WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. The Board of County Comm{ssioners of St. Lucie County
presented a petition for a change in zoning from CO (Commercial
Office) to RM-11 (Residential, Multiple-Family - 11 du/ac) for the
property described below.
2. The St. Lucie County Planning and Zoning Commission, held
a public hearing on the petition on October 22, 1992~ after
publishing notice at least fifteen (15) days prior to the hearing
and notifying by mail owners of property withinfive-hundred (500')
feet of the'subject property. At that public hearing, the Planning
and Zoning Commission recommended that the Board approve the change
in zoning classification from CO (Commercial' Office) to RM-11
(Residential, Multiple-Family - 11 du/ac) for the property
described below.
3. On November 24, 1992, this Board held a public hearing on
the petition, after publishing a notice of such hearing in the Port
St. Lucie. News on November 4, 1992 and notifying by mail owners of
property within five-hundred (500').feet of the subject property.
4. The proposed zoning change is consistent
Lucie County Comprehensive Plan and has satisfied thewith the St.
standards of
review set out in Section 11.06.03 of the St Lucie County Land
Development Code. '

Com. Culpepper requested an update on an item that was to be on
the agenda regarding the glitches that were in the Comp Plan with
regard to residential properties that were subsequently land used
commercial.
This item was addressed by the Community
Administrator.
Development
It was-the consensus of the Board-to change the land~ use and
zoning for the area that is affected at n~ cost to the- people
involved.and hold the policy open for other, areas which will come
up in the future. Staff was directed to inform those .in the
affected area that the Board of County Commissioners will at.
their initiative, initiate a zoning and land use change for the
area. Staff to report back next week.

On Tuesday, November 24, ~992, you will be requested to review the petition of the
Board of the County Commissioners of St. Lucie County for a change in zoning from CO
(Commercial Office) to RM.11 (Resident/al, Multiple-Family. 11 du/acL The properties
71hich are included iff this p~t/on were rezoned fron~ RM-11 (Residential'Multiple Family
alu/ac) to CO (Commercial Office) during the comprehensive rezoning reviews of the
County which were completed in April of 1991. This petition, if approved, will permit
owners of-existing single-family residences within'the petitioned area to obtain bank loans
for improvements to their homes and to obtain refinancing of existing loans. Under the
current, zoning designation these single-family residences are considered non-conformin us
and, therefore~ ~are not eligible to obtain lo~, ..... -~ .... ...... g es
w .... a~ mtuc~ currently lenomg regulations.
The Planning and Zoning Commission held a public hearing on this application on
October 22, 1992. Following the review of the petition and opportunity-for public
comments, the Planning and Zoning Commission voted unanimously to recommend that this
Board grant approval to this rezoning. -- -
Attached you will find a copy of the minutes from the October 22 hearing, a copy of
the original staff report on the matter, and a.copy of Draft Resolution #92-255, which would
grant approval to the request.

approve the minutes of-the Regular Meeting of September 2_4, 1992.
Mr. Sattler seconded the motion, and upon roll call the Board
voted in favor of the motion. '

~---r. Luis Serna presented Staff comments. He stated that the ~urpose
of this petition is to allow, for the expansion of existing single-
family residences on property which is currently zoned CO
(Commercial, Office). The area included within this petition is
composed of eleVe~ parcels totalling approximately 7.5 a~res. These
properties were rezoned from RM-11 (Residential, Multiple-Family 11
du/ac) to CO (Commercial Office) in 1991 as part -of the
comprehensive rezoning reviews of the County. He stated that the
property is situated between CG (Commercial General) zoning to the
east along South U.S. 1 and Residential Single-Family and Multi-
Family to the west.
Mr. Serna stated that as a result of the change in zoning on these
properties to CO, the single-family residences existing on these
properties legally became non-conforming uses, meaning ther~could
be continued maintenance of the residences, but they could not be
expanded. -
Mr. Serna statgd_ that in recognition of the potential hardship to
property owners in the area, the St. Lucie County Board of County
Commissioners has petitioned that these properties be rezoned to a
designation which will allow for the expansion of the existing
single-family resi.~/nces, but which will serve as a transitional
zoning district between the commercial uses to the east, and the
residential uses to the west.
Mr. Serna stated that this petition, with its RM-11 zoning
designa~i0n, is appropriate.at this location and that the amendment
.is consistent with the surrounding zoningand land uses. He further
stated that staff recommends that this petition be forwarded to the
Board of County~ ~ Commissioners with the recommendation of approval.
Chairman Terpening asked whether o~ not the residential area was
the reason for the Commercial Office zoning. _.
Mr. Kelly stated that the Comprehensive Plan designated 600 feet of
property on both sides of U.S. 1 as Commercial. Within that land
use there are several consistent zonings. Mr. Kelly referred to the
overhead transparencies for clarification to explain the different
zonings. He stated that when the County assigned consistent zonings
within the residential areas they used Commercial Office because
it was a less intense use. '
Ms. Alien stated that it was not the intent of the Comprehensive
Plan hearings to change the zoning of the residential
neighborhoods, and she further stated that they should be kept
residential.

Mr. Serna r~plied that the proposed zoning, if approved, would be
permanent. He stated that the proposed zoning would be a transition ..
from less intense zoning west of the property to commercial zoning
to the east.
Hearing no further comment in favor or in opposition to the
petition,' Chairman Terpening cIosed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including staff comments, and the Standardsof Review as
set forth in .Section 11.06.03, St. Lucie County Land Development
Code, Mr. McCain made a motion that the Planning and Zoning
Commission recommend that the St. Lucie County Board of_Eounty
COmmissioners grant approval to the application of The Board of
County Commissioners of St. Lucie County for a change 'in zoning
from CO (Commercial Office) to RM-11 (Residential, Multiple-Family
- 11 du/ac). Mr. Skidmore seconded the motion and upon roll call
the Board vote~ unanimously in favor of the motion.
Chairman Terpening ~tated that this petition would be forwarded to
the Board of County Commissioners with the recommendation of
approval. ~

This amendment represents a logical transition from commercial uses
associated with South U.S. 1 development east of the property to
single-family and multi-family residences west of the property. The
property is contiguous to other parcels having the petitioned zOning
designation.

