February 5, 1988 Page 2 Subject: Barnett~Bank - River Park Expansion Comments: Barnett Bank of St. Lucie County, is proposing to construct an additional 43,500 square feet of office space at their current facility at the corner of South US #1 and Prima Vista Boulevard, in the River Park section of St. Lucie County.. This addition will be located on what was, until very recently, the site of Florida Home Finders real estate offices. As the Board will recall, on January 26, 1988, you were presented with a request to rezone a tract of land adjacent the existing Barnett fa~itit¥ for use as a parking lot for this proposed expansion. At that public hearing, several comments/commitments were made by Barnett representatives in regard to the development of this site and those comments/commitments have been incorporated into these development plans. As required under St. Lucie County Zoning Regulations, the developers have submitted a traffic impact report for review. This report has beenreviewed by County Staff and its conclusions accepted in regard ~o the projected impacts. At this time the only non-site related traffic improvement that the developers are to be responsible fo~, is the dedication of the north ten (10) feet of the project site, for the future expansion needs of Prima Vista Boulevard. Wi~ this in mind, staff recommends that any approval action for this project contain the following condition of approval: Prior to the issuance of any building permits for any portion of this development project, the developer shall dedicate to St. Lucie County the north ten (10) feet of the project site for the future ~ight of way needs of Prima Vista Boulevard, as indidated on the Site Plan referenced in Section A of this Resolution. Consistent with our impact fee regulations, it will be necessary for the developer to submit floor plans of the new addition, along with plans for the existing, facility, in order for an accurate determination to be made. When these plans are submitted, the issue of Road Impact Fee credits may also be addressed. In summary, County staff has reviewed the proposed development plan and determined it consistent with the requirements of the St. Lucie County Zoning Ordinance. Attached you will find a copy of Draft Resolution #88-38 which will grant approval to this development project. Staff recommends approval of Draft Resolution #88-38. France, for a change in zoning from U (Utilities) to CO (Commer- cial, Office) for property located at the southwest corner of the intersection of Prima Vista Blvd. and Banyan Drive. Mr. James R. France presented the petition. He explained that a parking area is planned for a new main office facility which will be constructed in the future at the corner of Prima Vista Blvd. and U.S. 1. He explained that parking requirements include five spaces per 1,000 sq. ft. The existing parking area will not meet those requirements when the new building is cgnstructed. After clearing, the parcel will be paved and landscaped as an addi- tional employee parking area. Mr. France said that the urban forester has indicated that most of the foliage is characterized as nuisances. Mr. David Gregory, Senior Vice President with Barnett Bank of St. Lucie County, offered the Board and the audience a conceptual exhibit to help visualize the planned site. He pointed out an existing water retention area. Propane tanks that are located on the property will remain on the parcel under GDU's control. He also mentioned CoUnty landscaping requirements in the area that abuts residential uses. Mr. Gregory also offered an "as-built survey" which demonstrated what is now located on the property. He suggested a comparison between the survey and the conceptual plan exhibit~. Upon request, Mr. Murphy pointed out the area on the overview that is designated with an "A" and an arrow is not included in the petition, and has propane tanks located on it. The area that is designated "A" is also not a part of the petition and will remain in its present state of a pond or water retention facil- Mr. Terpening said'that under the existing Utility zoning classi- fication a parking lot coULd be constructed on this property to serve utility purposes; however, the parking lot could not be used for the bank's purposes. Mr. Murphy then said that if the bank were to construct a utility-type service on"the property, parking would be permitted as an accessory to that particular use. The Utilities designation does not permit"'just a motor vehicle parking lot. The parking lot use intended by the bank would require a change in zoning to CO. Commercial, Office is a iow intensity commercial district, consistent With' other