SUBJECT: Use Determination _ Parking of Receational Vehicles
Dear Mr. Murphy:
In regard to your letter of July 27, 1987, please be advised
that the parking and storage of recreational vehicles/boats is
a permitted use under the Commercial General zoning district
regulations of the St. Lucie County Zoning Ordinance.
Specifically, this use would be classified as a motor vehicle
parking facility (3.3.112(2)(vv)) under the permitted uses of
this district.
Please be advised, that in establishing any such use in the
commercial zoning district, you would be expected to comply with
all landscaping and screening requirements of the St. Lucia
County Zoning. Ordinance. These requirements must be met before
any zoning compliance can be issued for this use.
If you have any further questions on this matter, please let
me know.

We are in the process of selling a 3.3 acre tract on the east side of
North U.S. #1, approximately one-quarter mile north of Indrio Road. This
property at one time was used as a "men's health club", and fortunately
was shut down by the County.
Our buyer from Louisville, Kentucky is wanting to utilize this property
for an R.V. and boat storage operation. In doing this he would clean up
the property, fence it in and store and possibly rent and repair R.V.'s
and boats.
The entire property (an assessors map is enclosed) is zoned general
commercial; however I do not see these particular uses itemized in the
general commercial zoning ordinance. I think this would be a definite
improvement to this property and would greatly appreciate it if you would
write me a letter stating if these uses are permissable on this property.

WHEREAS, the Board of County C°mmissioners of St. Lucie
County, Florida, has made the following determinations:
1. Dorothy L. Foster presented a petition to amend the
future land use classification set forth in the St. Lucie County
Growth Management Policy Plan from RL (Low Density Residential)
to CG (Commercial, General) for the property described_ below.
2. The St~ Lucie County Local Planning Agency, after
holding a public hearing on December 10, 1986 of which due notice
was Published at least seven' (7) days prior bo said hearing and
all owners of property within five hundred feet (500') were
notified by' mail of said hearing, has recommended that the Board
amend the future land use .classification set forth in the St.

CommiSsioners of St. Lucie County, Florida:
A. ~NGE IN FUTURE LAND USE CLASSIFICATION.
The future land use classification set forth in the St.
Lucie County Growth Management Policy Plan for that property
described as follows:
Section '17, Township 34 South, Range 40 East,
the South 200 feet as measured along U.S. 1
and along Old Dixie Highway of that part of
the Northwest 1/4 of the Northeast 1/4 lying
between U.S. 1 and Old Dixie Highway, less
the West 225 feet as measured parallel to
U.S. 1. Containing 2.30 acres more or less.
(Located on the east side of U.S. 1,
approximately 1400 =feet north of Indrio
Road. )

from RL (Low Density Residential) to CG (Commercial, General).
B. FINDING OF CONSISTENCY.
This Board specifically determines that t~e approved
change in future land use plan is consistent with the policies
and objectives contained in the St. Lucie County Growth
Management Policy Plan.
C. ~7~ANGES TO ZONING MAP.
The St. Lucie County Community Development Director is
hereby authorized and directed to cause the changes to be made on
the Official Zoning Map of St.' Lucie County, Florida, and to make
notation of reference to the date of 'adoption of this ordinance.
D. CONFLIC~ ING PROVISIONS.
Special acts of the Florida legislature applicable only
areas of St. Lucie County, County ordinances

and County resolutions, or parts thereof, in conflict with this
ordinance are hereby superseded by this ordinance to the extent
of such conflict.
E. SEVF. RAB IL ITY.
If any portion of this ordinance is for any reason held
or declared to be unconstitutional, inoperative or void, such
holding shall not affect the remaining portions of this
ordinance. If this ordinance or any provision thereof shall be
held to be inapplicable to any person, property or circumstances,
such holding shall not affect its applicabii-ity to any other
person, property or circumstances.
F. APPLICABILITY OF ORDINANCE.
This ordinance shall be applicable as stated in
Paragraph A.
G. FILING WITH THE DEPARTMENT OF STATE.
The Clerk be and hereby is directed forthwith to send .a
certified copy of this ordinance to the Bureau of Laws,
Department of State, The Capitol, Tallahassee, Florida, 32304.
H. FILING WITH D~PARTMENT OF COMMUNITY AFFAIRS.
The County Attorney shall send a certified copy of this
ordinance to' the _Department of Community Affairs, 2571 ExecUtive
Center ' Circle East, Tallahassee, Florida, 32301.
I. EFFECTIVE DATE.
"This ordinance shall take effect upon receipt of
official acknowledgment from the Office of Secretary of State
that this ordinance has been filed in that office.

Attorney Bruce Abernethy appeared before the Board on behalf of
his client to request Board approval of the proposed change in
land use.
Attorney william Oaney appeared before the Board on behalf of his
mother who is the owner of property to the south and spoke in
favor of the proposed change in land use.
Based on the recommendation of the Local Planning Agency, it was
moved by Com. Culpepper., seconded by Com. Krieger, to adopt
Ordinance No. 86-86 approving the petition in its entirety which
Ordinance amends the St. Lucie County Growth Management Policy
Plan, Ordinance No. 86-01 by changing the land use designation of
the property located on the east side of north U.S. #1, approxi-
mately 1,400 feet north of Indrio Road from RL to CG, making
findings; providing for making the necessary changes on the
official zoning map of St. Lucie County; and, upon roll call,
motion unanimously carried.

