Munshaw presented staff comments. She stated this was a petition for a change in zoning from RM-5 (Residential, Multiple Family - 5 du/ac) to CG (Commercial, General) for a 0.24 acre parcel located at 2605 Kerr Street. She stated that the land use designation in this area is Commercial. She stated that the petitioner wishes to use the existing house as an office for a business that he has been operating from his home. She stated that the surrounding zoning was RM-5 for the entire subdivision except for Commercial General to the south. She stated that staff has reviewedthis petition and finds that some sort of commercial use would be appropriate due to the commercial land use designation. She stated that staff had talked with petitioner about the possibility of a lower zoning classification, namely Commercial Office. She stated that one of the problems with the rezoning was that the lot was considerably smaller than the minimum lot size that would be required if he was going to erect a ~ew structure in Commercial General zoning. She stated that recommends against Commercial General zoning but would recommend Commercial Office. Mr. Pruitt asked staff if the lot was large enough to provide the required amount of parking. Ms. Munshaw stated she felt the existing building was small enough to allow for the parking area on the lot. She further stated that the main problem was that the minimum lot size in Commercial General was 20,000 and this lot was more like 10,000. Charles Blount, one of the petitioners, appeared before the Commission. H~ stated that he wanted to amend his petition downward to Commercial Office. Pearl Chambers, a resident in the area, appeared before the Commission; She presented the Commission with photographs she had taken of the subject property. She also presented the Commission with letters of opposition from: Mr. and Mrs. Yates, Mrs. Leonard Smith and family, Charles and Connie Waters and ~erself. She stated that they all wanted to keep the neighborhood residential and were opposed to any type of commerCial. Chairman Terpening noted for the record that the Commission had also received letters from Leo Gallahue and Stanley Caldwell opposing the zoning change. Lloyd 'Taylor, a property owner in the area, appeared before the Commission. He stated that he was opposed to the change from residential to commercial. He asked the Commission to explain what Mr. Blount had requested. Chairman Terpening e~plained that Mr. Blount had requested that his petition be amended from Commercial General do [ Commercial Office. Mr. Taylor stated that he was still opposed to the change. He stated that the property was very cluttered at the present time and he did not want it to be any worse. Chairman Terpening explained that if the zoning was changed to Commercial Office they would not be allowed to store anything outside. Ms. Munshaw stated that under Commercial General or Commercial Office that type of equipment should not be stored outside. Mr. Taylor stated he was aware of that but he felt that Blount was allowed to do this it would be a continuous action to keep the property cleaned up. if Mr. police Joyce Chambers, a resident of the area, appeared before the Commission. Although it was shown as Commercial land use in that area, it should be of sufficient size to meet buffer requirements and parking requirements. Mr. Carman stated that the 10,000 square feet would be legal. After considering the testimony presented during the public hearing, including staff comments, and the standards of review as set in Section 5.3.300, St. Lucie County Zoning Ordinance, Mr. Pruitt moved that the Planning and Zoning Commission recommend that the St. Lucie County Board of County Commissioners grant approval to the amended Petition of Charles V. and Jeanette Blount for a change in zoning from RM-5 (Residential, Multiple Family - 5 du/ac) to CO (Commercial Office) zoning. Motion was seconded by Mrs. King, and upon roll call, Mrs. Allen, Mr. Carman, Mrs. King and Mr. Pruitt voted in favor of the motion and Mr. McCain, Mr. Skidmore and Mr. Terpening voted against the motion. This resulted in a vote of four in favor of the motion and three against. Te~pening informed the petitioner that the petition forwarded to the Board of County Commissioners with a Chairman would .be recommendation of approval. Mr. Pruitt asked that as a Board they ask staff to look into the matter of having a minimum~3ize parcel, larger than a quarter of an acre, for commercial zoning. Chairman Terpening stated they could direct staff to investigate fhat but he was concerned with individual rezonings and individual buildings occurring on 10,000 square foot lots. Even if you blanket the whole neighborhood and change the zoning that still allows the opportunity of'having twelve or thirteen little buildings versus one or two larger buildings. Mr. Pruitt stated that he felt the parcels needed to be larger than the 10,000 square feet and possibly they should have several parcels before they could have the commercial development. They own a business, that plugs wells and would like to have an office independent of their home, which has been used as a home occupation for some time. Staff has reviewed this petition and finds that the subject property should be rezoned to some commercial district due to the commercial land use designation. However, the CG (Commercial, General ) seems premature at this time, due to the solidly residential character of the remainder of Kerr Street to the north. Yet CN (Commercial, Neighborhood) is hardly appropriate in an area s o cl os e to Wal-Mart and many other s hopping opportunities. The best apparent solution is to ask the applicant to consider CO (Commercial, Office), which would allow his stated purpose and also allow him to meet the 10, 000 square foot minimum lot size for that zoning district.