The proposed amendment has been determined to be not in conflict
with the public interest, and is in harmony with the purpose and intent
of the Land Development Code.
The purpose of this petition is to allow for the expansion of ex/sting single-family
residences on progeny which is currently zoned CO (Commercial, Office). The properties
which are included in this petition were rezoned from RM-11 (Residential, Multiple-Family-
11 du/ac) to CO (Commercial, Office) during the comprehensive rezoning reviews of the
County which were completed in April of 1991. The intention of designating these
properties CO (Commercial, Office) during the comprehensive rezoning process was to
provide a transitional zoning district between the CG (Commercial, General) zoning-to the
east along South U.S. 1 and the existing multi-family and single-family residences to the west.
A result of:the change in zoning on these properties to CO (Commercial, Office) was
that the single-family residences existing on these properties became legally non-conforming.
This status allows for the continued maintenance of these residences, but does not permit
them to be. expanded.
-In recognition of the potential hardship to property owners in this area due to the
non-conforming status of their propeny, the Board of County Commissioners of St. Lucie
County has petitioned that the zoning on these properties be changed to a designation which

Staff has reviewed the petition and has determined that the amendment is consistent
with the standards of review for amendments to the Official Zoning Arias, Section 11.06.03
of the Land Development Code. The pattern of development in the area from Oleander
Avenue to South U.S 1 is a transition in !and uses from single-family to multi-family
residences to commercial uses. The proposed RM-11 (Residential, Multiple-Family- 11
du/ac) will adequately serve as a transition in land use intensities from commercial- associated
with south U.S. 1 development and multi-multi family and single-family to the west of the
subject property.
Staff recommends that you forward the petition- to the Board of County

Residential Uses in Commercially designate~'areas
At the County Commission meeting of September 15, 1992, a
question was raised on exactly what actions the Board took in
designating certain properties for nonresidential use, both in
zoning and land use, when existing residences were present. The
State daw, Chapter 163 F.S., which required that the Comprehensive
Plan De prepared also required that the land development
regula~ion~ be brought into conformance with that Plan within a
year. The law essentially requires that the land uses shown on the
Plan be reflected in zoning. As provided in the Plan, residential
land use categories permit only residential zoning districts with
some very limited nonresidential services; commercial land uses
permit only commercial zoning districts and industrial zoning
districts permit only industrial zoning districts. There are some
special exceptions to these rules, but in general the zoning
district applications are limited by the Future Land Use
designation over the property. As'a result, it was necessary that
certain properties be zoned to a category other than that for which
they were being used in order to be compatible with the land use.

Commercially Designated Areas
The problem that has apparently emerged is that a property
owner seeking to refinance his property has found that the lending
institutions are no longer making loans to these nonconforming uses
but instead are insisting on looking at them as zoned for lending
purposes. This appears in part to be driven by changes at the
federal level with regard to basic lending practices.
At this time this office is in the process of putting together
a map identifying where these area inconsistencies exist in order
to determine exactly the extent of the issue. ~owever, before we
can complete this project some additional direction from the Board
is required. Should staff put focus to just those a~eas of
inconsistent concentration or should we identify each property that
may be looked at as inconsistent, regardless of size? Staff would
suggest that the analysis include every property if the Board
wished to initiate such a program of change.
Once staff has completed this mapping task, the Board will
need to authorize the public hearing process in order to change
these properties. During the hearing process individual property
owners would be in the position to say whether or not they wished
such a change.

The problem that has apparently emerged is that a property
owner. . seeking~ .to refinance his property has found that the lending
institutions are no longer making loans to these nonconforming uses
but instead are insisting on looking at them as zoned for lending
purposes. This appears in part to be driven by changes at the
federal level with regard to basic lending practices.
At this time this office is in the process of putting together
a map identifying where these area inconsistencies exist in order
to determine exactly the extent of the issue. However, before we
can complete this project some additional direction from the Board
is required. Should staff put focus to just those a~-eas of
inconsistent concentration or should we identify each property that
may be looked at as inconsistent, regardless of size? Staff would
suggest that the analysis include every property if the Board
wished to initiate such a program of change.
Once staff has completed this mapping task, the Board will
need to authorize the public hearing process in order to change
these properties. During the~hearing process individual property
owners would be in the position to say whether or not they wished
such a change.

APPROVAL OF~ PLANNING AND ZONING COMMISSION MINUTES OF REGULAR
MEETING OF SEPTEMBER 24, 1992.
Ms. Calabrese made a motion that the Planning and Zoning Commission
approve the minutes of the Regular Meeting of September 24, 1992.
Mr. Sattler seconded the motion, and upon roll call, the Board
voted in favor of the motion.
PUBLIC HEARING - BOARD OF cOUNT~ COMMISSIONERS

Mr. Luis Serna presented staff comments. He stated that the purpose
of this petition is to allow for the expansion of existing single-
family residences on property which is currently zoned CO
(Commercial, Office). The area included within this petition is
composed of eleven parcels totalling approXimately7i5 acres. These
~r~pertles were rezoned from RM-11 (Residential, Multiple-Family 11
au/ac) to CO (Commercial Office) in 1991 as part of the
comPrehensive rezoning reviews of the County. He stated that the
property is situated between CG (Commercial General) zoning to the
east along South U.S. 1 and Residential Single-Family and Multi-
Family to the west.
Mr. Serna stated that as a result of the change in zoning on these
properties to CO, the single-family residences existing on these
properties legally became non-conforming uses, meaning there could
be continued maintenance of the residences, but they could not be
expanded.
Mr. Serna stated that.in recognition of the potential hardship to
property owners in the area, the St. Lucie County Board of County
~om~iSsioners has petitioned that these properties be rezoned to a
designation. . which, will allow for the expansion of the existing
sln~.le-family residences, but which will serve as a transitional
zoning district between the commercial uses to the east, and the
residential uses to the west.
Mr. Serna stated that this petition, with its RM-11 zoning
desigr~ation, is appropriate at. this location and that the amendment
is consistent with the surrounding zoning and land uses. He further
stated that staff recommends that this petition be forwarded to the
Board of County Commissioners with the recommendation of approval.
Chairman Terpening asked whether or not the residential area was
the reason for the Commercial office zoning.
Mr. ]Kelly stated that the Comprehensive Plan designated 600 feet of
property on both sides of U.S. 1 as Commercial. Within that land

