The St, Lucie County Local Planning Agency, after holding a public hearing on May 12, 1987 of which due notice was published at least seven (7) days prior to said hearing and all owners of property within five hundred feet (500') were notified by mail of said hearing, has recommended that the Board-amend the future land use classification set forth in| the St. Lucie County Growth .Management Plan from SU (Semi Urban) to RL (Low Density Residential) for the property described below. 3. Special acks of the Florida legislature applicable only to unincorporated areas of St. Lucie County, County ordinances and County resolutions, or parts thereof, in conflict with this ordinance are hereby superseded by this ordinance to the extent of such conflict. E. SEVERABILIT~. If any portion of this ordinance is for any reason held or declared-to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this ordinance. Chairman Terpening turned the gavel over to Vice Chairman Mabel Fawsett in order to abstain from the first three items on the agenda due to a conflict of interest. PUBLIC HEARING: Petition of Needy Trust to amend the Future Land Use'Maps of the St. Lucie County Growth Management Policy P~an from SU (Semi Urban) to RL (Low Density Residential) for property located on the north side of Orange Avenue, approximately 1800 ft. east of the Sunshine State Parkway (Florida Turnpike). Mr. Jorge Dorta-Duque presented the petitiog. He said that a manufactured-home community was proposed for the subject area, and that use is not against the Growth Management Policy Plan. He pointed out that the property is surrounded by canals, the turnpike and Orange Avenue, which allows adequate buffering. They are proposing to bring in water and se~er to the site from Ft. Pierce Utility Authority, which will also benefit surrounding property owners. Mr. Dorta-Duque also said that the planned manufactured-home community would also serv( as a buffer for the future semi-urban uses on Kings Highway. Mrs. Ferrick asked if property owners would be required to hook up to the water and sewer service line. Mr. Dorta-Duque said that the Ft. Pierce Utility Authority does not have a policy requiring that the area homeowners are hook up to their service; however, that service would be available if they wished. Mr. Carman clarified with Sta{f that Ft. Pierce Utility Authority cannot legally require hook-up for those areas out of the City of Ft. Pierce. Mr. Russakis asked Mr. Dorta-Duque how far the subject site is from the jail. Mr. Dorta-Duque referred the question to Mr. Murphy, who replied that the property site is 1/4 to 1/2 mile from the jail. He also informed the Board that the County is in the process of acquiring one of the parcels in that area, and is looking at some of the others. Mrs. Fawsett inquired if a traffic study had been completed, what kind of impact will the proposed manufactured-home community have on Highway 68. Mr. Dorta-Duque said that a traffic study would be part of the PUD presentation, and was not a part of this presentation. Vice Chairman Fawsett asked for public comment in favor of the petition. There was none. Regarding opposition, Mr. Grady Owsley, bought his adjacent property 10 years ago when it w~s agricultural land. With the recent construction of a jail a d 911 building, he feels that Ft. Pierce is moving in that direction. He didn't feel a community development of the type proposed is needed. Mr. Tony York owns property adjacent to the proposed site and has a bee business on his property. He expressed concerns regarding flooding. He also pointe~ out the location of a nearby hog farm. He felt that the presence of bees and hogs may not be compatible with a development such as that proposed. There is also.a vegetable farm nearby which use~ a considerable amount of insecticides at times. He said that during a heavy rain, the relief canal backs up and floods the subject property. Mrs. Fawsett pointed out to Mr. York a conceptual drawing that indicated where retention ponds and/or lakes are planned. Mr. York expressed his concern that these measures may not be sufficient to control the water. Mr. Hector Arias, Engineer for the proposed project, assured the Board and Mr. York that the water will have to be controlled, that permits are required from the flood control district assuring compliance. He said that they have to be able to handle a 25-year storm ~hich i~volves quite a few inches of water. Regarding a retention area, Mrs. Ferrick asked Mr. Arias if there Mr. Arias said in the area. she is a canal on the side boundary. indicated was an existing pond, and what she thought' may be a canal is a buffer zone. Mr Dorta-Duque said the develgpment would have about 600 units, which a little less than 4 units per acre. 'Regarding the gas line, he said that it is an easement that is crossed by two roads. He said the petitioned area is a transitional area between the more intensive uses around the interchange of ~-95 and Orange Avenue and the lower suburban/agricultural uses west of th~ Florida Turnpike. In reviewing Comments from the Department of Community Affairs DCA did not and the Treasure Coast Regional Planning Cogncil, the reference this petition specifically, but generically stated, that it is generally consistent with State plans and policies. The Treasure Coast Regional Planning Council referenced this petition specifically and pointed out the large forested areas on the site and the existing wetland areas. These areas will be addressed in specifics during the PUD process as to plans to preserve, create or mitigate. Mr. Russakis said he thinks the proposed project is a good use of the land, as it is getting too ~xpensive to farm. However, he was concerned about the relief canal water, tha~ is the very water that floods the Orange Blossom ~all. St. Lucie County has submitted proposed land use amendments to the State Department of Community Affairs, which in turn is seeking Council's comments. Background St. Lucie County is considering two amendments to the Future Land Use Element. Locations of the properties under consideration are shown on the accompanying map, and the number of acres and proposed changes in land use designations are summarized in the attached list. Evaluation The proposed amendments to the Future Land Use Element have been reviewed in accordance with the requirements of Chapter 163, Florida Statutes, Council's review procedures, and Council's adopted plans and policies. The following comments are offered as a result of that review. The proposed amendments are pt ~n conflict or inconsistent with the policies of Council' proposed Comprehensive Plan.
