Petition of Helen C. Burke to define a Class A

zoning.
On Tuesday, August 28, 1990, you will be asked to review
the petition of Helen C. Burke for a definition of a Class A
mobile home as a single family detached dwelling unit in an AR-1
(Agricultural, Residential - 1 du/ac) zoning district. The
proposed location is on the west side of Sunrise Drive about
1500 feet north of Orange Avenue.
The Planning and Zoning Commission held a public hearing
on this petition on July 25, 1990. A number of neighbors
appeared in opposition to the petition. After discussion, the
Commission voted 6-1 to recommend that you deny the petition.
A copy of the original staff report on the matter and a
copy of Draft Resolution $90-249, which would grant approval to
the request, are attached.
Staff has reviewed the petition and recommends approval
of Draft Resolution $90-249. Staff believes that the mobile home
in question meets the definition of a Class A mobile home found
in the ordinance. Mobile homes determined to meet the
definition are permitted uses in this zoning district. The
ordinance does not give any criteria regarding neighborhood
character or compatible property values as a basis for making
this determination.

A RESOLUTION DEFINING A CLASS A MOBILE HOME
AS A SINGLE-FAMILY DETACHED DWELLING UNIT
IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St.
County, Florida, has made the following determinations:

1. Helen C. Burke presented a petition to define a mobile
home as a single family detached dwelling unit in an AR-1
(Agricultural, Residential - 1 du/ac) zoning district.
2. The St. Lucie County Planing and Zoning Commission held
a public hearing on the petition, after publishing notice at
least fifteen (15) days prior to the hearing and notifying by
mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board deny the
hereinafter described request for defining a Class A mobile home
as a szngle family detached dwelling unit in AR-1 (Agricultural,
Residential - 1 du/ac) zoning.
3. On August 28, 1990, this Board held a public hearing on
the petition, after publishing a notice of such hearing in the
Fort Pierce News Tribune on August 8, 1990, and notifying by~
mail all owners of property within 500 feet of the subjec%
property.
4. The Class A mobile home determination is consistent
with the St. Lucie County Comprehensive Plan and has satisfied
the standards of review set out in Section 11.05.02 of the St.
Lucie County Land Development Code.
NOW, THEREFORE, BE ITRESOLVED by the Board of County
Commissioners of St. Lucie County, Florida:
A. The St. Lucie County Board of County Commissioners has
determined that the request of Helen C. Burke to determine a
Class A mobile home as a detached single family dwelling unit to
located on the following described property:
Lots 37 and 38, Block B, Tropical Acres, as

PUBLIC HEARING - HELEN C. BURKE - FILE NO. MH-90-003
Mr. Serna presented staff comments. He stated this .698 acre
parcel was located on the west side of Sunrise Drive
approximately 1500 feet north of the Orange Avenue Extension.
The existing zoning on this parcel is AR-1 (Agricultural,
Residential - 1 du/ac). The particular parcel is a nonconforming
lot of record, however, so the minimum lot size requirements do
not apply. He stated that the land use designation for this
parcel is Agricultural 2.5 acres per dwelling unit, and the
surrounding land use is mainly single family residences and
vacant land. Mr. Serna stated that there were two vacant parcels
adjacent to this parcel and a large lot single-family home
located directly across Sunrise Drive. County Staff has reviewed
this petition and determined that the unit meets all requirements
of the single-family dwelling unit and on the basis of this
review recommends that the Planning and Zoning Commission forward
this petition to the Board of County Commissioners with the
recommendation of approval.
Mr. Pruitt asked if there were any other Mobile Homes
area.

Mr. Serna stated that there were a couple of mobile homes;
however, they did not appear to be Class-A mobile home type
units.
Chairman Terpening asked which lots were currently occupied by
mobile homes.
Mr. Serna stated that there was a mobile home located on Sunset
Drive, another located closer to the Orange Avenue Extension and
a third toward the end of Sunrise Drive.
Chairman Terpening asked whether this would be the first
for a mobile home in this vacinity.