Mr. James Kiernan, an adjacent property owner, appeared before the
Commission. He asked Mr. Serna why he had stated that the new
zoning would be "transitional." He asked whether or not this zoning
would be permanent.
Mr. Serna replied that the proposed zoning, if approved, would be
permanent. He stated that the proposed zoning would be a transition
from less intense zoning west of the property to commercial zoning
to the east.
Hearing no further comment in favor or in opposition to the
petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including staff comments, and the Standards of Review as
set forth in Section 11.06.03, St. Lucie County Land Development
Code, Mr. McCain made a motion that the Planning and Zoning
Commission recommend that the St. Lucie County Board of County
Commissioners grant approval to the application of The Board of
County Commissioners of St. Lucie County for a change in zoning
from CO (Commercial Office) to RM-11 (Residential, Multiple-Family
- 11 du/ac). Mr. Skidmore seconded the motion and upon roll call
the Board voted unanimously in favor of the motion.
Chairman Terpening stated that this petition would be forwarded to
the Board of County Commissioners with the recommendation of
approval.

APPROVAL OF PLANNING AND ZONING COMMISSION MINUTES OF REGULAR
MEETING OF AUGUST 27, 1992.
Mr. Sattler made a motion that the Planning and Zoning Commission
approve the minutes of the Regular Meeting of August 27, 1992. Mr.
McCain seconded the motion, and upon roll call, Ms. Allen, Mr.
Carman, Mr. Flowers, Mr. Sattler, Mr. McCain, Ms. Calabrese, Mr.
Klein and Chairman Terpening voted in favor of the motion.
Mr. Skidmore abstained from voting because 'he was not present at
that meeting.
PUBLIC HEARING- DR. SUSAN F. McCLuRE
FILE :NO. CU-92-008
Mr. Luis Serna presented staff comments. He stated that this
PetitiOn is for Conditional Use approval to operate a kennel in AR-
1 (Agricultural, Residential -1 du/ac) zoning He stated that the
appl~cant currently operates at this location, ~ hospitalfor small
animals known as Barber's Midway Animal Hospital. The facility is
located On a three (3)'acre parcel at 3404 West Midway Road.
'Mr, Serna stated that "kennels", as defined in the Land Development
Code and as restricted in the AR-1 zoning designation, allows for
the boarding~ breeding, and sheltering 6f dogs and cats within a
completely enclosed structure. Because of this restriction, and the
relatively low residential density of the surrounding properties,
the f~ility is not expected to have an adverse impact on
properties ~n the ~area. He stated that staff believes that the
parcel is of sufficient size for the facility to be operating
without affecting neighboring properties. He further stated that
staff recommends that this petition be forwarded to the Board of
County Commissioners with the recommendation of approval.
Mr. Bret McClure, co-applicant, appeared before the Commission. He
stated that he didn't have much to add to staff comments except
that he would prefer to have the facility called a "boarding
facility" instead of a "kennel." He stated that they are trying to
provide the best available service to their clients.
Mr. Sattler asked how many animals they might be boarding at one
time.
Mr. McClure stated about 20 animals.
Mr. Sattlerasked whether or not there is a restriction 6n the size
of the animals that are being boarded.
Mr. ~Clure stated that it would be strictly small animals just
dogs ahd cats. '

