The Planning & Zoning Commission recommended approval of the petition. Memo from Development Coordinator advised that this rezoning encompasses about 18 acres which could house a shopping center with up to 200,000 sq. ft. and while the proposed rezoning meets the commercial guidelines for shopping areas of the Growth Management Policy Plan, the proposed rezoning should excluf land needed by DOT for major intersection improvements to Virginia Ave. and Okeechobee Road. He also recommended that no access to the property should be allowed from Virginia Ave. Atty, Chet Griffin, representing the petitioner was present and said the property has a depth of 840', abuts a grove, and has 350' fronting on Virginia Ave. but there will be no access from Virginia Ave. They will al'so need ~ite plan approval for any development. Com. McCain asked if developer'will give additional R/W for DOT inter- section improvements to Virginia Ave. and Mr. Griffin said they would. Moved by Com. (B-2 and'R-lC to B'.-3}- EXISTING LAND USE: FUTURE LAND USE: The :proposed rezoning i§=~currently in citrus. To the north across Okeechobee Road is the proposed Fort Pierce Shopping Mall.. Land use to the eastland to the south is either vacant or Low Density Residential-. Generally Low Density Residential throughLout this entire area with commercial development at high access locations. COMMENTS: The proposed rezoning encompasses almost eighteen (18) acres. As such, a shopping center with up to two hundred thousand~sq, ft. gross leasable area could be built on the site. Th~ proposed rezoning meets the commercial guidelines (page 73) for community shopping areas of the Growth Management Policy Plan. The proposed rezoning should specifibally exclude land needed by DOT for major intersection improvements to Virginia Avenue and Okeechobee Road. Prior to rezoning a procedure might be considered for dedication of the'required right-of-way at the north west corner of the proposed rezoning. No access to the property should be allowed from Virgi.nia Avenue. Access should be provided from Hartman Road ~nd the proposed'two ~signalized intersecti,ons on Okeechobee Road. Chester B. Griffin, Attorney, was present for the petitioners. He stated that this property i§ _oca~ed at the intersection of Hartman and Okeechobee Roads, just across the street and slightly south of the~!ocation of the new Fort Pierce Mall and consists of 17 to 18 acres w~th 18S0 feet on Okeechobee Road, 350 feet on Virginia Avenue and 840 feet on Hartman Road, South, which is the dirt section of that road. The rezoning sought for this property is commercial use, which is not ~neonsistent with the Ft. Pierce Mall. Mr. A~ent has suggested that something be worked out on the right-of-way with DOT at the two signal sites for the Mall, to which the property owners are in agreement. There was no opposition to the petition. Chairman Scott read Mr. Ament's comm&nts into the record~in summary form. Motion by Mr. Tiernan and second by Mr. Davis to apprwve the petition. Mr. Moore inquired of Mr. Griffin as to whether or not he was familiar with the ri~gh~-of-way and access on Virginia Avenue; and that Mr. Ament had suggested that there be no access allowed from Virginia Avenue. Mr. Griffin replied that he.was vaguely aware and that the petitioners were agreeable for safety reasons. The Board was polled and the motion passed unanimously.