Mr. Serna stated not to his knowledge. He stated he was not sure
if the existing mobile homes were conforming or nonconforming.
Helen C. Burke, the petitioner, stated that she planned on
making the mobile home into a nice single-family dwelling.
Susan Burke, the petitioner's daughter, stated that if the
Commission feels any improvements need to be made to the
exterior, i.e., roofing or siding, she is willing to make them.
Chairman Terpening asked if the mobile home would be a permanent
residence.
Susan Burke stated yes it would be her mother's residence.
Chairman Terpening stated that there was one (1) letter in favor
of the petition from a Floyd and Dorothy Ryan. Also, there was
one (1) letter in opposition to the petition from a Jodi L.
Fennecken and one (1) petition in opposition with 39 signatures.
Mr. Terpening asked the people in the audience who signed the
petition to raise their hands so a count could be entered into
the minutes. A total of thirteen (13) hands were counted.
Norman J. Vecit, 441 Sunrise Drive, appeared before the
Commission. He stated that he was against the zoning change
because he did not feel it would be right to allow a trailer to
move into the area.
Helen Tomlin, 350 Sunrise Drive, which is located across the
street and diagonally from the property in question, appeared
before the Commission. She stated that on both sides of her are
vacant lots at the present time. She is opposed to the change in
zoning and also against the mobile home moving into the
residential area. She feels that if this mobile home were
allowed, then the other vacant lots that surround her property
would also be open to have the same type of structure. She
doesn't feel the mobile home fits in with the neighborhood and
feels the mobile home would depreciate in value rather than
appreciate as a permanant type of structure, which would generate
more tax dollars in the future to promote the various projects in
St. Lucie County.
Gary Pore, 111 Sunrise Drive, appeared before the Commission.
He stated that the mobile homes that were spoken of earlier were
there under the assumption that permits have been obtained by the
people living in these mobile homes to build homes. He stated
that when the homes are completed, the mobile homes will then be
moved out. Mr. Pore stated he was against the mobile home being
classified as a single-family dwelling because mobile homes
depreciate in value as well as depreciating the property
surrounding them.
Chairman Terpening asked if the existing mobile homes were
temporary residences for owners constructing permanent homes.
Mr. Serna stated he was not sure.
Chairman Terpening asked if there, were any other
petitions in the area for a Class A Mobile Home or if
the first petition.

Gary Pore stated that the only other mobile home in the area is
located behind the store, which is another zoning district and
all the other mobile homes had permits to be on the property
until their houses were built.
Gordon Joyner, 261 Sunrise Drive stated that he wanted to clarify
what Mr. Pote said. The owner of the other mobile home in the
area had been given an extension. The mobile home at the end of
the road had not made any effort to start building, but all
mobile homes are now given one year to build and then they have
to move the mobile home.
William Fenneken, 422 Sunset Drive, stated that he does not
believe the mobile home should be allowed. He lived in a
mobile home park for eight years, he presently owns property in
a mobile home park, he lived in a mobile home park for eight
years while he accumulated enough money to build an $80,000 home.
He stated he did not think it was right to run down his home by
permitting a mobile home to move in next to him.
Joseph T. Hess, 1708 Dovetail Drive, Ft. Pierce, appeared before
the Commissioners. He has been in the area for fourteen years.
He stated that he is a broker/saleSman for a local real estate
firm and has been a chairman for a planning board for fourteen
years and knew the state. He stated that on behalf of Ms. Burke
he has known her and her family for twelve years and stated there
was no neighborhood she ever moved into or lived in that she did
not improve. He stated she is the type of person one would be
glad to have as a neighbor.
Tanya Kopatrick, 781 Sunrise Drive, appeared before the
Commission. She stated that she lives near one of the mobile
homes that supposedly has a permit to be there. She had called
about the mobile home and was told it was only allowed to be
there for one (1) more year and then it has to be removed. She
stated that she would not mind having a lady for a neighbor, but
she did not want the mobile home.
Chairman Terpening asked the petitioner if she had any closing
comments.
Michael Burke, son of Helen Burke, appeared before the
Commission. He stated that his mother's intention is to improve
the mobile home by putting a shingle roof on it and a foundation
on the bottom so appearance wise it looks as good as a house.
There being no further comments in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
Mr. Carman stated it appeared to him that the basic premise of
the petition was whether or not it was legal to put a mobile home
on this piece of property. He stated that if it is legal then
that is the way it should be; according to the comments of the
staff it would appear that is so, but just to make sure he wanted
to ask the attorney.
Ms. Krista Storey stated that the issue before the Board on this
petition is whether this particular structure meets the definitio
of a class A mobile home and, therefore, would be considered a
single family dwelling, which is a permitted use in the AR-1
zoning district. She stated it was simply a matter of the
structure meeting the criteria set forth in Section 2.2.000,
subsection 46 of the Zoning Ordinance. The Board has received
staff comments on the application of those criteria to the
current petition.. She stated that once you have made that
determination, that means the structure is equivalent to a
single family dwelling and it is, therefore, a permitted use in
the AR-1 zoning district.
Mr. Carman stated that the last paragraph of the staff comments
states they have reviewed the petition and determine that the
proposed unit meets all the requirements. Mr. Carman stated
that under those circumstances he moved the approval of this
petition.
The motion died due to lack of a second.
After considering the testimony presented during the public
hearing, including staff comments, and the standards of review as
set forth in Section 2.2.000, subsection 46, St. Lucie County
Zoning Ordinance, Mr. Skidmore moved that the Planning and Zoning
Commission recommend that the St. Lucie County Board of County
Commissioners deny the petition of Helen C. Burke to define a
Class A Mobile Home as a single family dwelling unit in AR-1
(Agricultural, Residential 1 du/ac) zoning because he does not
feel that a mobile home is the same as a single-family dwelling
as far as a housing area versus a mobile home area and to him
Class A mobile home is3ust what it states, a mobile home and not
a regular built house. The motion was seconded by Mr. Pruitt.
Ms. Enck stated that it seemed like they wanted to put a mobile
home in and the neighbors were concerned about aesthetics in
their neighborhood. She asked if there was a possibility of
working something out. She also asked if the mobile home was a
single wide or double wide.
Ms. Helene Burke stated it was a double wide.
Chairman Terpening stated that the public hearing was closed.
Ms. Enck stated that she used to live in Indian River Estates and
a mobile home there attached a garage and one could not see that
it was not a house.
Chairman Terpening stated that Ms. Enck was not speaking of a
mobile home, but of a premanufactured home. He asked Ms. Storey
if she was comfortable with the motion.
Ms. Storey stated that she appreciated Mr. Skidmore's comments
and said she would not be doing her 3ob if she did not emphasize
again to the Commission the issues. The issue is whether the
structure meets the structural criteria in the ordinance, and
those issues are relative to the minimum width of the main body,
the minimum roof pitch, the roofing materials, and the exterior
finish. She stated that she certainly appreciates the comments
of the neighbors; however, there was nothing in the criteria as
to howthe unit fits into the neighborhood. She stated it was
not a typical zoning petition in which that type of issue is
specified in the ordinance. She stated that she was not saying
that it was an appropriate or inappropriate policy, but her 3ob
was to advise the Commission regarding the legal criteria for
their consideration.
Chairman Terpening asked if it would be more appropriate to
include the roofing in the motion since some of the homes have
pitched roofs coming from the manufacturer and this one does not.
Ms. Storey stated yes.
Chairman Terpening interrupted and stated he heard staff's
presentation that it would be an add-on and not a factory built
roof. He asked if he was correct.
Mr. Serna stated that this mobile home did have a pitched roof.
Chairman Terpening asked if the roof was shingled.
Mr. Serna stated that he was not sure what type
would be used.