the. subject property. He questioned whether or not there is a plot

Chairman Terpening asked staff if there was such a plan showing the

Mr. Seuna stated that staff does not have a plot plan for the

Mr. Mallon stated that he Would object to a separate building being
added on at a later date. He stated that he would not object to
expanding the existing building because of the parcel size.
Mr. Mallon presented pictures to the Commission of the residential
property in the area that would be affected if a separate structure
were to be constructed on the back two acres of the subject
property, He stated that the existing animal hospital now faces
Midwa~ Road, if the petitioners constructed a~separate building on
the rear of their-property, then the noise of the barking dogs
would[ be a nuisance to the surrounding property owners.
Mr, Carman asked Mr. Mallon how far away his house is from the
animal hospital.
Mr. Mallon stated that his house is closer to the petitioners back
two acres. "~
Ch'ai~an Terpening asked Mr. McClure where he would be constructing
a separate building, or if he had intentions of expanding in the
future.
Mr. McClUre stated that he can appreciate his neighbors objecting
to noisy, barking animals, becaus~ he doesnot like them either. He
stated that ~his intentions are to move .out of the half of the
existing building they now occupy as their'living facility and to
expand the-clinic into that building, giving them an additional
1,300 square feet. He further stated that if needed, he would like
to be able'to expand to a separate structure, aborting the existing
facility. He stated that he would build the new structure as soun~
proof as possible, in order to accommodate his neighbors concerns.
Mr. Flowers asked Mr. McClure how far back from the existing
building would he build the separate facility.
Mr. McClure stated the facility would be built as close to the
existing building as possible.
Chairman Terpening stated that Mr. Mellon's concern seemed to be
that a building might be constructed on the back portion of the
subject. _ property. He asked the petitioner if he would have any
objections to a limitation being set on where the kennel would be
placed on the property.
Mr. Mc~lure stated yes, that he was hesitant to discount that
option~ In fact, he wo~ld ~like to have the option· of using an
existing structure located toward the rear of his property.
Mr. Klein asked whether or not they would be living on the
prem~.ses, once they vacate the current living facilities.
Mr. McClure stated yes.
Mr. Klein asked whether or not the facility would still be subject
to the nuisance law.
Mr. .Jim Lancaster, Assistant County Attorney, stated that the
nuisance laws would still apply even if the-petitioners did not
live at the facility.
Mr. Klein asked whether or not their intention would be to board
animals just for Dr. McClure's clients, or for anyone that would
need their animal boarded.
Mr. McClure stated, just their clients.
Mr. Sattler. asked what the distance would be from the corner of the
existing building to where Mr. Mallon's house is situated.
Mr. Mallon stated approximately 400 feet.
Mr. Sattler asked whether or not an addition of 1,500 square feet
on the back of the existing building would be a problem.
Mr. Mallon stated that it would not be a problem for him, but it
might, be for his neighbor Mrs. Walther.
Mrs. Nancy Walther, an adjacent property owner, appeared before the
Commission. She stated that her concern is the widening of Midway
Road. If the right-of-way takes most of her yard, then she and her
husband will have to,build a new home on their remaining back acre,
which would put their home alongside the new addition on the animal
hospl, tal. She further stated that until she knows all the details,
she cannot be in favor or in opposition to this petition.
Mr. Raymond Black, an adjacent property owner, appeared before the
Commission. He stated that his concerns were whether or not the
petitioners were going to have a private kennel, or a boarding
kennel. He stated that there is a difference between the two.
~Chairman Terpening asked whether or not the Land Development COdes
distinguish between a private kennel and a boarding kennel.
Mr, Serna stated that the Code does not distinguish between a
private kennel and a boarding kennel.
Mr. Black stated that in Broward County t.hey distinguish between
the two. A Private kennel is where dogs are raise~ together and
they do not bark. A boarding kennel has different people bringing
in dogs that do not know each other, so they bark. He asked which
type of kennel the petitioner was proposing.
Chai~-~anTerpening stated that as staff answered that question, the
County does not make a distinction between the two. If this
petition is approved, the petitioner will be able to board animals
as he sees fi~.
Mr. Black asked if a stipulation could be added to the Board's
decision so that the petitioner could not build on their back two
acres.
Mr. Sattler asked whether or not a new Conditional use W°uld have
to be submitted if an addition is added to the existing building.
Chaiz~an Terpening stated that it would depend on the conditions.
This Board could recommend that conditions be placed on the
proposed use. He stated that without any special conditions, the
applicants could build anywhere they choose on their property, as
long as theymeet the proper setbacks.
Chairman Terpening asked that a letter of concern received from
Edward Becht, Attorney, representing Mrs. Busch of the Busch Family
Foundation, be noted into the record.
Mr. Klein asked which parcel belonged to Mrs. Busch in relationship
to the petitioned Property.
Ms. Allen stated that it is Parcel No. 16 owned by Boatmen's Trust.
Mr. Skidmore asked how many animals can to be boarded at the
applicants existing facility.
Mr. McGlure stated that they have no facilities to board animals.

Ms. Ca~abrese asked whether or not the petitioner would have any
objections to placing an attachment onto the existing structure.
Mr. McCture stated no, they would not.
Chairman ~orgening asked ~. ~ancaster ~f there was a need ~o

decision. .
Mr. Lancaster stated that this Board can makea recommendation to
the Board of County Commissioners as they see fit, and if the
applicant, is willing to compromise on a condition to the approval,
that would certainly be preferable.
Bearing no further comment in favor or opposition to the petition,
Chairman Terpening closed the public portion of the hearing.
After considering the testimony presented during the public
hearing, including Staff comments, and the Standards of Review as.
set forth in Section 11.07.03, St. Lucie County Land Development
Code, Ms. Calabrese made a motion that the Planning and Zoning
-CommisSion recommend that the St. Lu~ie County Board of' County
Commissioners grant approval to the application of Dr. Susan F.
McCl~Lre for a Conditional Use to operate a kennel in AR-1
(Agricultural, Residential - 1 du/ac) zoning with the following
restriction:
That the applicant operate the kennel within the current
structure or in an attachment to the current structure.
Ms. Allen seconded the motion.
Mr. Skidmore stated that he would like the motion amended to
restrict the location of the kennel to the front one acre of the
property.
There was a general discussion among the Commission regarding
limiting the size of the proposed addition.
Ms. Calabrese stated that she would amend her motion to include the
second restriction.
Mr. Klein Stated that he had a problem with the motion requiring
that the addition be attached.
Upon roll call Ms. Allen, Mr. Skidmore, Mr.- Flowers, Mr. McCain,
Ms.'Ca~abrese and Chairman Terpening voted in favor of the motion.
Mr. Carman, Mr. Sattler and Mr. Klein voted against the motion.
Chairman Terpening informed the agent' for the petitioner that the
petition would be. forwarded to the Board of County Commissioners
with t~e recommendation of approval with the two conditions as
specified.