On Thursday, December 18, 1986, you will be a§ked to
review a petition on behalf of Dorothy t. Foster to amend the
Future Land Use Maps of the'St. Lucie County Growth Management
Policy Plan from RL to CG. This petition was presented to the St.
Lucie County Local~ Planning Agency for review on December 10,
1986, at which time this Agency voted 4 to 1 to recommend
approval of this petition. In offering this recommendation of
approval, this Agency determi~ned that the proposed petition is
consistent with the Policies and Objectives of the St. tucie
County Growth Management Policy Plan.
As required under Chapter 163, Florida Statutes, County
Staff has transmitted this amendment request to the Florida
Department of Community Affairs for interagency -review. In com-
ments received back from the Department, concern was expressed
about the compatibility of this petition with the Commercial
Development Policies of the Growth Management Policy Alan. On
September 22, 1986, the Treasure Coast Regional Planning Council
reported that..this proposed amendment did not conflict with any
regional plan or policy.
Attached for your review is a copy of the original staff
comments on this petition, transmitted to you on August 1, 1986,
and the most recent memorandum transmitted to the St. Lucie
County Local Planning Agency on December 2, 1986. By separate
memorandum, the County Attorney's Office will be providing a
Draft Ordinance denying this petition, in accordance with Board
policy.

Commissioners held a public hearing for the purpose of
authorizing the transmittal ofthis petition to the Florida
Oepartment 'of Community Affairs as required under Chapter
163.~184, Floridia Statute. As of this date, my office has not
received any return comments from the Department about this
petition. On September 22, 1986, the Treasure Coast Regional
Planning Counci~ held a nearing on the proposed petition, and
reporteO that the proposal did not conflict with any adopted
Council plans or policies. . -

Dear Commissioner Fenn:
Pursuant to section 163.3184, Florida Statutes, the Department
of Community Affairs has conducte~ a re~ie--w of the proposed amend-
ments to the St, Lucie County Growth Management Policy Plan.
Our review indicated that the August 11, 1986, proposed plan.
amendments were generally-consistent with the statutory requirement~
except as noted in the attached comments. The Department believes
the County should continue to monitor the cumulative impact of such
plan amendments to ensure the internal consistency of the adopted
Growth Management Policy Plan pursuant to s.163.3177(2), Florida
Statu.te~. Additional comments from the Treasure Coast Regional
Planning Council and the Indian River County Board of County
Commissioners~have been attached for your review and possible use
during the comprehensive plan amendment process.
Once the adoption process is complete, the Department
requests a copy of the amended comprehensive plan as required by
s.163.3187(3), Florida Statutes.

Pursuant to the requirements of the Local Government Comprehensive Planning
and_.Land De~elooment_. Regulation Act,_ Chapter__163, Florida Statutes,'the
Treasure Coast Regional Planning Council reviewed the amendments~to the St.
Lucie County land use element at its reoular meeting on September 22, 1986.
The following comments were a~proved by Council for transmittal to the
State Department of Community Affairs pursuant to Sections 163.3184(1)(c)
and (2), Florida Statutes, for consideration by the County prior to
adoption of the document.
Evaluation
The proposed amendments to the Land Use Element have been reviewed in
accordance with the. requirements of Chaoter 163, Florida Statutes,
Council's review procedures,~ ~nd Council's adopted plans and policies. The
following comments are offered as a result of that r~view.
The proposed amendments are not in conflict or inconsistent with
adopted Council plans or policies. Proposals to convert large
tracts of agricultural lands to semi-urban uses (e.o., Item 20)
are of some concern, however, and should not be considered prior
to a comprehensive reevaluation of the County's goals and
objectives for the entire area (see attached letter).
Prior to the approval of the land use amendments, the proposed
changes should be tested aoainst the St. Lucie County
transportation model, to assure that the affected roadways can
accommodate the more intense land uses.
Council suoports the efforts of St. Lucie County and the School
Board of S~. Lucie County (see the attached letter) in improving
educational opportunities through the use of dmdications and
impact fees as discussed in the amendment request.

