This change if grauted would create a considerable hardship on the residents of Beach Cl~o Colony. The streets in the colony are only two l~ne ~nd are not prepared to handle additional traffic that would be created by a commercial marin~. It is felt that a change to commercial would greatly reduce the value of o~rproperties in the colony in that all t~e properties were sold with the under- standing that the area in question was to be used strictly for a private marina and a possible two story condominium. At the last meeting of your commission on this same zone change your body suggested that M~. Apostolopoulos and the residents attempt to get together and purchase this property ~s a recreation ~rea for the property ov~ers in Beach Club Colony~ Even although most of us were of the understanding, from previous com~tments at the time we purchased the properties, that the property known as the m~in~ area was to have become common property of the residents without further cost as a part of the original purchase price of the villa units. In spite of this we the owners did get togather approximately $12000.00 of earnest monmy, which is c~rrently held in t~st, to purchase this property at ~ agreed upon price of $90,000°00 . Just prior to the end of M~y 1975 we learned that there were certain commitments made by N_r~ Apostolopoulas to the U.S~ ~rmy Corps of Engineers relative to putting the channel in from the indian ~ver which were not fulfilled as well as some commitments to the State Of Florida on the same cha~el. In attempting to get these items cleared we visited the office of the U.So Army Corps of Engir~uers a t Jacksonville Florida and learned that there had never been a permit requested or granted to use t~s area as a marina but ra~her it had been approved for building p~rposes only and that was subject to completion of several items that N~. Apostolopo~los had agreed to do. ~Je approached !~. Apostolopoulas thru his attorney ~nd advised that we were ready to close on the agreed $90,000.00 purchase providing he would get the clearances from the UoS~ army Corp of ~ineers ~d the State of Florida for this area to be used as a marina and if he could get them to agree to bypa~ ~o~ of the requ~d items th~.t h~ had been prevlov~i~ co~ited to m~k~ ~e had uo objection. ~e did feel that we were not in a position to purchase a $90,000,00 property for a mawina until we were assurs~ that the agencies involved wot~d definitely ~pprove the property for marina use~ %~e are still prepared to purchase this property at the mutually agreed upon fi&ar~ just as soon as we feel we have a good title to property to use as a m~rina, k~e -~derstand that there is not a grs~ deal of expense involved in getting the proper permits but in asm~uch as the orig~_nal des2 was made by ~5r. ~ostolopoulas mud the agencies then he is ~k in a better position to clear'dp these matters th~n we would be as a new owner. This document also provides that should the builder elect to construct docks in that area, these docks can never be sold to anyone other than a con- dominium owner. PRICE, Dislrict No. 5 July 29~ 1975 MEMORANDUM TO WELDON LEWIS RE: REZONING PETITION OF GEORGE APOSTOLOPOULOS The above petition was first filed in our .office on January 31-, 1975. Before the first hearing the residents of Beach Club Colony and George Apostolopou!os began negotiations for the resi- dents to purchase__ the docks_located in their vicinity. The reason George Apostolopoutos had requested this rezoning was to enable him to sell these docks to the .general public. The docks were originally permitted as a recreational facility for the condominiums as Well as residents of Beach Club Colony. In the interim they have requested tabling of this petition on. three (3) different occasions. These requests were granted by the .Planning $ Zoning Boa.rd to enable further negotiations on the purchase of these docks by the Beach Club Colony residents; It was the opinmon Of the Planning Department as well as .the writter of this memorandum that it would be much more desirable to have the lots purchased by the residents which would require no rezoning, than to rezone a portion of this property to B-2 zoning. On July 2, 1975, Mr. Apostolopoulos requested that we re-instate the petition saying.that negotiations had fallen apart and he wished to persue the rezonmng of this property. On the day of the hearing' I received a telephone call from a resident of Beach Club Colony, a Mr. BartOn, asking me if there had been another request made to again table this petition. I advised Mr. Barron that to the best of my knowledge no such request had been received, but suggested he talk to Mrs. Kohler, who ms secretary of the Planning $ Zoning Board, to see if she had-received any request for the tabling of~ this petition. Mrs. Kohler advised Mr. Barron she had receiv&d a telephone request from George Apostolopoulos and had advised him At that time the Plan- ning & Zoning-Board would not rec.ognize such a request proffered by telephone, but it 'would be necessary for them to present the request in writing. Mrs. Kohler indicated she-had been told via the telephone Mr-~ Apostolopoulos would hand .carry a written request to table this petition sometime Thursday afternoon. We received a hand carried re- quest for tabling from Mr. Apostolopoulos, delivered by. his son to me personally at approximately 2:30 Thursday afternoo, n July 24th. I advised the bearer of this letter that we would forward the request to the Planning $ Zoning Board, but this did not indicate automatic tabling of the petition since this required affirmative vote 'of five members of the Planning g Zoning Board, and if he wished to insure proper consideration of his request he should be represented at the meeting to explain in person the reason he was requesting tabling. , I Memo to Weldon Lewis Page 2 Re: George Apostolopoulos At 4:15 on Thursday afternoon Mr. Barton again called Mms. Kohler, who advis'ed him we had received a written~request from Mr. Apostolopou_ los requesting tabling of the petition. She informed Mr. Barton this did not represent official tabling: but rather the request would be reviewed by the Board who would then take either affirmative or negative action on the request. Thursday night when this petition was read at the Planning Zoning hearing~ the letter requesting tabling was also prese~nted. I personally' recommended to the Board the tabling of this petition after having discussed it with Gary Ament and sharing the same feeling~ it would be better for St. Lucie County if we were not required to rezone this and the negotiations for residents to purchase these docks could be completed. Mr. Larry McIver, a member of the' Planning Zoning Board disagreed with tabling, and made a motion not to table the petition but rather to take action one way or another at this heaming'-. This-action was taken and the recommendation for approval of the petition was made to the Board of County Commissioners by a vote of 6 to 2 of the 8 members present at the Planning $ Zoning meeting. . · Following the publication in the newspaper of the results of this meeting', I have received a barrage of calls from residents of Beach Club Colony accusing us of being party to setting ~them upj./~ various other behind the' scene involvements of'this a&t~on. A three man committee from Beach Club Colony visited my office on Monday of this week and indicated the only reason they did not attend this meeting was because they had received word from this office that the Apostoloph oulos petition had been tabled. I .can absolutely guarantee that no one was told that this petition was tabled. In fact, we had only the three telephone calls from the one individual previously mentioned in this memo, and the final word given to him at 4:15 Thursday afternoon was that we had received a request for tabling but the decision rested with the Planning & Zoning Board as to whether or not they would grant the request, we have been very careful concerning requests for tabling since the problem arose on the John Keane petiti0n~ and I am confident and positive that this is_.the exact-happening so far as.-this office is concerned. I un de rs t.an d from hearsay only, Mm. Apostolopoulos's secretary called numerous people involved in protest against this petition and told them that it had been tabled. This' ms unfortunate and I can sympathize with the people protesting this rezoning, but since I will be on vacation when this petition is heard before the Board of County Commissioners I want. it .definitely understood that regardless Of accusations or statements made by dis a'ppointed protestors, that in no way was the Building & Zoning Department or any employees involved in misinformation to' the applicant or the notified property owners. I will appreciate very much if you will so repmeSent this at the County Commission hearing in the event it is otherwise presented by people protesting the rezoning. It might be helpful if'you would discuss this with Gary Ament~ who I am sure will at least bear out my statements concerning the treatment of this request at.the Planning & Zoning hearing.
