There was SOme discussion as to who should pay the OS%s of readvertising inasmuch as it was the petitioner,s request that the Publ~ c hearing be c6ntin~d. Zoning Director Thomas advised that it cost about ~200 to Send out ~Otices and type letters in preparation for a zoning hea ~ing and suggested that perhaps the BOard should request the petitioner to ~ay at least half of that cost., Com. Park moved to grant permission to advertise this rezoning with the petitioner payin~ half the costs ($100.) which was seconded by Com. Enns and upon roll call, unanimously carried. ZONING - PUBLIC HEARING - CONTINUED BOARD OF COUNTY COMMISSIONERS NOVEMBER 6j 1979 Petition of Bernie Thames for a change in zoning f]~om A-1 (agriculture) to R-lA (resi~e~ti~--l) for property located on the north approximately 2 miles west of the Turnpike interchange. Petition was first heard on July 10th and tabled u~ to determine R/W needs of the DOT along SR 70 Inasmuct present on Oct. ' 9th, the hearing was continued until Oct petitioner was not present, it was continued until toda~ Mr. Thames was present and apologized for missing the two previous meet- ings. He stated that he is unsure about the necessity for rezoning right now as he understands the Growth Management Plan will provide residential zoning for this area. Also, ~eiative to R/W needs on SR 70, D~ has not yet contac- ted him, but he doubts any property will be taken on the north side of the road . ' - Mr. Ament stated that the Plan. & Zoning Com. wilI ecommend property in this area east of Brocksmith Rd. be designated for 2 units to the acre. Com. Green commented that the Brd. of Co. Commrs. is the final authority on the GMP; therefore, the%recommendation may not be approved. Admn. Lewis presented a map of the area which indicated that DOT will re- quire some property on the north side of Okeechobee Rd. widening of the road. in connection with side of Okeechobee Rd. til Oct. 9th in order as petitioner was not · 16th, but because Com. Enns questioned Mr. Thames' proposed use for the land if it is re- zoned. Mr. Thames replied that he will eventually subdivide it, but given the current economic situation, he intends to wait until the surrounding area has developed more. Com. Enns commented that if the property is rezoned now, the Property Appraiser will take this into consideration. Mr. Thames stated that usually the tax appraisal is based on the use of the land not the zoning ever, Atty. Adams stated that of the 7 factors used in the Property Appraisers I . How- assessment, zoning is one of them. After some further discussion~ Mr. Thames requested ~is petition be post- poned until the GMP is adopted and the SR 70 R0/W situation resolved. Atty. Adams advised that the Board must take action to continUe the public hearing to a specific time to eliminate the need for readvertising. Moved by Com. Hr. Ament ~eplied that if the A-1 zoning was used: then eaoh home would need 150 foot fr ~ntage~ and would cut down on the number of homes tha~ could be constructed. He also mentioned that wi%h the tranmission lines on the property, he would not be able to get more than one unit per acre. Mr. Thomas stated that probably he would end up with long narrow lots of approximately eight or nine total/homes. ~ Motion to deny the petition by Mr. McIver and seconded by Mr. Ebner~ with the statement that on the pending Growth Management Policy Land Use Plan this area has been designated as agriculture.