PUBLIC HEARING - PAUL JACQUIN
FILE NO. RZ-92-007
Ms. iD~ana Waite presented staff co~ents. She stated that this
applic~tion is for a change 'in zoning from RS-2 (Residential,
Single-Family - 2 du/ac) to AG-1 (Agricultural - 1 du/ac) in order
to establish a commercial landscape nursery on 30 acres. The
subject property is located approximately one mile north of
Okeechobee R~ad (SR70),. between SoUth Jenkins Road and Interstate
95. She stated that the subject site is abutted by grove and
nursery operations to the south and east.
Ms. W~ite stated that the applicant intends to replace an old
unmaintained grove with a tree farm for the sale of trees for
landscaping. . purposes. She stated that the proposed zoning change is
not anticipated to create an adverse impact on the natural
environment. The proposed nursery operations would only include the
use of herbicides and not pesticides. Any future development on the
site would have to comply with all state and local environmental
regulations. She stated that the applicant intends to maintain the
ex~stihgcabbage palms and oak 'trees that border much of the site.
She further s~ated that this Would provide a buffer between the
nursery and the~existing or any future residential uses.
Ms. Waite stated that the proposed zoning designation is compatible
'with tile existing uses and zoning designations in the area. This

Mr. McCain asked for clarification regarding the Concurrency
Deferral Affidavit as provided by the applicant.
Ms. waite stated by signing the affidavit, the applicant
acknowledges that this rezoning is a preliminary development order
and that at this time there is not an impact'on water, sewer or the
roadways. Concurrency will be addressed when the applicant applies
-for a building permit, which is a final development order.
Mr. Miller stated that the Deferral Affidavit is a statement of
understanding so the applicant knows there will be no public
facility capacity reserved at this time.
Mr. Paul Jacquin, the petitioner, appeared before the Commission..
He sta~ed that he didn't have much to add to Ms. Waite's comments,
but he would answer any questions the Commissioners might have.

Mr. Settler asked whether or 'not they were going to build a
structure on the subject property.
Mr. Jacquin stated yes, that he was going to construct a home for
his son. He Stated that there are existing barns and two homes
located on the property now.
Mr. Frank Ferrer,. an'adjacent property owner,-appeared before the
Commission. He stated that his property borders 1-95 on the north
side 'Of Graham Road. He stated that he is not objecting to the
petition, but he is concerned about the additional traffic. When
they start clearing the property, there will be large vehicles
entering and leaving, the property. He stated that he is also
concerned about chemicals in t~e ~ater runoff when the trees are
watered. He stated that this nursery will be right in the middle of
a residential area.
Mr. JacqUin addressed Mr. Ferrer's concern over the added-traffic
and the chemicals. He stated that when he starts clearing there
will be heavy equipment in and out of the property. Once the
initial clearing is done, there won't be much traffic, because it
takes about three years for the trees to be sellable and about a
ten year grow-out. He further stated that there is a one acre lake
on. the property, and he will use a Micro-Jet system to irrigate the
trees from the lake in order to save water. He stated that he will
not ]be putting any chemicals in the ground to hurt the water
supply.
Mr.~ McCain asked whether or not the business would market the trees
on a retail basis.
Mr. JaCquin stated that because of the large amount of trees on the
property, this will be a wholesale market.
Hearing no further comment in favor or in opposition to the
petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including staff comments, and the Standards of Review as
set forth in Section 11.06.03, St. Lucie County Land Development
Code, Mr. carman made a motion that the Planning and Zoning
CommisSion recommend that the St. Lucie County Board of County

a change in zoning from RS-2 (Residential, Single-Family - 2 du/ac~
to AG-~ (Agricultural - 1 du/ac). Mr. Skidmore seconded the motion
and upon roll call the Board voted unanimously in favor of the
motion.
Chairman Terpening informed the petitioner that his petition would
be forwarded to the Board of County Commissioners 'with the
recommendation of approval.

PUBLIC HEARING - CHARLES GRUNBAUM (ECKERD DRUGS)
FILE NO. RZ-92-008
Chairman Terpening stated that his firm is professionally involved
with the development of this project and that he would therefore
abstain from voting.
Mr. David Kelly presented staff comments. He stated that this
petition is for a change in Zoning from RS-4 (Residential, Single
Family, 4 du/ac) toPNRD (Planned Non-Residential Development) for
an 8,600 square foot Eckerd Drug Store, located on the Northeast
corner of Prima Vista Boulevard and Floresta Drive. He stated that
there is a site plan for the project which shows an additional
6,900 square feet of retail space. He stated that at this time the
ppll. cant is only requesting preliminary PNRD approval for the
e tire site and.then f~nal approval for only the Eckerds site when
the petition is heard by the Board of cOunty CommisSioners. He
stated that the Development Review Committee has reviewed the
projec~ and determined that it meets all technical requirements,
and that the uses proposed are suitable for this site.
Mr. Kelly stated that he would continue his presentation once the
applicant has been heard by the Board.
Ms. Cynthia Angelos, Attorney and agent for the petitioner appeared
before the Commission. She stated that for Clarification she would
be presenting the Eckerd PNRD only at this hearing. She stated that
it is important to be aware of the status of the law and the
Standards of Review for reviewing projects such as this one. She
stated that in reviewing the letters of concerns from the
surrounding homeowners, there appeared to be an "emotional
involvement" regarding this project. She stated that she felt it
was necessary to go over each Standard of Review which would govern
a decision regarding this project.
Ms. Angelos quoted from sections of the St. Lucie County Land
Development Codes and the St. Lucie County Comprehensive Plan, and
restated the standards of review listed in the staff report'. She
stated that this development is consistent with all the elements of
the Comprehensive Plan and is consistent with the spirit and intent
of the Land Development Code.
Ms. Angelos stated that a traffic impaCt analysis has been
submitted by the developer, and both Prima Vista Boulevard and
Floresta Drive are now operating at Level of Service A. Prima Vista
can accommodate an additional 19,334 trips per day. The traffic
counts as submitted bythe engineer for this particular PNRD would
add 122 trips west and 22 trips east on Prima Vista. Floresta Drive
can accommodate an additional 7,300 trips; 22 trips north and 56
trips south. She stated that a representative of the engineering
fir~. that prepared the statement [.s also available to answer any

