WHEREAS, the Board of County Couu,issioners of St. Lucie County,
Florida, has made the following determinations:
On January 24, 1995 this Board granted approval to
Resolution 95-002 authorizing the final planned unit
development approval for the residential project known as
Southern Oak Estates and further authorizing a change in
zoning on certain described property in St. Lucie County.
Paragraph 5 of Resolution 95-002 identified the purpose
of this Planned Unit Development approval to increase the
maximum lot coverage of buildings within the limits of
the property described in Resolution 95-002.
Paragraph 5 failed to specify the maximum lot coverage by
buildings within the approved Planned Unit Development
known as Southern Oak Estates.
NOW, THEREFORE, BE IT RESOLVEDbythe Board of County Commissioners
of St. Lucie County, Florida:

made the following determinations:

Elizabeth J. Walker-Burns presented a petition for a change in zoning from RS-2
(Residential, Single Family 2 du/ac) and AR-1 (Agricultural, Residential - 1 du/ac)
to PUD (Planned Unit Development) for certain property in St. Lucie County,
Florida.
On December 15, 1994, the St. Lucie County Planning and Zoning Commission held
a public hearing, of which due public notice was published in the Port St. Lucie News
and mailed to all prOperty owners within 500 feet at least 15 days prior to the
ihearing, and recommended to this Board that the requested change in zoning from
iRS-2 (Residential, Single-Familv 2 du/ac) and AR-1 (Agricultural, Residential - 1
alu/ac) to PUD (Planned Unit l~evelopment) be granted.
-On January-24, 1995, this. Board held a public hearing on the petition, after
publishing a notice of such hearing in the Port St. Lucie News and on January 3, 1995
and notifying by mail all owners of property within 500 feet of the subject property.
The proposed zoning change is consistent with the St. Lucie County Comprehensive
]?lan and has satisfied the requirements of Section 11.06.03 of the St. Lucie County
12nd Development Code.
SITE PLAN
The petitioner is proposing to change the maximum lot coverage by building within
an existing 33 lot single-family project located at South 25th Street.
The DeVelopment Review Committee has reviewed the site plan for the proposed
project and found it to meet all technical requirements and to be consistent .with the
future land use maps of the St. Lucie County Comprehensive Plan.

and Final Planned Unit Development approval for the project known as Southern
Oak Estates - Planned Unit Development, after publishing a notice of said hearing
in the Port St. Lucie News and notifying by mail all property owners of property

The proposed project is consistent with the general purpose, goals, objectives, and
standards of tl~e St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan, and the Code of Ordinances of St. Lucie County.
The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other
matters affecting the public health, safety and general welfare.
All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping,
and screening.
The proposed project will be served by adequate public facilities and services.
The applicant has demonstrated that water supply, evacuation-facilities, and
emergency access are satisfactory to provide adequate fire protection.

Petition of Elizabeth J. Walker-Burns, for Preliminary and Final Planned
Development (PUD) approval and a Change in Zoning from RS-2
(Residential, Single-Family 2 du/ac) and AR-1 (Agricultural, Residential - 1
du/ac) to PUD (Planned Unit Development)
Attached is a copy of Draft Resolution 95-002 which would grant PUD approval for
a 32.4 acre existing subdivision known as Southern Oak Estates. The property is located
approximately 1/4 mile south of the intersection of South 25th Street and West Midway
Roacl on the east side of South 25th Street. This change in Zoning to PUD is proposed.to
change the maximum lot coverage by buildings. This would allow the property owners within
the subdivision to build homes that are larger than those permitted under the-RS-2 Zoning
District.
Within the past year, several owners of property within this subdivision have
requested permits for homes larger than the 20% maximum lot coverage allowed under the
existing RS-2 Zoning District. To meet the zoning district requirements of RS-2, one
property owner was granted a variance and another bought additional property. This change
in zoning is requested to alleviate the need for future variances within this subdivision. If
approved, the proposed PUD would allow 30% maximum lot coverage rather than the 20%
provided for under the eXisting zoning district. The minimum yard setbacks and the
permitted uses within the proposed PUD and the existing RS-2 Zoning District are identical.
Southern Oak Estates is an existing 33 lot subdivision. The Final Plat of Southern
Oak Estates Subdivision was originally approved on November 26, 1991 and a Replat of the
outhern Oak Estates Subdivision was approved on December 7, 1993. The Plat of
outhern Oak Estates and the Replat of Southern Oak Estates have been recorded and will
not be revised as a result of this action. The existing subdivision has a maximum density of
1.02 dwelling units per acre and includes 12.013 acres of open space, which is well above the
~County Planned Unit Development requirements. The only change to the site plan is the

