W~LP. EAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Chester B. Griffin and Richard V. Noill presented a
petition to amend the future land use classification set forth in
the St. Lucie County Growth Management Policy Plan from -~'1~
(Residential, Low) to X (Interchange) for the property described

2. The St. Lucie County Local Planning Agency, 'after
holding a public hearing on May 1, 1986, of which due notice was
published at least seven (7} days prior to said hearing and all
owners of property within five hundred feet (500') were notified
by mail of said hearing, has recommended that the Board amend the
future land use Classification set forth in the St. LUcie County
Growth Management Plan from RL (Residential, Low) to X
(Interchange) for the property described in Paragraph A lying
SOuth of Canal No. 37.
3. The Board held a public hearing on May i4, 1986, after
Publishing a notice of such hearing in the Fort Pierce News
Tribune on May 6, 1986.

Petition of Chester B. Griffin and Richard V. Neill t
the Future Land Use Classification of the St. Lucie County
Management Policy Plan from RL (Residential, Low) to X (Inter(
for two parcels located between Peters Road and 1-95.
MEMORANDUM: On January 23, 1986, this Agency sitting
as the~. Lucie County Planning and Zoning Commission,
heard a request on behalf of Chester B. Griffin and
Richard V. Neill to amend the Future Land Use Maps of
The St. Lucie County Growth Management Policy Plan
from RL to X for two parcels between Peters Road and
1-95. At that time, this Commission voted to recom-
mend approval of only a portion of this petition
identified as Parcel 2. ,
County Staff has no objection to this petition pro-
vided that the same recommendation of approval is
made as was ih January, 1986.

of the January 23, 1986 meeting of the Planning and
Zoning Commission).
Mr. Sciturro asked if
petition, anyone wished to speak in favor of this
Mr. Bruce Abernethy, Esq., of the law firm of Neill Griffin,
Jeffries and Lloyd, addressed the Board, saying: '
I am appearing here tonight on behalf of Richard V. Neill and
Chester B. Griffin.
Staff advised at last night's hearing, to bring forth any new
and compelling evidence in favor of this petition.
Mr. Sciturro stated that the petition would be sent to the
Board of County Commissioners with a recommendation for approval
of that portion of the property south o~ ~=~ .....
One day after the meeting of JanUary 23; 1986, we rec.
a letter from an adjacent property owner, Fred C. Fi:
stating that he fully supports our petition to Plan Am

His is the only parcel of land abutting that portion of t
subject property, (the north one-half), which was not
mended for approval by'this Board at the hearing on
23, 1986.
This Board only recommended to approve the change from RL
X land use for the south one-half of the PrOperty.
In view of the support shown by the adjacent property

Mr. Field spoke in oppositon to the petition. He said
two or three years ago, the County Commission denied
this same petition. He said there are lots of new homes
on Graham Road and Copenhaver Road, and he said there is
no reason for commercial zoning to go beyond Andrews Avenue.

On May 14, 1986, you will be asked to review a Petition
on behalf of Chester B. Griffin and Richard V. Neill to
reclassify proper.fy located between 1-95 and Peters Road,
South of Graham Road, from RL to X. This proposal was
presented to the St. Lucie County Planning and Zoning
Commission in Oanuary of 198~ and to the St. Lucie County
Local Planning Agency in May of 198~. At both of these
meetings it was recommended that only a portion of this
Petition be approved. Specifically, both Bodies support the
reclassification of that property south of Canal.#37 but do
not support the reclassifying of that property north of this
canal.
County Staff recommends that this Petition be approved

COMMENTS: As required, the Petitioner had submitted a
Conceptual Site Plan for this property. That plan, in
conjunction with Petition #19, indicated an original intended use
.of the property for motel/hotel purposes. My office has recently
received a request by the Petitioner to withdraw the rezoning
petition for this property. However, the Petitioner would like
to let stand before this Commission, the Land Use Amendment
Petition for consideration.
With the withdrawal of the Rezoning Petition (see
Petition #19), the conceptual site plan is thus voided and no
longer an item for consideration. County Staff has looked into
this matter and recommends that the Commission approve a land use
designation to Interchange (X) for only the balance of Parcel #2.
That is, Staff has no objection to extending the existing X land
use classification northward to the North St. Lucie River
Drainage District Canal #37.
Staff, however, recommends denial of any change to
Parcel #1, which stretches from Canal #37 to Graham Road. Staff
believes such a request to be premature at this point in time. It
should be pointed out that any 1-95 oriented development would
draw its traffic from the Okeechobee Interchange to the South.
This distance is about one mile; the road unpaved. Parcel #1
should also remain RL at this time in order to buffer residential
areas on Graham Road.