Ms. ~mgelos stated.that because of this project's location at the
intersection of Prima Vista and Floresta, and because of the
existingsubdivision. · : . pattern, this property is not ideally suited
for family residences and is more appropriate for the proposed use.
Ms. Calabrese asked whether or~ not any of the neighboring
properties were Zoned commercial.
Ms. ~mgelos stated that to the east towards U.S. Highway 1, there
are. six parcels, that are zoned commercial. At the next major
intersection to the west, the four corners of the intersection at
Primal Vista and Airoso are zoned commercial.
Mr. Kelly ~concluded staff's presentation by stating that staff
recommends that this petition be forWarded to the Board of County
Commissioners with a recommendation of approval, subject to the
following conditions:
With the exception of Fuel and Ice Dealers,
only retail uses which are permitted in
Neighborhood Commercial zoning shall be
allowed in the PNRD; and

That the applicant must provide staff with a
legal description specifying the limits of
Phase I prior to Final PNRD approval.
Mr. Kelly recommended that this Board forward Resolution No. 92-194
to 'the Board of County Commissioners for final approval.
Mr. Klein asked if the condition for fuel and ice dealers will
apply to both Phases I and II.
Mr. Kelly-stated yes, Phase I is the primary concern at this point
and this condition Would also ultimately apply to Phase II.
Mr. Klein stated that his concern was the term "ice dealers," and
whether or not that statement would be limiting the sale of ice.
Mr. Kel.ly stated no.
Mr. Klein asked whether or not these conditions would be acceptable
to the applicant.
Ms. AngelOs stated the conditionsrwould be acceptable.
Mr. Klein asked if staff was satisfied with the traffic analysis
since the report had been supplied by the developer.

'Mr. McCain asked if the traffic study would determine the cost of
impact fees.
Mr, Kelly stated that impact fees are based on square footage by
use, by particular zones in the County., they are paid'whether or
not there is a traffic study. The traffic study indicates whether
or not there will be enough capacity on the roadway.
Mr. McCain stated that it was his understanding that a developer or
owner' could present their own traffic studies, if they disagreed
with the County.
Mr. Kelly stated that a traffic study is done to evaluate the
capacity of the roadway, and that it may be used in some cases to
demonstrate that the proposed use is of a lesser intensity and
should therefore be subject to a different classification of facts.
Ms. Calabrese asked what type of buffering wo~ld be used in Phase
I of the development.
Mr. f[elly stated that the Eckerd's landscape plan will meet the
County,s landscape codes. There will be a tree every 30 feet, and
the existing boat channel on the back of the parcel would serve as
a buffer. ~e stated that there will be considerable excavation on
the back boundary. The site plan does show landscaping in excess of
codes.
Mr. Paul Turczak, a realtor in Port St. Lucie, appeared before the
Commission. He stated that he is in favor of this petition.
Five adjacent property owners appeared before the Commission to

Mr. Charles Grunbaum, the petitioner, appeared before the

omm~ss~on. He stated that he wanted to clarify one point regarding
the intersection of Airoso and Prima Vista. He stated that this
intersection has a CommerCial Office zoning, and to his knowledge
these properties have been forsale without-a potential buyer for
some time.
The President of River Park Homeowners Association appeared before
the Commission. He read from a letter that had been written on
Septe~.mber 1.0, 1992 stating the Association was in opposition to the
petition.
Ms. Jamie .Turner, an interested person, appeared before the
Commission. She asked if the new Eckerds would be open 24 hours a
day or have regular business hours.

Ms. Angelos stated that the hours would be from~9.00 '~ ......... A.M.. to 9.~0~'~
P.M., Monday through Saturday and from 9:00 A.M. to 6:00 P.M. on
Sunday,.
Ms. Turner asked whether or not Eckerds would be able t° change
their hours without having to go befOre the Planning and Zoning
Board or the Board of County Commissioners.
Mr. Kelly stated that he was not aware of a requirement to reappear
before the Commission.
Ms. Turner stated that her main concern was the added traffic, and
as a resident of River Park, and speaking for most of her
neighbors, she is in opposition to the petition.
Ms. Nancy Mehan, an interested person, appeared before the
Commission. She stated that she is opposed to the petition because
the added traffic will cause more accidents at the intersection of
'Prima Vista and Floresta.
Ms. Lois Carter, an adjacent property owner, appeared before the
Commission. She stated that she is opposed to the petition because
the buffer of pine trees along the boat channel may be removed and
the lighting of the Eckerds sign will shine into her pool area
behind her home.
Ms. Angelos stated that the existing buffer of pine trees at the
rear of this site will remain untouched. She Stated that the sign
will be in conformance with the St. Lucie County Code.
Ms. Ca~ter asked whether or not a height and size restriction can
be Placed on the proposed sign because it is next to a residential
area.
Mr. Kelly stated that in cases where Neighborhood Commercial-level
development is allowed on residential land use, there are specific
restrictions on signage.
Mr. Stefan Mathis, a consultant to the petitioner, appeared before
the Commission. He stated that his firm prepared the site plan for
Eckerds and the setback leaves more than sufficient room and that
the majority of the~pine trees will remain as a natural buffer.
There were two adjacent property owners that appeared before the
commission to speak in opposition to the petition.
Hearing no further comment in favor or in opposition to the

After considering the testimony presented during the public
hearing, including staff comments, and the Standards of Review as
set forth in Section 11.06.03, St. Lucie County Land Development
Code, Mr. Skidmore made a motion that the 'Planning and Zoning
Commission recommend that the St. Lucie County B6ard of County
Commissioners approve Resolution #92-194, thereby granting approval
of the petition of Charles Grunbaum (Eckerd Drugs) for a change in
zoning from RS-4 (Residential, Single-Family - 4 du/ac) to PNRD
(Planned Non-Residential Development) subject to the conditions as
noted in staff's recommendation. Mr. Sattler seconded the motion.
Ms. Calabrese asked whether or not Mr.. Skidmore would consider
amending his motion to include limiting Eckerd's hours of
operation.
Mr. Skidmore stated that he would amend his motion to read that the
petitioners hours of operation shall be from 9:00 A.M. to 9:00 P.M.
MOnday ~hrough Saturday and from 9:00 A.M.. to 6:00 P.M. on Sundays.
Mr. Carman stated that there should not be a condition placed on
the hours of operation.
There was a general discussion among the Commissioners regarding
the hours of operation as stated in Mr. Skidmore's motion.
Mr. Sattler stated that he would not second the motion restricting
the hours of operation.
Ms. ~alabrese seconded Mr. Skidmore's motion.