the proposed increase in the lot coverage by buildings from 20% to 30% maximum lot
coverage by buildings.
On December 15, 1994, the Planning and Zoning ~x~mmission held a public hearing
on this petition. At that time there were no objections to the proposed change in zoning.
At this meeting the Planning and Zoning Commission voted 6-0 to approve this change in
zoning with the condition that any permitted use within the AR-i Zoning District and the
maintenance of horses, stables and other equestrian services continued to be allowed on
Tract A. This condition is included ,within Draft Resolution 95-002 and on the project site
plan.
The original application requested a' change in zoning from RS-2 to RS-3, however,
the Future Land Use Designation applied to this subdivision is RS (Residential Suburban)
which allows a maximum of 2 du/ac. RS-3 is not consistent with this Land Use Designation.
The application was then modified to PUD. ,The only-change between the proposed PUD -
and the existing RS-2 Zoning District is a change in the maximum lot coverage from 20%
to 30%.
Staff has reviewed the application and has determined that it meets the Standards of
Revie~ set forth in Section 11.06.03 of the St. Lucie County Land Development Code. Staff
recommends approval of Draft Resolution 95-002. Attached you wffi find the minutes of tti'e
DecemDer 15th Planning and Zoning Commission' hearing, a copy of the ori~nal staff report,
and ]Draft Resolution 954302, Which. would grant approval to the requested PUD Zoning.

Elizabeth J. Walker-Burns presented a petition for a change in zoning from RS-2
(Residential, Single Family 2 du/ac) and AR-1 (Agricultural, Residential - 1 du/ac)
to PUD (Planned Unit Development) for certain property in St. Lucie County,
Florida.
On December 15, 1994, the St. Lucie County Planning and Zoning Commission held
a public hearing, of which due public notice was published in the Port St. Lucie News
and mailed to all property owners within 500 feet at least 15 days prior to th~
hearing, and recommended to this Board that the requested change in zoning from
RS-2 (Residential, Single-Family 2 alu/ac) and ARq (Agricultural, Residential- 1
du/ac) to PUD (Planned Unit Development) be granted.
On January 24, 1995, this Board held a public hearing on the petition, after
publishing a notice of such hearing in the Port St. Lucie News and on January 3, 1995
~md nOtifying by mail all owners of property within 500 feet of the subject property.
The proposed zoning change is consistent with the St, Lucie County Comprehensive
Plan and has satisfied the requirements of Section 11.06.03 of the St. Lucie County,
Land Development Code.

The Development Review Committee has reviewed the site plan for the proposed
project and found it to meet all technical requirements and to be consistent with the
future land use maps of the St. Lucie County Comprehensive Plan.
On December 15, 1994, the St. Lucie County Planning and Zoning Commission held

in the Port St. Lucie News and notifying by mail all property owners of property

The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan, and the Code of Ordinances of St. Lucie County.
The proposed project will not have an undue adverse effect on adjacent proPerty, the
character of the neighborhood, traffic conditions, parldng, utility facilities, or other
matters affecting the public health, safety and general welfare. --
All reasonable steps have been taken to minimiTe any adverse effect of-the proposed
project on the immediate vicinity through building design, site design, landscaping
and screening.
The proposed project will be served by adequate public facilities and services.
The applicant has demonstrated that water supply, evacuation facilities, and
emergency access are satisfactory to provide adequate fire protection.

Mr., Gibbins stated that due to the fact that he has a conflict, he would abstain from voting.
Ms. Diana Waite presented staff comments. She stated that initially the applicant was
requesting a RS-3 zoning designatign, but found it to be i~' conflict with the future land use
designation on the parcel, therefore, Staff recommended that the petitioner apply for PUD,
which they have.
Ms: Waite stated that the existing subdivision provides for a max/mum density of 1.02
dwelling units per acre and includes 12.13 acres of open space which exceeds that required
under a Planned Unit Development. She stated that over the past year, there' have been
several property owners within the subdivision that have requested building permits fOr
homes larger than the 20% maximum building area that is allowed under the RS-2 zoning
district.
Ms. Waite stated that staff recommends that this petition be forwarded to the Board of
County Commissioners with a recommendation of approval with the following condition:
· Tract "A" may be utilized with any uses permitted in the AR-1 zoning districts
and the maintenance of horses, stables, and other services will be permitted
on the property.
Mr. Kelly stated that the intent is to maintain the 33 lots exactly as they are today, increase
the lot coverage on the lots from 20% to 30%, to use.the remaining land for the open space
recreational requirements of the PUD, and to further specify that the property is used for
exactly what it is used for 'today.
Mr. Bruce Albernethy, attorney representing the petitioner, appeared before the
Coramission. He stated 'that MS. Burns owns most of the lots within the Southern Oaks'
subdivision, however, there are approximately 10 other lot owners, all of whom have joined
in ttxis petition. He stated that this request was generated by coupl6 of the lot owners who
went to pull building permits and found out that their plans for a single one story home
would not fit on the lot with the 20% maximum building requirement.'
Hearing no further comments in favor or in opposition to the petition, Chairman Klein
closed the public portion of the hearing.
After considering, the testimony presented during the Public Hearing, including staff
comments, and the Standards of Review as set forth in Section 11.06:03, St. Lucie County
Land Development Code, Mr. Skidmore moved that the Planning and Zoning Commission
recommend that the St. Lucie County Board of County Commissioners grant approval to the