PUBLIC HEARING:
Petition of Chester B. Griffin and Richard V.,Neill to
amend the future land use classification of the St. Lucie County
Growth Management Policy Plan from RL (Low Density Residential
Development) to X (Interchange Oriented Developments) for pro
located on the southwest corner of 1-95 and Graham Road.
Attorney Bruce Abernethy appeared to represent this petition
also. He said they are requesting the Plan Amendment but have
withdrawn the rezoning petition that was to follow. This is not
the type of land that should be low density residential, Mr.
Abernethy said. 1-95 is directly to the east of the property
and since the petitioners have no immediate plans to develop the
property the zoning will remain RS-2. When they decide to deve-
lop the property they will have to rezone it and go through a
Site Plan review at the time of development.
Mr. Earl Field spoke in opposition to the petition. He said
two or three years ago the County Commission denied this same
petition. He said there are lots of new homes on Graham and
Copenhaver and there is no reason for commercial zoning to go
beyond Andrews Avenue.
Mr. Marion Sizemore said he has just completed a new home
in this area. He lived on Okeechobee Road and Jenkins R~ad for
26 years and he sold that so the property could be developed.
He said he agreed with Mr. Fields and he would like to save Mr.
Abernethy the trouble of coming back to rezone the property. He
said he saw no reason at this time to change the land use, there
is no interchange at Graham Road and the only ingress and egress
to those homes is Graham Road.
Mr. Walter Heinrick also spoke in opposition to the petition
He said he has just built a new home and there are lots of childr
in the area. He presented a petition in opposition to the petiti
Mrs. Vickie Trefetner said she lives on Copenhaver, they
built their home 7 or 8 months ago and they feel it is a perfect
area and size for children. She said she did not favor the
petition.
Mr. Abernethy said there is a Site Plan pending on the prop(
to the south for Royce Motel
Mr. Carman asked Mr. Murphy if Staff recommends approval of'
the petition and Mr. Murphy said Staff recommends only partial
approval. Staff recommends approval of just that portion to the
south of Canal R/W # 37.
Mr. Carman asked Mr. Abernethy if Mr. Griffin and Mr. Neill
would accept the Board changing their petition.
Mr. Abernethy said what has been suggested by Staff is not
consistent with what they are attempting to do with the petition.
Mr. Terpening asked Mr. McIntyre if the Board desires to
m~ke a recommendation for that portion just south of Canal # 37,
when this petition goes forward, would that be just a recommendati
Mr. Mc Intyre said that is what it would b~, he had no proble
with that and that is what Staff has recommended.
Mr. Carman made a motion to approve the petition for just
that portion of the property south of Canal # 37 to X. The motion
was seconded by Mr. Terpening and upon vote was unanimously approv
by the Board.

Richard V. Neill for change in future land use
classification from RL to X and for a change
in zoning from RS2 to CT; property located
North of Okeechobee Road and West of 1-95
Enclosed herewith please find the following:
1. Petition for change in future land use classification.
2. Application for change to the Official Zoning Atlas of
St. Lucie County.
3. A check in the amount of $500.00 in payment of the joint
application fee.
It is my understanding that although the cut-off date for
filing the Petition for Change in the future land use
classification is Friday, December 20, 1985, It will be
acceptable to file a conceptual site plan (which ordinarily
accompanies the Petition for change in future land use
classification) after December 20, 1985, so long as it is filed
on or before December 31, 1985. If for any reason my
understanding is incorrect, please advise immediately since it is
very important to Mr. and Mrs. Zaydon that the enclosed Petition
and Application be heard in May of 1986.
