Our office has been informed of a zoning request change on the
aboveright-of-way referenced guidelines, file and have been asked to review the existing
According to our records, the existing right-of-way is 50 feet on
North-43rd. Street and North 44th. Street bordering the east and
west portion of the above described property. The current
right-of-way standards are 60 feet. Which these roads are
currently 10 feet short in County standards.
Please contact our office regarding this matter so that we may be
able to discuss the probability of right-of-way dedication of 5
feet along North 43rd. Street and 5 feet along North 44th Street

WHEREAS, the Board of County Commissioners of
County, Florida, has made the following determinations:

Jr. presented a petition for a change in zoning from RS-
4 (Residential, Single Family - 4 du/ac) to I (Institutional) for

2. The St. Lucie County Planning and Zoning Commission held
a public hearing on the petition, after publishing notice at

On Tuesday, April 24, 1990, you will be asked to review the
petition of Apostle Faith Church of Deliverance by Agent
Rev. Isaac Miller, Jr. for a Change in Zoning from RS-4
(Residential, Single Family - 4 du/ac) to I (Institutional)
'from North 44th Street to North 43rd Street, approximately
225 feet south of Avenue O.
The applicant previously has obtained a rezoning to I
(Institutional) on the lots immediately to the north of the
subject proper.ty in order to build a church. Rezoning is sought
for these lots to provide possible room for expansion of parking
when the church is constructed.
The Planning and Zoning Commission held a public hearing on
the this petition on March 22, 1990. No one spoke in opposition
to the petition; a number of members of the congregation attended
the hearing in support. The Commission voted unanimously to
recommend approval.
Attached you will find unofficial minutes from the March 22
hearing, a copy of the original staff report on the matter, and
a copy of Draft Resolution $90-104, which would grant approval to
the request.

Ms. Munshaw presented staff comments. She stated this was a
petition for a change in zoning from RS-4 (Residential, Single
Family - 4 du/ac) to I (Institutional) for property located from
North 44th Street to North 43rd Street, approximately 225 feet
south of Avenue O. The parcel consists of two small lots with a
combined size of .37 acres. She stated the parcel is adjacent to
a larger parcel which had already been zoned Institutional. She
further stated the property is to used for additional parking for
the church that is to be built on the larger parcel. She stated
that the Institutional zoning is compatible with all future land
uses and staff does recommend approval of the petition.
Charles Hendley, Esquire, appeared on behalf of the petitioner.
He stated the Institutional zoning would be compatible with the
St. Lucie County ComPrehensive Plan and there wo~ld be no adverse
effect on the surrounding community. He stated he had nothing
further to add to staff comments but was available for questions.
Chairman Terpening asked all persons present in favor of the
Petition 'to stand for a head count. Chairman Terpening noted for
the record that there were 25 people present in favor of the
petition.
Rev. Isaac Miller, Jr. pastor of the Apostle Faith Church of
Deliverance, appeared ~efore the Commission. He. stated.the
church had bought the two ad3acent lots for additional parking
and requested that the Commission approve the petition.
Hearing no further public comment in favor of or in opposition to
the petition, Chairman Terpening closed the public portion of the
hearing.
After considering the testimony presented during the public
hearing, including staff comments, and the Standards of Review as
set forth in Section 5.3.300, St. Lucie County Zoning Ordinance,
Mr. Pruitt moved that the Planning and Zoning Commission
recommend to the St. Lucie County 'Board of County Commissioners
that they grant approval to the petition of Apostle Faith Church
of Deliverance, Inc. for a change in zoning from RS-4
(Residential, Single Family - 4 du/ac) to I (Institutional. Mr.
McCain seconded the motion, and upon roll Call the Board voted
unanimously in favor of the motion. '
Chairman Terpening informed the petitioner's representative that
the petition would be forwarded to the Board of County
Commissioners with a recommendation of approval.
Chairman Terpening called a recess at 8:00 p.m.
The meeting resumed at 8:10 p.m.

