At the recent regular session of the Florida Legislature,
Senate Bill 978, which amended several sections of the Local
Government Comprehensive Planning and Land Development Regulation
Act..(also kno%~n as .Chapter 163, Florida Statutes) was passed and
signed into law. One o.f the man amendments to this Act dealt
with the procedures to be fe lowed for amending a Local._
Government's Comprehensive Plan. Inder the previous statute, th~
board of county commissioners, only had to certify that the Local
Planning Agency held a public hearing on the propose~
comprehensive plan, element, or portion thereof prior to it~
transmittal to the State Land Planning Agency for review. Unde!
the new law, the board of count commissioners is required t(
hold a public hearing on the pi )posed plan or plan amendment
prior to the transmitting of that plan or amendment to the Stat~
Land Planning Agency for review.
On July 24, 19'86, Rhoda P~ G2.asco, an attorney for the Stat~
of Florida Department oI Communit Affairs opined that the Count