property owner sought and was granted a variance and another bought
additional property. This change in zoning/s requested to alleviate the need
for future variances within this subdivision. If approved, this request will allow
an additional 10% lot coverage by buildings~ The smallest lot in the
subdivision, which is 15,000 square feet would then be able to accommodate
a 4,500 square foot single story home.
Whether and the extent to which the proposed amendment would result in
demands on public facilities, and whether or to the extent to which the
proposed amendment would exceed the capacity of such public facilities,
including but not limited to transportation facilities, sewagefaeilities, water
supply, parks, drainage, schools, solid waste, mass transit, and emergency

This rezoning would not create additional demands on any public facilities in
this area~ The County Engineering division has indicated that the stormwater
management system was' designed to accommodate up to 70% impervious
surface within the subdivision. The proposed PUD states that the maximum
impervious surface coverage on any lot shall not exceed 70%. No additional
roadway impacts are expected.

COMMENTS
The purpose of this petition is to allow for the construction of larger homes on the
established parcels within the Southern Oaks Subdivision. Property owners within the
subdivision have found the existing maximum lot coverage by building within the RS-2
Zoning District to prolu'bit the construction of the homes desireck
~[lae application for this change in ZOning originally requested a change to RS-3
Zoning;, however, the Future Land Use Designation of tiffs property is RS (Residential,
Suburban) which allows a maximum of 2 dwelling units per acre which was in conflict with
the requested Zoning District. Staff has recommended and the applicant has agreed to
modify the request to PUD (Planned Unit Development). The existing subdivision provides
for a max/mum density of 1.02 dwelling units per acre and includes 12.13 acres of open
space, which is well above the requirements of the County Planned Unit Development
requirements.

The proposed PUD Zoning would allow a maximum lot coverage of 30% rather than
the 20% allowed under the existing RS-2 Zoning District. The minimum yard setbacks and

of the St. Lucie County Land Development Code;
The proposed amendment is not in conflict with any applicable portions of the
St. Lucie County Land Development Code. PUD Zoning complies with the
Land Use Category/Zoning Consistency Matrix found in Section 11.09.02 and
meets the PUD design standards of Section 7.01.03 of the County Land
Development Code.

In the past year, several owners of property within this subdivision have
requested building permits for homes larger than the maximum building area
of the RS-2 Zoning District. To meet the zoning district requirements, one
property owner sought and was granted a variance and another bought
additional property. This change in zoning is requested to alleviate the need
for future variances within this subdivision. If approved, this request will allow
an additional 10% lot coverage by buildings. The smallest lot in the
subdivision, which is 15,000 square feet would then be able to accommodate
a 4,500 square foot single story home.
Whether and the extent, to which the proposed amendment would result in
demands on public facilities, and whether or to the extent to which the
proposed amendment would exceed the capacity of such public facilities,
including but not limited to transportation facilities, sewage facilities, water
supply, parks, drainage, schools, solid waste, mass transit, and emergency
medical facilities;
This rezoning would not create additional demands on any public facilities in
this area. The County Engineering division has indicated that the stormwater
management system was designed to accommodate up to 70% impervious
surface within the subdivision. The proposed PUD states that the maximum
impervious surface coverage on any lot shall not exceed 70%. No additional
roadway impacts are expected.

The proposed PUD Zoning would allow a maximum lot coverage of 30% rather than
the 20% allowed under the existing RS-2 Zoning District. The minimum yard setbacks and
the permitted uses within the proposed PUD and the RS-2 Zoning District are identical.
County staff has determined that the PUD Zoning District is compatible with the
existing character of the area and finds that this petition meets the standards of review as
set forth in Section 11.06.03 of the County Land Development Code. Staff also finds the
proposed rezoning not to be in conflict with the goals, objectives and policies of the County
Comprehensive Plan.
Staff recommends that you forward this petition to the Board of County
Commissioners with a recommendation of approval. If you have any questions on this