Section 5.2.000
DEVELOPMENT PERMITTED AS OF RIGHT
(1) Application
An applicant seeking approval of his proposed development for s
use permitted as of right in Section 3.3.100 or for a sign
permitted in Section 3.2.700 shall, after obtaining a Certifi-
cate of Zoning Compliance in'accordance with Section 5.1.500,
submit an application for a Building Permit or an application
for a Sign Permit together with a description of the proposed
developmen~ to the Communi~ Development Director.
(2)
Action on the Application
If the Community Development Director determines that the
proposed development has been issued a Certificate of Zoninc
Compliance, and the proposed development complies with all othe~
requirements of the St. Lucie County Growth Management Polic~
Plan and all other applicable Coun%~ ordinances, he shall issue
the permit.
Section 5.3..000 AMENDMENTS TO THE ORDINANCE AND OFFICIAL ZONING ATLAS
Section 5.3.100 Purpose
The purpose of this section is to provide a means for changing
the text of this Ordinance or the Official Zoning Atlas. It is
not intended to' relieve particular hardships or confer special
privileges or rights on any person.
Section 5.3.200 Persons-Entitled to Propose Amendments
(1)
Amendments to the text of this Ordinance may be proposed
by the Bo&~d of County Commissioners, the Planning and
Zoning Commission, or any other interested party.
(2)
Amendments to the Official Zoning Atlas may be proposed by
the Board of County Commissioners, the Planning and Zoning
Commission, or over fifty (50) percent of the owners o~
the real property to be directly affected by the proposed
amendment.
Section 5.3.300 Standards of Review
In reviewing the application of a proposed amendment, to the text
of this Ordinance or an application for a proposed amendment to
the Official Zoning Atlas, the Board of County Commissioners and
the Planning and Zoning Commission shall consider:
(1)
Whether the proposed amendment is in conflict with any
applicable portions of this Ordinance;

(2)
Whether the proposed amendment is consistent with all
elements of the St. Lucie_County Growth Management Policy'
Plan.
(3) Whether and the extent to which ~he proposed amendment is
inconsistent with existing and proposed landuses;.
(4) Whether there have been changed conditions that require an
amendment;
(5)
(-6)
Whether and the extent to which the proposed amendment
would result in demands on public facilities, and whether
or to the extent to which the proposed amendment would
exceed the capacity ofsuch public facilities, including
but not limited to transportation facilities, sewage
facilities, water supply, parks, drainage, schools, and
emergency medical facilities;
Whether and the extent to which the proposed amendment
would result in significant adverse impacts on the natural
environment;
(7) Whether and the extent to which the proposed amendment
would adversely affect the property values in the area;
(8) Whether and the extent to which the proposed amendment
would result in an orderly and logical development pat-
tern, specifically identifying any negative effects on
such pattern;
(9)

Whether the proposed amendment would be in conflict with
the public interest, and is inharmony with the purpose
and interest of this Ordinance; and
Any other, matters that may be deemed appropriate by the
Planning ahd' Zoning Commission or the Board of County
Commissioners, in review and consideration of the proposed
amendment.
Section 5.3.400 Procedures
(i)
Proposal by the Board of County Commissioners or the Plan
ning and Zoning Commission
Proposals for an amendment to the text of this Ordinance
or an amendment to the Official Zoning Atlas by the Board
of County Commissioners or the Planning and Zoning Commis-
sion shall be transmitted to the Community Development
Director for application. Any interested party may
request that the Board of County Commissioners or the
Planning and Zoning Commission initiate such an
application.

Proposals by Others
Any person desiring to apply to the Board of County Com-
missioners for an amendment to the text of this Ordinance
or an amendment to the Official Zoning Atlas shall submit
an application to the Community Development Director,
accompanied by a nonrefundable application fee as
established from time to time by the Board of County
Commissioners to defray costs` of processing the
application. An applicant may withdraw the application atI
a~ time prior to the commencement of the public hearing
beforethe Board of County commissioners, and may withdraw
the application thereafter only upon an affirmative vote
of a majority of the Board.
Application
The .apPlication shall include the following information:
(a) The applicant's name and address;
(b)

If the application requests an amendment to-the text
of this Ordinance, the precise wording of any pro-
.posed amendment to the text of this Ordinance shall
be provided;
A statement describing any changed Conditions 'that
would justify an amendment;

Upon notification of the completed application for an
amendment to the text of this Ordinance or an application
for amendment to the Official Zoning Atlas, the Planning
and Zoning Commission shall place it on the agenda of a
regular meeting for a public hearing in accordance with
the requirements of Section 5.1.100. The public hearing
held on the application shall be in accordance with Sec-
tion 5.1.200. In recommending the application to the
Board of County Commissioners, the Planning and Zoning
Commission shall consider the 'standards in Section
5.3.300.
Action by Plannin9 and Zoning Commission
Within a reasonable time of the conclusion of the public
hearing, the Planning and Zoning Commission shall make a
recommendation to grant or deny the application for amend-
ment to the Board of County Commissioners in the form
specified in Section 5.1.200(5).
Section 5.3.600 Action by Board of County Commissioners
(1) (a)
Upon receipt of the recommendation of the Planning
and Zoning Commission, the Board of County

Commissioners for a public hearing in accordance
with the requirements of Section 5.1.100.

amendment to the text of this Ordinance or a proposed
amendment to the Official Zoning Atlas, the Board of
