County Commission Review February 9, 1993 Resolution Number 93-008 File Number RZ-92-012 MEMORANDUM DEPARTMENT OF COMMUNITY DEVELOPMENT TO: County Commissioners FROM: Development .Administrator DATE: February 3, 1993 Petition of the Board of County Commissioners of St. Lucie County for a change in zoning from AR-1 (Agricultural Residential 1 du/ac) to I (Institutional) for property in St. Lucie County, Florida On Tuesday, January 26, 1993, you will be asked to review the Petition of the Board of County Commissioners of St. Lucie County for a change in zoning from AR-1 (Agricultural Residential - I du/ac) to I (Institutional) for property located on the north side of West Midway Road approximately 1/2 mile west of Selvitz Road, east of and adjacent to the existing Post-Office in St. Lucie County, Florida. Approval of this petition would allow any of the permitted uses listed in Section 3.01.03 X. I - Institutional zoning. The petitioner has indicated that it is the intent to construct and operate an administrative facility for the St. Lucie County Sheriff. The Planning and Zoning Commission reviewed this petition at its December 3, 1992 meeting. Following the review of the petition and opportunity for public comment, the Planning and ZOning Commission voted 7 - 0 with 1 abstention to recommend approval of the petition for the change in zoning. Attached you will find a copy of Draft Resolution 93-008 which would grant approval to the petition, our original staff report, and the minutes of the December 3, 1992, Planning and Zoning Commission meeting. APPROVAL OF PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF OCTOBER 22, 1992. Mr. skiM_ore made a motion that the Planning and Zoning Commission approv~_t_h_e minutes of the Regular Meeting of October 22, 1992. Mr. McCain seconded the motion, ~nd upon roll call, the Board voted in favor~.:~o~f the motion. PUBLIC HEARING - BOARD OF COUNTY COMMISSIONERS FILE .NO. RZ-92~012 Chairman Terpening stated that his firm had at one time been professionally involved with the development of this project and he would therefore abstain from voting. Mr. David Kelly presented staff comments. He stated that the purpose of this petition is for a change in zoning from AR-1 (Agricultural, 1 du/ac) to I (Institutional) for property located immediately east of the post office facility on Midway Road. He stated that this is a 10 acre site and the proposed use is to allow the construction of Sheriff's Administrative Complex. He stated that the proposed is consistent with all elements of the St. Lucie County Comprehensive Plan. Mr. Kelly stated that a fire station is approximately 'three miles away; U~ili~ies willlbe water byFort Pierce Utilities and sewer by St. Lucie County. No additional right-of-way will be required of this parcel, however, a 40 foot right-of-way dedication is being proposed as part of the project. Mr. Kelly stated that this petition meets the Standards of Review as set forth in Section 11.06.03 and staff recommends that this petition be forwarded to the Board of County Commissioners with a recommendation Of approval. Mr. Mccain asked Mr.!Kelly whether or not the 40 foot right-of-way dedication scheduled for 1996 and 1997 is for both lanes of Midway Road. Mr. Kelly stated yes, the 40 feet wouldcover the' needed right-of- way on that side of the road, for that section of the road. Mr. McCain asked staff how much right-of-way is there now? Mr. Miller stated the right-of-way for Midway Road is 80 feet. Mr. McCain asked whether or not the right-of-way for future expansion of Midway Road would be taken from the north side of the road. Mr. Dennis Murphy, L~nd Development Manager, stated'that'tentively, and consistent wmth how it has been done in the past. Right-of-way would come from the north side because of the canals on the south side of the rOad. 11 Mr. McCain asked whether or not the Post Office conveyed property to the County. Mr. Murphy.stated that the Post Office conveyed 20 feet of property at the time their petition was originally approved. Mr. Skidmore asked whether or not the subject property was in the Fort Pierce Utility Authority (F.P.U.A.) Service area. Mr. Kelly stated that it is in the F.P.U.A. area. He stated that the proposed construction of their wastewater treatment plant is sometime in the future, and that service is not yet available. The Post Office has it's own facility. The proposal is to run a line down Midway Road to Selvitz Road to a lift station and connect there, at this time. At some future date the sheriff's facility will be connected to a F.P.U.A. plant. - Mr. McCain.asked-whether or not there is an agreement between the County and"F.P.U.A, in this area for utilities. Mr. Terry Virta, Community Development Administrator, appeared before the Commission. He stated that at this time there is a "Gentleman's Agreement" that exists between the City of Fort Pierce and St. Lucie County that dates back to the "201" wastewater plan that was' done several years ago.-~An actual formal agreement delineating service area boundaries has been under negotiation for the last few years. He stated that the actual agreement between the City and the County has yet to be signed. Bearing no further comment in favor or in opposition to the petition, Chairman Terpening closed the public portion of the hearingl. He stated that the proposed construction of their wastewater treatment plant is sometime in the future, and that service is not yet available. The Post Office has it's own facility. The proposaI is to run a line down Midway Road to Selvitz Road to a lift station and connect there, at this time. At some future date the sheriff's facility will be connected to a F.P.U.A. plant. M~. McCain asked whether or not there is an agreement between the County and F.P.U.A. in this area for utilities. Mr. Terry Virta, Community Development Administrator, appeared before the Commission. He stated that at this time there is a "Gentleman's Agreement,' that exists between the City of Fort Pierce and St. Lucie County that dates back to the "201" wastewater plan that was done several years ago. An actual formal agreement delineating service area ~oundaries has been under negotiation for the last few years. He stated that the actual agreement between the City and t-he County has yet to be signed. Hearing no further comment in favor or in opposition to the petition, Chairman Terpening closed the public portion of the hearing.
