On July 27,1993 you wig be asked to review the petition of Mere'beck, Inc., for a change in zoning from ARq (Agricultural, Residential - 1 alu/ac)to AG-2.5 (Agricultural - 1 du/2.Sac) to allow for the expansion of an existing agricultural caretaking business on a 9.51 acre parcel. The property is located approximately 1.5 miles west of the Florida Turnpike at 'the southwest comer of West Coker Road and Orange Avenue Extension. The applicants immediate inten~ is to construct a building to be used as a repair shop for agricultural equipment used in the agricultural caretaking business. Under the AR-1 zoning district the existing agricultural caretaking business, which is a non-conforming use, can not be expanded. If approved, the proposed change in zoning would eliminate the non- conforming status of the' existing business and would allow equipment repair services as an accessory use to the agricultmal caretaking business. The Plam~ng and Zoning Commission held a public heating on this petition on June 22, 1993. At this meeting the applicant was the only individual to appeared before the commission regarding this application. The Commi~ion recommended approval of this petition by a unanimous vote. Attached you ~ find the unofficial minutes of the June 24, 1993 hearing, a copy of original staff report, and Draft Resolution No. 93-122, which would grant approval of the request. County stiff has reviewed the application and determined this petition to meet the Standards of Review set forth in Section 11.06.03 of the County Land Development Code. RZ-93-015 Ms, Diana Waite presented staff comments, She stated that the petitioner is requesting that a9.5 acre parcel be re~oned from AR- 1 (Agricultural, 1 du/ac) to AG-2.5 (Agricultural - 1 du/2,5 ac). She stated that the applicant is proposing this change as the first step in the process to-construct a building to b~ used in the repair of agricultural equipment. She stated that the intendeduse . would be accessory to an agriculture caretakingbusiness., which is currently a non-conforming use of the property, which cannot be expanded.' This rezoning is being requested to el{m{nate the non- conforming status of the. business and to allow for the expansion of the. present-agricultural operations. .Ms. Waite stated that the subject.property is located approximately 1.5 miles weSt of the Florida Turnpike atthe southwest corner of. Coker Road and Orange Avenue in a Residential Estate (RE)-_future land use district. She stated, that theRE district is intended to provide a transitional areabetween agriculture and-more intense- residential areastothe east by'providing an area that consists of large-lot singl~ family dwelling units. Three of the six zoning districts compatible with the ~E future land use classification permit agricultural uses. Ms. Waite referred to.a general location map showing the:land uses and zonings surrounding the subject property from the Florida Turnpike to Canal No. 54. Ms..Waite-stated that the dominant historical and existing land use in the general area of. this petition is agricultural. In the immediate area of the. subject property, however, there' are-several- -residences which have AR-1 zo.ning designations. She stated that agricultural uses are not permitted as p~{m~ry uses within-the AR-1 district, but are permissible only as accessory 'uses. -Agric.ultural uses are permitted and exist immediately east and west of these properties. There is no indication that the demand for agriculture-related uses and support_ services will decrease in the general area of this petition. Ms. .W. aite stated that if approved, this..chan~e in zonina would permit, among other agriculture-related activities, the use of the subject parcel for agricultural support services, including crop services, veterinary services, farm labor and management services and landscaping and horticultural services~ She stated that the maintenance and repair of the establishment's own-equipment would be .accessory to the agricultural services use. This change in zoning would not permit the establishment to engage in repair services for the general public. Ms. Waite stated that any final development order would require that all site and building requirements be met.~ The County Comprehensive Plan provides for the protection of single family. neighborhoods from the 'encroachment of comm_ercial or other inappropriate landuses through Section 7.09.04 of the County Land Develop~ent Code which requires a landscaped barrier, at lea~t six feet in forms a continuous screen between residential and uses. She stated that construction on this · parcel would also require that--one tree per thirty linear feet be provided between the non-residential and residential uses and along Orange Avenue. She stated that additional standards may be required if any future construction on ~his parcel requires site. .plan review ~and approval. Ms. Waite stated_thatstaff has determined that-theproposed zoning- designation can compatible with the'surrounding area if design and spatial are met. Chairman Klein asked whether or not the proposed buffer.would be consistent with the County Code requirements, or a separate requirement by staff. Mr. Jim Beckl.y, President of MerriBeck, Inc.,-appeared before the Commission. He stated that he had oWned the subject property since' 1986, and when he tried to obtain a permit-to bUild, a.barn, had just recently found out that he is not in compliance with the zoning which was changed in 1990. He stated that'he bought the property because of the frontage on Orange Avenue and he does ~te~nd ~o .bu~i~d his house in the hemmock-and to have a 20 foot to . -moot bummer around his property. He stated that he is requesting the rez0ning-to bring his Property into compliance so that he c~n have an office on site. After considering the testimony presented during the public hearing, including staff comments, and the Standards of Review as - set forth in Section 11.06.03, St. Lucie County Land Development Code, 'Mr. Walker made a motion that the Planning and Zoning Commission recommend that the St. Lucie County Board of County Commissioners grant approval to the application of MerriBeck, Inc. for a change in zoning from AR-1 (Agricultural, Residential - 1 du/&c) to AG-2.5 (Agricultural t du/2.5 ac). Mr. Skidmore seconded the motion and upon roll the Commission voted unanimously in favor of the motion. This property is located approximately 1.5 miles west of the Florida Turnpike at the southwest comer of Coker Road and Orange Avenue in a Residential Estate (RE) future land use district. Although agricultural uses are not primary permitted uses within the AR-1 district, agricultural uses are permitted and exist immediately east and west of these properties. 'There is no indication that the demand for agriculture-related .uses mad support services will-decrease in :the general area of this petition. If approved, this change in zoning would permit, among other agriculture-related activities, the use 9~..the subject parcel for agricultural support services, including crop services, veterinary services, farm labor and management services and landscaping and horticultural services. The maintenance and repair of the establishment's own equipment would be accessory to agricultural services use. This change in zoning would not permit the establishment to engage in repair services for the general public. The applicant has stated that most of their work is performed in the surrounding agricultural area, and a conveniently located repair facility will minimize the transportation of equipment on roadways. Any final development order w6uld require that all site and building requirements be met. The County Comprehensive Plan provides for the protection of single family neighborhoods from the encroachment of commercial and/or other inappropriate land uses through the County Land Development Code. In accordance with Section 7.09.04 of the . Code, any non-residential construction on this-parcel will be required to Provide a buffer between the non-residential _and residential use. This. would include a landscaped barrier at least six feet in height that forms a continuous screen between the uses. Construction on this parcel would also require that one tree per thirty linear feet be provided between the non-residential and residential uses and along Orange Avenue. Additional standards may be required if any furore constru~on on this parcel requires-site plan review and approval. In reviewing this petition, County staff has determined that the proposed zoning designation can be compatSble with the surrounding area if design and spatial standards are met. The petition is not inconsistent with goalS, objectives and policies of the County Comprehensive Plan and meets the requirements of the COunty Land Development Code.