property located along this~.corridor. Even though it may be split by a right-of-way, it is'considered an accessory to the bank expan- There was no further public comment in favor of the petition. Regarding opposing commentS, Mr. Joesph Archiprete stated con- sioners has accepted as the general guide for development in this community. In that document there are specific policies and standards that are used to evaluate requests. It is not possible to poll neighborhoods regarding particular requests; therefore, notices are sent to adjacent property owners announcing the appropriate hearings to be held to approve or deny those requests for change. Mr. Archiprete then gave a detailed account of his con6ern re- garding heavy traffic and flooding problems in the subject area. He felt that a parking lot would add to existing problems. He mentioned petitions that had been signed by residents in the area, and said that he was representing those that had signed the petitions. AdditiOnally, Mr. Archiprete mentioned the future plans for four-laning Prima Vista Blvd. and increased traffic when the New York Mets come to Port St. Lucie. For the record, Chairman Terpening mentioned one letter of oppo- sition from Mrs. Elinore Marvin who stated her concerns regarding traffic. Additionally, Chairman Terpening mentioned for the record two separate petitions in opposition to the petition. Both petitions state concerns regarding traffic and drainage problems. One petition was signed by 13 individuals from 11 households, the second petition was signed by 17 individuals from 14 households. Mr. Paul Johnson stated his opinion that part Of the traffic problem in the subject area is caused by the inefficient func- tioning of the traffic light at the end of Rio Mar. He also felt that the advent of the New York Mets would contribute to traffic problems. Mr. JohnSon also stated his concern that parking lots attract persons of a mischevious character. Regarding Staff comments, Mr. Murphy said that Staff had deter- mined that the rez~ning request to CO would be c~nsistent with the overall development policies of the County. Mr. David Gregory said that Barnett Bank is trying to fulfill their objectives in the least objectionable fashion. He said that drainage would improve because the facility would have to meet current County standards and requirements. Mrs. Fawsett expreSsed her concern for'the residents that abut the subject parcel~'J Mr. Sciturro asked.'if the Meehan's, owners of Lot 64 which directly abuts the subject parcel, had signed one Of the peti- tions presented to~this Board. The Secretary informed Mr. Sciturro that Mrs.'~Helen Meehan of 280 Banyon Drive had signed the petition in opposition. Mr. Sciturro then ~Sked Mr. Murphy what protection in the way of buffers the adjacent residents had from the parking lot. Mr. Murphy said that presently there is no such protection provided, but if the property i~ reclassified to CO and the use proceeds as a parking lOt, current~development codes would require an expanded landscaping area between the residential and nonresidential areas. The ~in.i~m landscaping buffer would be 10 ft. in width and minimum height of vegetation would have to be 5~.ft., growing to a height of 6 ft. in a certain length of time. A~fence or. wall would have to be 6 ft. in height. After considering the testimony presented dUring~the public hear- ing, including staff commen%s, and the~Standard~ of Review as set out in Section 5.3.300, or'the St. Lucie CoUnty Zoning Ordinance, Mrs. Fawsett made a.m°tion that the Plannin~ and .Zoning Commis- sion recommend the Board Of~County Commissioners deny the peti- tion of Barnett Bank of St. Lucie County for a change in zoning from U (Utilities) to CO (Commercial, Office), because she did not feel abutting residents would be protected. Mrs. Ferrick seconded the motion when Mrs. Fawsett agreed to amend her motion -5- to include the problems of flooding and traffic. Under discus- sion, Mr. Terpening said he had a problem with the future road expansion of Prima Vista Blvd. and the fact that the parcel is not suitable for residential use. However, he also expressed concerns regarding/the buffering of the southerly portion for residents. Mrs. Fawcett agreed that the northerly portion could be rezoned, but did not agree with rezoning the southerly portion of the parcel. Upon roll call, Mrs. Fawcett and Mrs. Ferrick voted in favor of the motion, and Mr. Terpening, Mr. S6iturro and Mrs. King voted against the motion. This resulted in two votes in favor and three against the motion. In that the motion for a recommendation of denial did not carry, Chairman Terpening called for a new motion.
