Comm were read; the petition was recommended~ for approval. · Mr. Tilton was present and stated that his plans for the property have not changed. He added that his architect is in the process of developing pla s for the project, and he would appreciate the Board upholding their previous approval. Mr. John Brooks was present representing the Trust for Public Lands as ~ell as the Savannas Wilderness Trust. Mr. Brooks cited opposition to the rezoni _ because the NE corner of the property is in the Savannas which has been designi~ nated an area which should not be developed. He feels the Board will be set- ting a potentially dangerous precedent if the rezoning is granted in that it would be very difficult to deny similar requests of which there could be several] in this area in the next year or so. He added that now is the time for the Board to decide whether the Savannas will be residential or recreational. And, he noted that there is an alternative market for the land as the state would purchase it for the Savanna project. Another concern is that the property slopes to the east and south~ and with development, urban run-off will go directly into the Savannas. He sugges- ted consideration be given to an equal division of the property whereby the west 15 acres would be rezoned as requested, the east 15 acres would remain as ' is, and hopefully the state and Mr. Tilton could work something out for the !east portion. ~ Corn. Park questioned Mr. Brooks, statement relative to the Board being agency to decide about the future use of land close to the Savannas since property is privately owned. Mr. Brooks admitted that the state would o buy the property for recreational purposes since it has no condemnatio in this~ .·respect~ and this would require a willing seller.~ He believes state has offered to buy Mr. Tiiton's land. He added that a Board dec~sion deny the rezoning could make the state's owner, purchase offer more interesting to Com. Park then~ referred to Mr. Ament's written comments which~indicated ]at any development on this property would be closely examined wi{h regard to lvironmental impact as well :as traffic generation impact on Walton Rd. Mr. %ent explained tha~ the Board of Co. Commrs. and state agencies would be the [thorities to make this examination. Discussion then turned to the surrounding properties. Mr. Ament stated at all 4 sides, with the exception of one piece immediately to the west, are thin the city limits of PSL. The city zoning in the area is R-2, which Mr. ent believes is a singl~ family residential classification; however, the area mediately south of Walton Road has recently been changed to a multi-family to accommodate the Midport project. Mr. Tilton then stated that 35 years ago he fished and swam in the Saran- ; later he was the only realtor whO purchased property for the Savannas on elf of the state without commission. No one was present representing the petition, and it was moved to the end of the agenda. Tilton: Mr. Thomas gave background information on this petition. The Planning and Zoning Commission had recommended approval of the petition to the Board of County Commissioners. At the County Commission hearing, Mr. John Brooks of the Property Appraiser's office, had commented that a particular property owner had not been notified of the rezoning. Upon offer of sending a letter after the fact, and that not'being satisfactory to Mr. Brooks, the Board of County Commissioners had directed County Staff to re-hear the entire petition from the beginning, with all property owners notified correctly. The property owner that Was. omitted was Trust for Public Lands, 82 Second St., San Francisco, CA. State of Florida, TIIF, had been listed also, and it was erroneously assumed that thes~ two listings were the same. Motion by Mr. Tiernan and second by Mr. Davis to approve the rezoning. Tilton - Walton Road area - from A-1 (agriculture) to R-4B (multiple dwellings)- Public Hearing held on June 12, 1979 Your question was substantially "Did the fact that the property owners to the immediate north were not notified of the public hearing have any effect on the validity of the proceedings when it was through clerical ~'ror that they were not notified?" A review of the case law on the subject in both Florida and elsewhere indicates that the rezoning was in fact invalid. This failure to give proper notice constitutes a jurisdictional defect (see Yokely Zoning Law, page 46) and therefore the Board of County Commissioners is withoUt authority to rezone the property. In addition, it would appear that were the County to allow the defective proceedings to continue uncorreCted that the County might well subject itself to financial penalty under the theory of the City of Co~al Gables vs Deschamps, 242 So 2d 210. Future Land Use: Inasmuch as this is an outparcel of unincorporated land completely surrounded by the City of Port St. Lucie, no future land use plans have been drawn up for this area. COMMENTS: The proposed rezoning abuts the Midport Development of Regional Impact (DRI) by General Dev61opment Corporation on the west and north. According to GDC's Director of Engineering and the Master Development Plan for Midport, GDC plans approximately twenty-six (26) acres of Medium Density Residential development immediately to the west of the proposed rezoning. Consequently, the proposed rezoning is consistent with development plans of GDC. Because of its proximity to The Savannas, subsequent development, if the property is rezoned, will be closely examined with regard to its environmental impact, and also its traffic generation impact on Walton Road.
