehicles not to use Francis Lane, but
to use the private access route from U.S.#I through Mr. Hensel's property. He
indicated on the map where the private roads are located. He added that he,
too, would like to see Francis Lane paved as it would improve the value of his
property. But, he feels it is improper to penalize him by using his develop-
ment as a means to getting the road improved.
Upon a question from Com. Green~ Mr. Thomas stated that the propert~had
once been zoned R-4E, but had been rezoned to B-4 with the piece immediately
to the west remaining in the R-4E category to act as a buffer and prevent acm
cess by commercial vehicles. Com. Park pointed out that most likely the same
resident, s who have signed the petition presented today had signed a similar
petition requesting the buffer of R~4E zoning on the earlier rezoningr which is
a definite conflict.
Com. McCain discussed the idea of residents requestihg the Board-to inves-
tigate the possibility of a special taxing district fo~ road paving and drainag.
improvements. He explained the p~ocedures involved, and 'stated that since
Francis Lane is not classified as a county collector road, the funds generated
by such a district would be the only means by which the improvements could be
made without fear of a dual taxation suit.
Mrs. Rose!yn DeGrief~ Francis Lane resident, also spoke realtive ~o the
poor condition of the road saying that the county is responsible for maintain-
ing the road and drainage ditches and this is not being properly~ done. She
complained that the %road is not graded more than once a week or once· every 10
days, and when it is, the road dirt is scraped into the ditches which further
aggrlavates the existing poor drainage. She felt that if the ditches were
cleaned out and the road properly graded, residents wouldn't be so apt to com-
plain. Com. Enns pointed out~ as did Commrs. Park and McCain, that there are
many county roads getting much less regular maintenance, and he felt Francis
Lane is no better or worse than any other dirt roads. There was considerable
discussion on the matter of maintenance.
Mr. Aurilio stated that the housing development will be a community for
~etired persons so will not general a great volume of additional traffic. There
will be a total of 14 rental units in the 3 buildings. Com. Park cited concern
about the residences being so close to an area of business, but Mr. Aurilio
said he has a 6' high stockade fence and the start of a hedge for a buffer.
Moved by Com. Green and seconded by Com. Enns to adopt Res. No. 79-101,
which authorizes the rezoning requested by Vi]lager Development, Inc., as well
as that of Mr. Tilton. Com. Green added that he would like the Road Dept. to
grade Francis Lane at least once a week and provide shell for repairs when
needed.
Com. Park stated that there are many roads in his district which haven't
been graded more than once a month. Com. McCain added that he would like to
know how to go about establishing a maintenance crew with equipment for his
district a!one~ Atty. Adams stated that while he is not aware Of anyway this
could be done, he will research the matter. Com. McCain instructed that he
prepare a written report on the subject for next Tuesday's meeting.
After some further discussion, roll was called and the motion carried
unanimously.

PETITION
WHEREAS, Samuel Aurilio has petitioned on behalf of Villager Develop-
ment, Inc. {V.D.I.) for approval of its Site Development Plan, and;
WHEREAS, the Planning and Zoning Commission has recommended that said
petition be approved thus requiring a change in zoning from B-4 {General
Business) to R-4E {Multiple Dwellings, Hotel, and Motel), and;
WHEREAS, approval of this Site Development Plan will result in exten-
sive construction activities requiring V.D.I.'s material suppliers' trucks
and heavy equipment to utilize Frances Lane for all ingress and egress, and;
WHEREAS, Frances Lane is an unimproved and unpaved road which is
quate to even meet the needs of its present users;
NOW THEREFORE, the undersigned residents and/or users of Frances Lane
do strenuously protest the reclassification and approval of ¥.D.l.'s Site
Development Plan and give the following reasons:
1. Unless Frances Lane is paved it cannot properly accommodate the
volume and type of traffic that V.D.I.'s construction activities will cause
during the development phase of the property, and;
2. Unless Frances Lane is paved, it cannot properly accommodate the

% Mr. Auriiio stated that this property was originally zoned R-4E and was
rezoned to B-4 several years ago, and now would like the original zoning of R-4E
again as he is cUrrently building units in that area, with a density of 10.S
per acre. He added that there is a site plan on file that does include this
property.
There was no opposition to the petition.
Mr. Ament's connnents were read into the public record by the Chairman.
Motion by Mr. Tiernan and second by Mr. Ebner to approve the petition.
The Board was polled and the motion passed unanimously.
The Planning and Zoning Commission wil~l recommend to the Board of County
