The Planning and Zoning'Commission, after a public .hearing held ~
Jan. 27, '1977, recommended approval of the petition because it is consistant
with existing and future land use plans for the area and because it would
create a hardship if %he owner could not construct a home on his property.
The petition was not opposed.
Moved by Com. McCain to approve Mr. Clausen's petition, was seconded
by Com. Green and, upon roll call, unanimously carried.

Existing Land Use: Single family low density residential and
citrus across Orange Avenue to the north.
Future Land Use: Low/medium density residential.
COMMENTS:
The proposed rezoning is currently vacant. In fact,
the whole area that is currently zoned B-3 is vacant.
The proposed rezoning is consistent with existing
land use and future land use plans for the area.
However, it should be noted that, if this rezoning
petition is granted, an almost unusable piece of
B-3 zoning will be left adjacent to Orange Avenue
because the depth will only be one hundred twenty
feet (120'). Consideration should be given to rezon-
lng the remaining B-3 to a residential zoning class-
ification compatible with other zoning in the area.

The-P~ianning & Zoning Commission held a public hea~ing 1/27/77.
Mr. Clausen was present and stated he was asking for the rezoning
on a portion of ~wo lots. He stated he lived on one and gave the
other one to his daughter~ and when she applied for a building permit
was told two-thirds of our lots were zoned B-3 and she couldn't build
on tha~ portion because residences were not permitted in B-3. She
was told she would have to go before the Planning & Zoning Commission
to change the classification to R-lC.
Mr. Thomas Gilbert stated he owned property adjacent to the
property under petition and favored the change in zoning classifica-
tion. Mr. Jules Gagne stated he was also in favor the the rezoning.
There were no objections to this petition.
The Planning & Zoning Board then voted unanimously to recommend
approval of this petition to the Board of County Commissioners, be-
cause it is consistent with existing and future land use plans for
the area~ and because it would create a hla~dship on the owner if not
permitted to construct a home on his property.
Prior to this public hearing, notice of the same was sent by first
class mail to all adjacent property owners as listed on the attached
sheet below.

questing that portion of both lots zoned B-3 be changed to R-lC.

Moved by H. B. Moore, Jr., seconded by Jack Scott to recommend approval