Mr. Skidmore stated that he would amend his motion regarding the

Chairman Terpening informed the agent for the petitioner that his
petition would be forwarded to the Board of County Commissioners
with the recommendation of' approval with the following three
conditions:
With the exception of Fuel and Ice Dealers,
only ~etail uses which are permitted in
NeighborhoOd Commercial zoning shall be
allowed in the PNRD; and
That the applicant must provide staff with a
legal description specifying the limits of
Phase I prior to Final PNRD approval; and
Eckerd's hours of operation shall be from 9:00
A.M. to 9:00 P.M. Monday through SatUrday and
from 9:00 A.M. to 6:00 P.M. on Sundays.
Mr. Klein stated that he would like it noted in the record that he
voted against the motion because of limiting the hours of
ope~atlon. ~e fUrther stated that he is in favor of the change in
zoning as recommended by staff.
Mr. McCain stated that he would concur with Mr. Klein's comment, he
stated that this Board should not get so totally with limiting the
hours 9f operations on the petitions that are heard. There are
extenuatin~ circumstances such as holidays~ hurricanes, etc. ~e
stated that he was in favor of the rezoning, but not the l~mitation
on the hours of business.
Mr. Sattler stated that in all the letters he had read and the
commen~s made by concerned citizens, he felt the major concern was
the added traffic situation and not the hours of operation. He
stated~that he had voted against the motion because of the
limitation on the business hours· He Stated that he was in favor of
the change in Zoning.

Mr. Carman stated that he would abstain from voting on this
petition because he is. a 'member of the Fort Pierce Utilities
Authority Board of'Directors.
Chairman Terpening stated that he would abstain from voting on this
petition because he is professionally involved with the petitioner.
Ms. Diana Waite presented staff comments. She stated that this
petition is for a Change in zoning from IH (Industrial, Heavy) to
U (Utilities) for the purpose of constructing a regional wastewater
treatment plant. The subject parcel is approximately 25 acres
located one mile north of WeSt Midway Road and one-half mile south
of the intersection of Glades Cut-Off and Selvitz Roads.
Ms. Waite stated that if approved, this rezoning would allow Fort
Pierce Utilities Authority (FPUA) to expand operations to provide
central wastewater services to future developments and allow for
the abandonment of existing septic tanks within its service area.
She stated that access to the site would be provided by the
construction of a new public roadway from the site to Selvitz Road
which will be built to County specifications. No access is
anticipated over the railroad tracks to Glades Cut-Off Road.
Ms. waite stated the proposed zoning designation is compatible with
existing uses and zoning in the area. Redesignation of this site to
Utilities is consistent with the spirit and intent of the
ComprehenSive Plan to promote the use of central utility services
within the'~ Designated Urban Service Ar~a. She stated that this
petition meets the standards of review as set forth in Section
11.06.03 of the County Land Development Code and is otherwise
consistent with the goals, objectives and policies of the County
Comprehensive Plan. She further-stated that staff recommends that
this application be forwarded to the Board of County Commissioners
with the recommendation of approval.
Mr. Bud Boudreaux, Director of the Water and Wastewater Systems for
the FPUA, appeared before the Commission. He stated that he would
answer any questions the Board might have regarding this project.
Mr. Skidmore asked whether or not the City of Fort Pierce would be
annexing the properties surrounding the proposed facility.
Mr. Boudreaux stated that the City of Fort Pierce has a policy of
requiring any applicant for water or sewer service from the
utilities authority to sign an annexation agreement.

~. Ski~ore asked whether or not living in the County, near the
FPUA facility who is not an applicant for water or sewer, would be
required to hoOk: up to the utilities system· ~e stated that these
people are living in the County .so they won't have to pay higher'
City taxes.
Mr. Boudreaux stated that it would depend on whether or not it is
a commercial or residential site. State law requires connection to
a central sewer facility for residential development if the sewer
service abuts the property. For a commercial site, the state law
requires connection if it is within 1,000 feet of a sewer facility.
However, that is a state law and not a County ordinance.
Mr. Skidmore asked whether or not the FPUA would be making money
off of the commercial and residential horokups.
Mr. Boudreaux stated yes.
Mr. Skidmore asked whether or not the City would gain tax revenue
when 'those properties are annexed. If so, the County would lose
revenue. He stated that he doesn't have a problem with hooking up
to water and sewer, but he is against mandatory annexation.

Mr. Skidmore stated that for the most part, he agreed.
Mr. Ma~rice Snyder, real estate agent for the Northern Trust Bank
of Florida, appeared before the Co~mission. He stated that they had
acquired title to the property in the early 1950s, prior to z~ning
laws. He stated that they are willing to sell the subject property

OTHER BUSINESS - PROPOSED PRIMA VISTACORRIDOR ~ ~AI~EA S~bY
Mr. Bill Miller, Planning Director stated that this item came up
during a staff discussion of the Eckerd's ~rezoning petition. He
stated thatstaff~is Concerned that similar rezonings for similarly
located property will be filed. He stated that staff wanted to
alert the Planning and Zoning Commission to the potential
comprehensive planning issues in this immediate area and open this
issue up fo~ discussion.
Mr. Kelly stated that the County believes that there will be
additional requests for commercial zoning along Prima Vista. Staff
is recommending that the County undertake a "small area study" for
the Prima Vista corridor. Staff would like this Commission's
comments on the merits of such a study. The study may result in a
series of performance standards by which future development
proposals could be measured. He furthei stated that the study could
result in standards for access,, minimum frontage, and similar
issues. He stated that the study area would be from U.S. Highway 1
to Airoso Boulevard, and extend roughly 500 feet back on either
side of Prima Vista.
Mr. Klein asked how far the County line extends.
Mr. Kelly stated that the County line is Ai~oso Boulevard, and that
would[ be the limit of the study.
Mr. Miller stated that the purpose of the study would be see what
impacts future commercial would have on the adjacent residential
areas.
Mr. ~Cain asked whether or not this study would be done in house
by the County.
Mr. Kelly stated "yes."
There was a general discussion regarding the advantages of
conducting the small area study.
Chairman Terpening stated that it is the consensus of the Board
that staff perform the study and that this Board take a look at the
proposals.
Mr. Miller stated that the Sign Committee should be finished in the
next two weeks with the revisions to the .section of the land
development code dealing with signs.

