January 2, 1990 Through previous correspondence you know that the Board of Counts' Commissioners proposed to change the zoning on your prop~rty=' in the Metzger Road area. Several attempts were made to contact you prior to the November 14, 1989 public hearing. The last letter dated October 30, 1989, was sent certified mail, and is attached for your information. The highlighted areas of the attached letter show that this office requested the return of the survey prior to November 7, 1989. The return receipt of your letter shows the date of delivery to be October 31, 1989. Your survey was not received by this (~ffice until November 20, 1989; six (6) days after the action on the proposed rezoning. Only those persons who responded prior to the deadline were inclu~Led in the rezoning petition presented to the Board of Cou~t~' Commissioners. For this reason, your petition was not included and cannot legally be included in the rezoning area. If you wish to pursue this rezoning, you will need to follow the regular procedures for rezoning. Owners who did not respond to the initial letter were sent a second request shortly after the Planniag and Zoning Commission hearing of October 26, 1989. At the Planning and Zoning-Commission hearing, several prope~ty owners appeared to reiterate their position on the rezoning after having mailed their survey responses. Following the public hearing, the Commission voted unanimously to recommend the ~p~roval of the rezoning. Fenn, Dennis Murphy explained to the Board that this area currently has a Land Use Classification of Industrial and Zoning of Industrial which has been carried land- usewise since ' 81; zoningwise since ' 84; a problem recently surfaced in that there are still several residential homes in the area which are computed as non-conforming uses and that he recently had an application for an expansion of the non- conforming which went beyond what we could do under our currenn non-conforming allowances; staff is requesting authorization from the Board to initiate a Change in Zoning petition for the areas outlined in red on the map displayed for the Board, and to reclassify only the Zoning to Residential 4 units to the Acre, which would allow the issuance of a building permit for the minor expansion than was sought, as well as address the future needs of the residenEs in the area; staff would not change the Land Use Plan, and staff would also include in all the notices to the effected landowners, an opportunity to opt out of the rezoning.
