HomeMy WebLinkAboutCapron Trail PUD~gR~DUM TO: FROM: DATE: SUBJECT: Capron Trail PUD - Project File Planning Administrator December 2, 1987 Project Status On Tuesday, December 1, 1987, the St. Lucie County Board of County Commissioners granted approval to Ordinance #87-93, approving a change in land use for property located at the intersection of Emerson Avenue and Indrio Road. This change from residential to commercial effectively voids the existing approvals for the development project known as Capron Trail Estates, due to the fact that any further development in accordance With the approved preliminary development plan is no longer possible with this commercial designation. To develop this project in any other manner will require a new PUD process. Therefore, effective this date, the approval for Capron Trail Estates PUD, is considered to be null and void. Copies of this memorandum are to be placed in all appropriate project files. On December 18, 1985, this Board granted preliminary planned unit development approval for a project known as 'Capron Trail Estates, to be located at the Northwest corner of Emerson Avenue and IndriO Road. 2. On December 5, 1985, the St. Lucie County Planning and Zoning Commission held a public hearing of which due notice was published in the Fort Pierce News Tribune and mailed to all property owners within 500 feet at least 15 days prior to the hearing, and recommended to this Board that preliminary development plan approval for Capron Trail Estates Planned Unit Development be granted. 2. This Board held a public hearing on December 18, 1985, of which due notice was published in the Fort Pierce News Tribune and mailed to all property owners within 500 feet at least 15 days prior to the hearing. 3. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Zoning Ordinance, the St. Lucie County Growth Management Policy Plan, and the Code of Ordinances of St. Lucie County. ~o.¢&~/ 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the.neighborhood, traffic conditions,, parking, utility facilities, or other matters affecting the public healthy safety, and general welfare. 5. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A~ Pursuant to Section 3.3.121 of the St. Lucie County Zoning Ordinance, preliminary development plan approval for Capron Trail Estates Planned Unit Development be, and the same is hereby, approved as shown on the drawings for the project prepared by James A. Kirby, Registered Land Surveyor, and as further described in the accompanying submissions of the developer, Art G. Russakis, subject to the following conditions: 1. That prior to the approval of any Final Development Plans for this project, the developer shall prepare a recordable instrument that will satisfy the St. Lucie County School Board that school age children will not be permanent residents of this project. 2. That prior to the approval of any Final Development Plans for this project, the developer shall meet and satisfy all of the fire protection requirements of the Ft. Pierce-St. Lucie County Fire D~strict. 3. The developer shall locate an emergency access point along the southern or eastern property boundary. 4. The developer shall construct both right and left turn lanes to the requirements of the St. Lucie ~County Engineer at the main project entrance. 5. The developer shall, the first peak season following the issuance of the 280th Certificate of Occupancy for this project, conduct, at his expense, a Traffic Signal Warrant Study for the intersection of U. S. #1 and Indrio Road and the intersection of U. S. #1 and the Turnpike Feeder Road (aka Kings Highway, $.Ro 713). If such signalization is warranted, the developer shall provide a financial contribution to St. Lucie County to provide the signalization. The amount of said contribution shall be determined by the percentage of this development,s traffic using those intersection(s). To assure compliance with this condition, the developer shall, prior to the issuance of any Building Permit for this project, provide a bond in the amount to cover complete signalization of these two intersections. Bo The Conditions set forth in Section A are an integral and nonseverable part of the preliminary development approval granted by this resolution. If any condition set forth in Section A is determined to be invalid or unenforceable for any reason, the preliminary development plan approval granted by this resolution shall become null and void. C. Unless within one year of the date of this resolution a final development plan is filed pursuant to Section 3.3.121(5) of the St. Lucie County Zoning Ordinance, the preliminary development plan approval granted by this resolution shall become null and void. D. A copy of this resolution shall be attached to the planned unit development submissions described in Section A, which submissions shall be placed on file with the St. Lucie County Development Coordinator. Russakis (by Agent Devitt j. Adams) for a change in zoning from AG (Agriculture) to P.U.D. (Planned Unit Development). On Wednesday, December 18, 1985, you will be~asked to review a petition by Art Go Russakis to rezone property at the Northwest corner of Emerson Avenue and Indrio Road to Planned Unit Development (P.U.D.). The petitioner is propOsing to construct a 330 unit retirement community of 74 acres. This petition was presented at the December 5, 1985 Planning and Zoning Commission meeting and was recommended for approval by a vote of 5-2. At the Planning and Zoning Commission Public Hearing, several concerns were. voiced by members of the Commission and the public. The first, and perhaps most confusing, was the type of structures to be provided. The developers of the project have indicated to staff and have gone on record as saying, that the proposed homes will not be mobile homes or manufactured homes. Rather, these units will range in size from 1,344 square feet to 2,016 square feet, and will be constructed in complete compliance with the requirement of the Standard Building Code. In so far as this committment is adhered to, the developer will not be required to provide on site emergency shelter. Any proposals by the developer to construct or assemble any other type of residential dwelling unit, other than a conventionally constructed, single family~ detached dwelling unit, will require a complete resubmission of the P.U.D. application. Several residents of the Lakewood Park area expressed their concern about the potential impact that this project would have on the roads in Northern St. Lucie County. As indicated in my memorandum of November 27, 1985, the developer has submitted a Traffic Impact Report for review. The report indicates that no roadway will fall below an acceptable level of service as a result of this project. In recommending approval of this petition, the Planning and Zoning CommisSion also recommended that proPosed Condition #3 be modified so that the emergency access point would be relocated as to exit onto a paved roadway. County Staff would therefOre recommend Condition #3 be modified to read: 3°) The developer shall locate an emergency access point along the Southern or Eastern property boUndary. As the Board is aware, a Planned Unit Development requires three Public Hearings. At this time, you are being asked to grant preliminary approval to this project. ShOuld the Board grant this request, the petitioner will have up ito one year to return to this Board and seek final~,development Plan approval. County Staff recommends that this petition be approved subject to the recommended conditions of the staff memorandum of November 27, 1985.
