On Tuesday, October 23, 1990, ~ou will be asked to review
the petition of Seventeenth Street Church of God, by Agent
Reverend Samuel Brown, Jr. for a Change in Zoning from RS-4
(Residential, Single-Family, 4 du/ac) to RF (Religious Facility)
on the west side of North 43rd Street between San Diego and
Sout~ Canal Avenue.
The rezoning would allow construction of a church on four
lots near the present dead end of North 43rd Street, which is
unpaved and very narrow south of San Diego. North 43rd Street
currently does not go through to the South Canal Street
right-of-way.
The Planning and Zoning Commission held a public hearing
on this petition on September 27, 1990. One neighboring
household spoke in opposition to the application. The
Commission voted unanimously to recommend your approval of this
application.

Mr. Carman said that he was confused about the statement in staff
comments about the limited size and depth of the proposed lot
reducing the likelihood that this facility COuld operate without
interfering with surrounding residences and limit oportunities
for future growth on this site He asked if there were four lots
altogether -
Mr. Serna said yes.
Mr. Carman asked if it was 77 hundredths of an acre.
Mr. Serna said that was correct.
Mr. Carman asked if the frontage was 30 feet or 40 feet.
Mr. Serna replied that it was a 60 foot frontage.
Mr. Carman asked what size the church was going to be.
Mr.footageSernaof the replied church, that he did not know the proposed square
Reverend Brown, pastor of Seventeenth Street Church Of God,
appeared before the Commission. He stated the reason for moving
was that his church did not have any area to expand and he was
concerned about having enough room to conduct services.
Mr. Carman asked if he had
properties, any plans to purchase the two corner
Reverend Brown said that in the future he WOuld be interested in
purchasing the two corner lots.
Mr. Flowers asked if North 43rd Street was a dead end street.
Reverend Brown said yes.
Mr. Skidmore asked how
be. many square feet the church was going to
Reverend Brown replied that the plans had not been drawn up at
this time.
Mr. Skidmore asked how big their current church was.
Reverend Brown stated it was approximately 30 x 60 feet.
Mr. Emin Gakin, 4301 San Diego Avenue and 43rd Street, appeared
before the Commission. He stated that he had been living on San
Diego since 1956 because he wanted to stay away from city living.
If the religious facility site is granted, the only way to get to
the facility is 43rd Street, which passes in front of his home.
He stated that he was against the petition because of the noise
and activity it WOuld bring to the neighborhood.
Mrs. Grace Gakin appeared before the Commission and stated that
her husband was a handicap and needed a quiet place to walk
without interference. She asked if the petitioners Could find
another place to build their church.
Chairman Terpening stated that one letter had been received in
favor of the petition.
Reverend Brown said that he had spoken to Mr. Gakin several weeks
Prior to this hearing and he WOuld build a fence adjacent to his
property. He said that adults attend Thursday night assemblies
and Sunday draws their largest crowds. He said he did not
understand why the proposed church WOuld interfere with any
current residents because the SOund inside the building stays
inside the building.
Mrs. Gakin stated that the music was going to be loud and it was
going to wake them up on Sunday morning.
Reverend Brown said he wanted the church very much, but he WOuld
not fight anyone for the use of this property.
Mr. Carman said that staff requires 5 feet on the east side
because of the narrowness of the road and to maintain properly
landscaping and screening as required by code.
Reverend Brown said that he understood the County's requests.
Mr. Skidmore asked how late
weekday, the services lasted during the
Reverend Brown stated
approximately 9:00 P.M. and a revival WOuld
last until approximately 10:00 P.M. He stated that it was hard
to pinpoint an exact time.
Mr. Skidmore asked how many present members were in the church.
Reverend Brown said 42 members at this time.
There being no further comments in favor of or in opposition to
the Petition, Chairman Terpening closed the public portion of .the
hearing.
After considering the testimony presented during the public
hearing, including staff comments, and the Standards of review as
set in section 11.01.03, St. Lucie County Land Development Code,
Mro Carman move that the Planning and Zoning Commission recommend
that the St. Lucie County Board of County Commissioners grant
approval to the petition of the l?th Street Church of God for a
change in zoning from RS-4 (Residential, Single - Family 4 du/ac)
to RF (Religious Facilities). Mr. McCain seconded the mOtion and
upon roll Call, Mr. Carman, Mr. Flowers, Mrs. Enck, Mrs. King,
Mr. McCain and Mr. TerPening voted in favor of the mOtion and Mr.
Skidmore voted against the motion.
Chairman Terpening informed the petitioners that the petition
WOuld be forwarded to the Board of County Commissioners with a
recommendation of approval.

C0MMENTS
The petitioners are requesting a change in zoning from
RS-.4 (Residential, Single-Family - 4 du/ac) to I (Institutional)
in order to build a church.
The site of this proposed facility is located in a
residential area an~. is currently undeveloped and surrounded by
mostly vacant property. Although this property meets the minimum
lot size requirements for the requested zoning, the limited size
and depth of this lot reduce the likelihood that this facility
can operate without interfering with surrounding residences and
limit opportunities for future growth on this site. More
appropriate for this use would be a larger and/or a corner lot
which would allow for future growth and maintain greater
separation from neighboring residential properties.
Religious facilities are generally considered compatible
with residential land uses, and it is possible for the
petitioners to operate in a manner that will benefit the
neighborhood without negatively affecting nearby.residences.
Staff, therefore, recommends that this petition be forwarded to
the Board of County Commissioners with a recommendation of
approval. The petitioners are, however, urged to create and
maintain proper landscaping and screening as required in the Code
and, in the near future, consider purchasing and rezoning
adjacent properties to the south before these parcels are
developed as single-family residences.

your transaction, please remit to our office a copy of the executed
Warranty Deed, Commitment for Title Insurance and Contract for our
records.
Upon receipt of the above mentioned copies, our office will take the
liberty to prepare a Warranty Deed for your review and execution.
As a result of this donation, upon improvement of' this property, you
will receive an impact fee credit through Planning and Zoning. You

change for rSght-of-way needs.
According to our records the present right-of-way fronting your
property on North 43rd Street is only 50' with minimum standards
of 60' resulting in a 10' shortage. We are asking for a 5'
donation of the Easterly portion of your property.
As a result of this donation, upon improvement of this property
you will receive an impact fee credit through Planning and Zoning.
