RESOLUTION NO. 79-54
WHEREAS, the St~ Lucie County Planning and Zoning Commission,
after:hotding-aPublic hearing of which due notiOe ,was published at least
fifteen (15) days prior to said hearing and all owners of property
within 300 feet were notified by mail of said hearing, has recommended
to the Board of County Commissioners of St. Lucie County that the
hereinafter described request for a change in zoning classification
be GRANTED, and
WHEREAS, the Board of County Commissioners held a public hearing
on June 19, 1979 after first publishing notice of said hearing in the
News Tribune'on June 4, 1979.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-

property located on the North side of Orange Ave. Ext., approx. ~2/3. mile east of Jenkins Rd.
to enable petitioner to carry on his business of sales, service and building Of truck equip-
ment, fork lifts and backhoes.
By a 4-3 vote the Planning & Zoning Connnission recommended approval of the petition.
The area requested for rezoning (10 acres) was shown on a map, a 1200' strip along
the canal (1~8" wide more or less) leading into a 5 acre square tract. The first 200' of
the strip on Orange Ave. is now B-3, the remainder of the property A-1.
Mr. St~ was present to explain the reason for ! ='
ocauing' on this property, saying
he has outgrov~ his present site and wishes to build on this property which he owns. He
produced letters from 2 neighbors, Mr. Noelke and Metzgar Road Land Trust who are not
opposed to the rezoning.
Mr. and Mrs. Campbell who are building a home on the opposite side of the canal,-
directly across the 5 acre tract, objected because they were fearful of what could go in a
B=4 classification. ~o Campbell said they would not object to a B-3 classification, but
Mr. Stam~ indicated that in order to build truck bodies, B-4 was necessary.
Commrs. Park and Price were especially against B-4 across from the C~mpbell's home and
there was some suggestion to allow only B-3 or B-2 in the rear 5 acre tract to which
Stamm agreed. Com. Park asked if this tract could remain in A-1 and Mr. ThOmas advised
that if this_was the ~case it could only be used~-for storage purposes_as an accessory to
an agriculture use; however, Mr. St~n agreed to withdraw the 5 acres from his petition.
After considerable deliberation, it was moved by Com. McCain to approve the ~ended
petition (B-4 for the 1200' strip with the 5 acre tract to remain A-i) which was seconded
by Com.

PUBLIC HEARING:
Petition of Investors'Diversified, Ltd., Inc., by John H. Stamm, Jr.,
for a change in zoning c!assifieation from B-3 (arterial business) and A~i
(agriculture) to B-4 (general business) for property located on the North
side of Orange Avenue Extension, approximately 2/3 mile East of Jenkins Road.
Mr. Stamm explained that he would like to relocate his business from
the present location, said business consisting of sales, service and building
of truck equipment, fork lifts and backhoes. There would also be some small
manufacturing of truck bodies. The property is adjacent to Turner Machine.
Speaking in opposition was Joe Campbell, for himself, his brother and
Mr. Don Crow. Ail are adjacent property owners. They objected to the broad
us~of B-4 zoning. Mr. Thomas explained that because of the manufacturing
of-~ruck bodies they would require a B-~ zoning, and that Turner Machine,
although adjacent to this property, is non-conforming. Mr. Campbell com-
plained that they have already moved cars and truck bodies onto the property
and this can be seen from their residences.
Mr. Lawrence Baumker spoke for himself and his sister, both adjacent
property owners. Their land is zoned agriculture for citrus and object to
a business zoning adjacent to their Troves. They also mentioned that the
entrance to their property ~s off the canal and they are afraid that this
access will be affected.
Mr. Stamm explained that the vans stored on the property will be dis-
posed of as soon as the insurance settlement is made, stating that he is not
in the junk business. He said that he has outgrown his present location and
intends to build a nice building and improve-the property. As for the access
across the canal, he intends to improve and enlarge it for everyone's use.
Motion by Mr. Moore and second by Mr. Davis to deny the petition. The
Board was polled and the following votes were cast: Ayes: Mr. Moore, Mr.
Davis, and Mr. Scott; Nays: Mrs. King, Mr. Gorham, Mr. Tiernan and Mr. Ebner.
The motion failed to pass.
A motion to approve the petition was made by Mr. Tiernan' and seconded by
Mr. Gotham. The Board was polled and the following votes were cast: Ayes:
Mrs. King, Mr. Gorham, Mr. Tiernan, Mr. Ebner; Nays: Mr. Moore, Mr. Davis,
and Mr. Scott. The motion passed by a 4 to 3 vote.

County Commissioners approval of the petition.

Existing Land Use: Vacant and citrus. Land to the east is currently vacant
and is zoned Low Density Residential, while land to the
west across a large canal is in grove and Light Indust-.
rial uses.
Future Land Use:
COMMENTS:
The proposed rezoni~g to B-4 is totally incompatible
with existing zoning patterns in the area, and with-
existing land uses in the area. The proposed future
land use for the area is Medium Density Residential.
Currently, the canal on the west side of the proposed rezoning
serves as an adequate buffer from widely scattered Heavy Comm-
ercial and Light .Industrial uses to the west. The proposed
rezoning to allow Heavy Commercial uses likely would allow an
unsatisfactory precedent for a continuation of Heavy Commercial
and Light industrial uses along a major gateway to the City of
Fort Pierce. More than adequate amounts of properly zoned land
exist within the vicinity of this proposed rezoning and else-
where in the County.
