At the meeting of June 27th this petition was tabled until today at the request of the petitioner. Moved to-put the petition back on the floor, was second by Com. Green, and upon roll call, unanimously carried. The Planning & Zoning Commission had recommended approval of the petition. to R-1 'C Atty. Buck Bryan was present representing petitioner and explained the Mr. Bill Ryan, also present, was to be the purchaser of 240 acres located 3½ miles west of the Turnpike to be developed for 435 single family dwellings a~ 100 town house condominiums, equestrial trails etc. Jerry James advised that his house sits on 5 acres in the middle of th~ proposed development and although he-is not objecting to the rezoning feels he should be protected from it by a buffer of 140' left in A-1 around his property on three sides. He said that although he realized that Mr. Ryan wot beleft needing he wouldn't additional be withinreZ°ningSthe 300' to ~mplete the project, unless this area was zonings, necessary to be informed of future re- Mr. Bryan pointed out that had Mr. James wanted additional property around his home, he could have bought it a . had intensions ~7~ ..... nd that at one time he and others of d ..... Green suggested leaving this 140' in A-i, making it a road which Would still permit construction of homes but Mr. Bryan pointed out that it would not be satisfactory and might lock in other homes. Com. Enns felt the sale might be held up if the 140' had to remain in A-1 and thought there would be other safeguards for Mr. James, bu~ Mr. James claimed if the zoning is granted the land could be resold and he might be facing a sewage treatment plant, but Mr. Enns pointed out that the Coats' hon is also in the middle and that no commercial zoning was being requested toda~ Com. Park brought up the question of the James' house being in an Agriculture category and how it would be affected by being adjacent to R-lC a Mr. Thomas stated that nothing as presently situated would be changed but %? set backs Could hamper future construction of something like a horse stable, although this could be handled by a variance from the Board of Adjustment. However, Com. Park said he felt there could be some problems because of A-1 adjoining R-lC and felt the developer could consider the buffer area as a concession. Moved by Com. COMMENTS The proposed rezoning contains approximately 240.0 acres and is located about 3-1/2 miles west of the Sunshine State Park- way. The proposed rezoning has limited frontage on Okeechobee Road with primary access being to unpaved Brocksmith Road. The proposed rezoning to R-lC would permit up to four (4) dwelling units per acre and, if granted, would result in the first large scale introduction of urban densities west of the Turnpike. If developed at more than three (3) dwelling unit per acre the project would be a Development of Regional Impact (DRI). The proposed rezoning is inconsistent with existing land uses in the area and future land use plans for the area. It is precisely for these reasons and the difficulty in determining impacts of such a large scale development, that rezoning to Planned Development Project (PDP) was recommended several months ago to the prospective buyer of this property. Unfortunately, it sent owners of the property did not want for PDP and therefore have requested R-lC. PDP : ~ means whereby the county can analyze potential impact of a proposed residential project prior to granting "development approval" in the form of zoning. First, the Coats family are good friends and good neigh- bors and I would like to accomodate them in their sale. Neverthe- less, I have requested~ of buyer's attorney, the existence of a conceptional plan of development. Apparently, it does not exist and I cannot make an intelligent evaluation. 1 have discussed with Gary Ament his views and I concur with his findings that R-i~C, permitting four (4) units per acre, is far in excess and totally incompatible with land planning for this major sized tract at the present time. A PDP is the only realistic approach to a residential de- velopment of this magnitude, and 1 strongly urge the Board to re- quire this approach and not permit over-zoning totally incompatible for the surrounding land use. In summary, I adopt Mr. Ament's report and conclusions as my position to the rezonging request. Thank you.
