Walker 9628 SE Turtle Creek Drive Tequesta, FL 33458 Dear Mr. and Mrs. Walker: When the County legal department was preparing the resolution for your rezoning petition granted by the Board of CounTy Commissioners on April 17, 1979, it was discovered that the newspaper had made an error in the legal advertisement for this hearing date. Where you had requested eliminating the North 300 ft. of the par- cel, the newspaper misread and printed, "less the North 800 ft." Hence, the resolution could be written presently as less the North 800 ft.,'but if you wish to use the legal description as presented, it wil.1 be necessary for us to re-advertise for another hearing before the Board of County Commissioners. We will proceed with this new advertising and will request a hearing date for June 26, 1979. We will con- firm this date to you in writing. PLANNING AND ZONING MEETING MARCH 22, 1979 PUBLIC HEARING: Petition of John C. and Catherine Ann Walker for a change in zoning classification from A-1 (agriculture) to R-4D (multiple dwellings) for property located 900 ft. We~ of Coolidge Road on Orange Avenue Extension. Mr. Hank Riegler spoke for the petitioners, stating they had purchased the property mn !972. It is bounded on the West by Florida Gas Transmission Co., on the East by a real estate office and an airstrip and on the North by the Orange Avenue Feed Store. The South adjacent land is vacant. The location is too close to 1-95 for single-family residences, not ideal for industrial use, there is no demand for offices or commercial businesses in the area. St. Lucie County is lacking in rental houses, and for this reason the petitioners state that R-4D would be the highest and best use of this land. Russell Perdue spoke in support of the rezoning. He owns a business across the street and believes that this will help deve!ope the area. Mr. Tom Walls of T & J Hitching Post across the street, opposed the rezoning, stating he wishes to keep the area as is. Mr. Scott read Mr. Ament's comments into the public record. Mr. Martinelti, adjacent property owner, stated he bought his property for retirement and opposed the petition. Mr. Adams, County Attorney, asked Mr. Riegler why the north 300~_ft-. of the property was not included in the rezoning request, to which Mr. Rieg!er replied that at the time the petition was filed, the Walkers thought that it was zoned for commercial use. ~r. Moore asked if the petitioners would consider a lesser density on the multiple dwellings, to which Mr. Riegler replied that they were planning on the !0 to 11 units pen acre, what with the water and sewer requirements they were looking at about 1~ years before the first permit. Jim Peeler stated'that he, too, was opposed to the rezoning request. Mr. Ebner stated that he felt St. Lucie County had sufficient property zoned for multiple dwellings. Moved by Mr. Tiernan to deny the petition, seconded by Mr. Ebner. The Board was polled and the following votes were cast: Ayes: Mr. Tiernan and Mr. Ebner, Nays: Mr. Moore, Mr. Skeffington, Mrs. King and Mr. Scott. The motion was defeated by a 4 to 2 vote. A motion to approve the petition was then made by Mrs. King and seconded by Mr. Skeffington. The Board was polled and the following votes were cast: Ayes: Mr. Moore, Mr. Skeffington, Mrs. King and Mr. Scott; Nays: Mr. Tiernan and Mr. Ebner. The Planning and Zoning Commission will recommend to the Board of County Commissioners approval of this petition. To the east is an airstrip and to the west is pasture and a limited installation of the Florida Gas Transmission Company. Semi -Urban.
