HomeMy WebLinkAboutHilliard Groves IncRESOLUTION NO: 80-75 WHEREAS, the St. Lucie County Planning and Zoning Commission after holding a public-hearing of which due notice was published at least fifteen (15.) days prior to said hearing and all owners of property within 300 feet were notified by mail of said hearing, has recommended to the Board of County Commissioners of St. Lucie County that the hereinafter described requests for changes in zoning classi- fication be denied and granted respectively, and WHEREAS, the Board of County Commissioners held a public hearing on August 26, 1980 after publishing a notice of said hearing in the News Tribune on August 11, 1980. NOW, THEREFORE, BE IT RESOLVED by the Board of County Co_mmis- sioners of St. Lucie County, Florida in meeting assembled this 26th day of August, 1980 as follows: 1. The Planning & Zoning Commission recommended approval of the petition. Atty. Bert Bittan Jr. was present to explain that the operation of Hiltiard Groves has expanded from a small fruit stand to a large packing house and that their retail business has recently moved to Okeechobee Road leaving, the packing house available fo~ packing an~ coloring fruit besides their own, and also selli~ wholesale, which necessit-ates the B-4 zoning. He saida~e Planning & ~earlng Zoning Commission only one person was present wh~advocated the change. Com. Park asked if the zoning.classification will stay the same under the Growth Manage-.- ment Plan and Gary Ament said he wouldn't expect it to stay the same. Com. Enns, being reluctant to permitting heavy commercial on a major highway, asked Mr. Johnson Cowner) that if he was granted B-4 now would he rezone it back to Agriculture- under the GMP if it permitted his operation, and Mr. Johnson said he would have no objection to doing so. Bittan, Jr., for a change in zoning classification from B-~ (arterial business) to B-4 (general business) for property located on the southeast corner of Kings Highway and Andrews Avenue, Mr. Sherwood Johnson, one of the owners of Hilliard Groves, was present and stated that the petition covered some five acres of their property. They have been in business some 35 years in St. Lueie County, that their business has grown considerab!y,, and that they find the B-3 zoning somewhat limiting. They are requesting the change in zoning in order to construct degreening rooms. Mr. Davis asked what kind of gas is being used, to which Mr. Johnson answered that they use ethylene, mn- fused at 850 in order to remove the chlorophyl. The gas is not harmful in any wayl The fruit, although mature inside, cannot be packed when green. Mr. Scott asked why the degreening room would not be in A-i, to which Mr. Moore added that he could not understand why a B-4 zoning would be necessary. Mr. Thomas answered that B-4 first permits fruit packing and shipping, that the operation is now permitted because of the fruit packing, but to bring in other people's fruit for processing in this room would in effect make them a licensed fruit packing and shipping house; hence the need for B-4 zoning. This is helping them make this changeover. They probably could do some processing under the present B-3 zonmng for their own retail business, but to wholesale, or for processing of other people's fruit, then it becomes questionable and~on the line. I have, in fact, recommended that they request this change to B-4. Mr. Davis asked if the process could not be interpreted as agricultural processing and stay within an A-1 zoning. Mr. Thomas replied that any in- dustry in A-1 is only by Special Exception from the Board of Adjustment, and smnce this property is not presently zoned A-i, it is not applicable here. Mr. Bittan, attorney for Hilliard Groves, commented that they had been in business for years and is one of the most substantial operations in the Indian River area, having grown from a retail stand to a half-million dollar plant. Times and things change, and having a degreening room on the premises is now not only more efficient, but economically more feasible. There was no opposition to the petition. Mr. Ament's comments were read by the secretary. PLANNING AND ZONING COMMISSION JULY 24, 1980 Page 2 Motion by Mr. Moore to approve the petition, and a second by Mr. Davis with a comment that there must be some other way for them to use this as they want without a B-3 zoning, as B-4 is so much more permissable. He added that they were the best in their business and have been here a long time. For that reason, I will second the motion and vote for the rezoning. Mr. Moore added that he agreed with Mr. Davis, that a zoning classi- fication ~or this type of business is necessary because S..R. 713 lends itself to this type of development. Mr. Thomas replied that under existing regu- ~ations, ~t would be necessary t.o rezone the p~operty back to A-I, then apply to the Board of Adjustment for a Special Exception to serve agricultural interests 100%, which would permit anything they want under agriculture, but the Board would set limits on this. He further stated that we have per- mitted the extension of their operation and issuing of a building permit, but that We ha~e suggested B-4 zoning for their operations that might be an extension of this. The only other way is through the Board of Adjustment. When asked by Mr. Davis how long this would take, Mr. Thomas replied a mini- mum of 90 to 120 days, with the rezoning for A-i through the Planning and Zoning an~ Board of County Commissioners taking about 60 days, and then through the Board of Adjustment another 30 days minimum. Mr. Moore commented that fo~ future use, a written policy covering this, would be preferable, coming probably from Mr. Ament.. Mr. Thomas stated that under the new GMPP, Mr. Ament might have commented on what should be permitted. Mrs. King added that this should be taken care of under the new AG classification, but that we are talking of adoption sometime ,near July of 1981. Mr. Davis then asked if the Planning and Zoning Commission would recommend A-1 to the Board of County Commissioners, would it speed things uP? Mr. Adams replied that -legally, rezoning it to A-1 would make it non-conforming, and he did not think the County Ordinances would permit this. M~. King then asked for the vote with the Board being pol{ed and the motion' being unanimously passed. (B-3 to B-4) t~isting Land Use: The proposed rezoning is currently used for Neighborhood Cancnercial, General Ccnrnercial, and industrial processing. Surrounding land use is a/most exclusively citrus. Future Land Use: Low Density Residential and Citrus. The proposed Growth Management Policy Plan definitely reflects the desirability of not developing either strip conrnercial or Heavy Ccmnercial land uses along S. R. 713. S. R. 713 is one of the few arterial roadways in the County which is not bordered by continuous strip ccnrnercial zoning. The proposed rezoning to B-4 (Heavy Conr~rcial) is inconsistent with future land use plans for the area and existing zoning pat- terns in the area.