Development Code does not specifically address bed and breakfast inns, commercial lodging
establishments are permitted as conditional uses in HIRD zoning: Staff does not anticipate
that the proposed use will create significant adverse impacts on the surrounding properties.

submission of the required site plan material that the development of
this project is possible without a reduction in any Levels of Service
below the standards adopted in the Comprehensive Plan of St. Lucie

The proposed amendment is not expected to result in significant
adverse impacts on the natural environment. Portions of the subject
property have been impacted by the invasion of Australian Pine. The
invasion of this non-native species has resulted in erosion of the
primary dune system. The applicant has proposed, as a part of this
project, the restoration of the primary dune on those portions of the
property which, have been heavily impacted by the invasion of
Australian Pines.
The applicant will be required to obtain approval of a St. Lucie County
and State of Florida Sea Turtle Protection Plan prior to receiving Final
Planned Unit Development approval.

COMMENTS
This petition is for preliminary Planned Unit Development approval for a project to
be known as Ocean. The concept for the Ocean project involves the development of 101
residential units on a 34.4 acre parcel located on the east side of S.R. A-1-A directly south
of the Middle Cove Beach Access. The project will be developed in four phases. The
second phase of the project will include the development of a community center together
with s:ix multi-family residential units within a single four-story structure. The remaining 95
units within the development will be three story single-family residences. Approximately 5.7
acres of,the project wi21 be reserved as common open space for recreation.
Portions of this property have been heavily impacted by the invasion of Australian
Pines. The invasion of this non-native species has resulted in the elimination of much of the
site's natural dune vegetation causing over-wash of the primary dune and the encroachment
of sand into the wetland areas on the site.
in accordance with Section 7.09.05 of the St. Lucie County Land Development Code,
the developers of Ocean will ~be required to remove all exotic vegetation from the subject
property. Associated with the removal of'exotic vegetation,.the developers of Ocean have
indicated that they will restore the dune to its natural height and location, and will plant
native vegetation to provide stabilizatibn. These improvements will restore the primary dune
to a more natural state reducing the potential for. further dune over-wash and will create an
environment more suitable for the nesting of sea turtles.

Staff has reviewed the Petition and has determined that it is consistent with all
applic, able portions of the St. Lucie County Comprehensive Plan and Land Development
Code. The application of the PUD designation to the site will permit development of the
property at a density slightly lower than that which would be permitted under the current
zoning and future land use designations, while preserving environmentally sensitive portions
of the property through the clustering of residences and associated improvements on areas
more appropriate for development.
Attached is Draft Resolution #92-238 which, if approved by the Board of County
Commissioners, would grant preliminary PUD approval to this project subject to the
following conditions:
1.)
Prior to receiving Final Planned Unit Development approval, the developer
shall complete the dedication of the northernmost 300 feet of the' subject
property east of S.R. A-1-A to St. Lucie County. Such dedication shall be in
a manner and form acceptable to the County Attorney.
2.)
All residential structures within this development shall be equipped with
automatic sprinkler protection.
3.)
All one-way road sections within the project shall be provided with four feet
of compaction on each side of said roadways. This compaction shall be to
Department of Transportation's specifications.
Staffrecommends that you forward Draft Resolution #92-238 to the Board of County
Commissioners with a recommendation of approval subject to the conditions specified above.

WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following dete~nations:

COMM~ENTS
The purpose of this petition is to allow for the expansion of existing single-family
residences on property which is currently zoned CO (Commercial, Office). The properties
which are included in this petition were rezoned from RM-11 (Residential, Multiple-Fam~y-
11 du/ac) to CO (Commercial, Office) during the comprehensive rezoning reviews of the
County which were completed in April of 1991, The intention of designating these
properties CO (Commercial, Office) during the comprehensive rezoning process was to
provide a transitional zoning district between the CG (Commercial, General) zoning to the
east along SouthU. S. land the existing multi-family and single-family residences to the west.
A result of the change in zoning on these properties to CO (Commercial, Office) was
that the single-family residences existing on these properties became legally non-conforming.
This status allows for the continued maintenance of these residences, but does not permit
them to be, expanded.
.I~ recognition of the potential hardship to property owners in this area due to the
non-conforming 'status of their property, the Board of County Commissioners of St. LUcie
County has petitioned that the zoning on these properties be changed to a designation which

would allow for the expansion of the existing uses and would also preserve their function as
a transitional Zoning district between the CG (Commercial, Ge~teral) zOning to the east
along South U.S. 1 and the parcels to the west of the subject property·
Staff has reviewed the petition and has determined that the amendment is consistent
with the standards of review for amendments to the Official Zoning Atlas, Section 11.06.03
of the l_¢nd Development Code. The pattern of development in the area from Oleander
Avenue to South U.S 1 is a transition in land uses from single-family to multi-family
residences to commercial uses. The proposed RM-11 (Residential, Multiple-Family - 11
du/ac) wffi adequately serve as a transition in land use intensities from commercial- associated
with South U.S. 1 development and multi-multi family and single-family to the west of the
subjec~ property.
Staff recommends that you forward the petition to the Board of County
Commissioners with a recommendation of approval. If you have any questions on this