he stood on his motion to deny. Mr. Pruitt seconded the
amended motion and upon roll call, the Board voted 6-1 in favor
of the motion.

Dear County Commissioners:
We received your letter informing us that one of our neighbors has asked
for a zoning change to allow a mobile home in our development.
We strongly disagree to this zoning change. My husband and myself lived
in a mobile home park for the last ten years, and struggled to save up
enough money to enable us to finally get away from the mobile home park
and chose an area where we could build a nice home in a fine residential
AR-1 Agricultural area. It was our belief that you had to have ten
acres in order to put a mobile home on it if you weren't in a park.
Tropical Acres is just a small, two-street development, and there are
nice~ beautiful homes along both streets. We do not want any mobile
homes in amongst our neighborhood, as it will definitely bring down all
our property values, and that is not fair to the rest of us. When we saw
the mobile home being brought in we thought they were just going to live
in it until they built their home. Now we find out they want to stay
there ands_live in it and we firmly voice our objections to that. There
is still quite a bit of undeveloped land available on the two streets,
and if you make a variance for these people, that means the rest of the
properties could also come in and request variances and put up mobile
homes too, and then it would be just like a trailer park.
Again, we strongly voice our objection to this requested zoning change,
and urge our County Commissioners to vote against the proposed change.
Thank you for your time. My husband and I Will be attending the meeting
to voice our opinion at that time also.

COMMENTS:
The petitioner is requesting authorization to install a
mobile home, meeting the definition of a Class A Mobile Home as
set forth in Section 2.2.000 (46), St. Lucie County Zoning
Ordinance. This property is zoned AR-i, and several other mobile
homes as well as large-lot, single-family homes are located
nearby.
Although the minimum requirements in the AR-1 zone require
1-acre lots, this parcel was recorded before July 1, 1984 and is,
therefore, considered a nonconforming lot of record. As a
nonconforming lot of record, the minimum lot size requirements
are waived.
County staff has reviewed this petition and determined the
proposed unit to meet all requirements. Staff recommends
that you forward this petition to the Board of County
Commissioners with a recommendation of approval. If you have any