The property described by Item 1 is close to the sites of the
Treasure Coast Square Mall and the proposed Vista Plantation
development in Martin County. The ability of U.S. 1 to
accommodate additional traffic generated by Item I must be
ensured. Adequate right-of-way should be dedicated f~r future
expansion of the roadway network prior to the development of this
parcel.
Considering the proximity of Item 16 to the St. Lucie County
Airport, the current land use designation of Liaht Industrial may
be more appropriate than the proposed Residential land use
designation. Consideration should be aiven to plans for future
expansion of the airport facilities an~ increased levels of air
_.traffic,-as well as noise-and safety issues. - -
The property described by Item 18 contains many acres of
wetlands known as the Northern Savannas. Care should be taken
to minimize the impacts of any development on this
environmentally sensitive area.
The property described by Item 20 is located on the border of
Indian River County and is near the interface of the St. johns
River Water Manaaement District and South Florida Water
Management District. Since a development of such size in this
location may have far reaching impacts, it is recommended that
the land use amendment 'not be approved until both St. Lucie
County and Indian River ,County aqree that such an action would
not adversely affect the ability of ~ither county to realize
growth management and planning objectives. A primary concern is
the relationship of the project with the existing
urban/agricultural boundary. Development of the property as
residential may create compatibility problems with existing
agricultural development. Prior to considering any change in
land use, the County should carefully consider its long range
plans for this area, provision of infrastructure and services,,
and the -impacts of residential development on agricultural
activities in the area. Additionally, a project of the size of
this proposal would be a DRI. Final consideration of the
proposed land use change should, perhaps, wait until a report
and recommendations can be developed that evaluate regional
issues.

INVOCATION:
The Invocation was given by Joseph Sciturro.
PUBLIC HEARING:
Petition of Dorothy L. Foster (by Agent: Bruce R. Abernethy, Jr.)
to amend the Future Land Use Maps of the St. Lucie County Growth
Management Policy plan from RL (Residential, Low) to CG
(Commercial, General) located on the east side of US 1,
approximatley 1,400 ft. north of Indrio Road.
Agent Bruce R. Abernethy, Jr., representing the petitioner,
presented a brief history and location of the subject property.
He stated that the current plan designation for the property is
CG for the front 200 ft., and RL for the east 575 ft. The
petitioner wishes that the east portion of the property be under
a consistent and unified plan designation for the entire parcel.
Because of its width, depth of the commercial portion, and cur-
rent zoning, the petitioner feels there is no economically feas-
ible use for the property. Beatrice Neil, a property owner to
the south, was prese~nt at the July 23, 1986 hearing and indicated
full support of the petition. Mrs. Neil remains firm in her
support. Mr. Abernethy quoted Policy No. 43 from the GMPP
regarding commercial development which deals with highway
commercial development catering to the motoring public. In
conjunction with Policy No. 70, the existing shallow 200 ft. deep
strip of commercial zoning should be deepened to 600-800 ft.,
which is exactly what the petitioner is requesting, a total of
425 ft. Further regarding Policy No. 70, the petitioner feels
that an acceptable access to US 1 is provided. .There is also
adequate buffering of residential property involving the FEC
Railway and Old Dixie Highway. To the north, one residence
exists and has a buffer zone of trees.
In review of the~GMPP, Mr. Abernethy did not agree with DCA
comments regarding possible violation of commercial development
policies on this size parcel.
Mr. Sciturro questioned the use of an existing building on the
subject property. Mr. Abernethy responded that the building is
vacant. He also responded to questioning by Mr. SciturrO that
the adult book store is located on the other side of US 1. Mr.
Sciturro asked if the petitioner would be using~ Old Dixie Highway
for ingress and egress, or using US 1. Mr. Abernethy replied
that the intended ingress/egress wo~ld be US 1.
Mr. Murphy confirmed that the action taken at the last hearing
was for the entire property.
There was no one present to speak in favor or in opposition to
the petition. Chairman Terpening, for the record, mentioned
three letters in opPosition, reading'-'their concerns that the
petition isnot compatible with residential use; noise, factors;
buffering considerations between residential and commercial
zoning; annoyance and hardship. TWo of the letters referred~to
illegal activities surrounding the subject property.
Mr. Abernethy rebutted these comments by saying that the owner
has not operated an~-~.llegal activity on the su~-~ct property, but
even if there were should not be a basis of ~etermining the
appropriateness of t~is petition. He reiterated his comments
regarding US 1 providing adequate buffering.
Mrs. Ferrick discussed a previously mentioned possible prevention
of accessing Old Dixie Highway being considered that would re-
quest an amendment to the GMPP to make either the entire tract
classified as CG or ~CH, all but the eastern 1 ft. The subject 1
ft. was left unclassified to protect the integrity of this area.
Mr. Abernethy stated that the petitioner had indicated a
willingness to work in that direction. What the petitioner
really needs is a further deepening of the commercial portion to
utilize access from US 1.
Mr. Terpening asked for clarification from Mr. Abernethy that the
petitioner was requesting a change to exclude the subject 1 ft.,
and Mr. Abernethy replied that they were willing to amend the
petition accordingly.
Mr. Carman and Mr. Sciturro discussed the probability that
illegal access from Old Dixie Highway would occur, due to an
invisible line that isn't to be crossed. Mr. Sciturro offered
that the County has a remedy for a violation of that sort.
Chairman Terpening closed the public portion of the meeting.
Mr. Murphy, representing Staff, related that the Dept. of
Community Affairs commented that the petition appears to be
inconsistent with commercial development policies of the GMPP.
The Treasure Coast Regional Planning Council did not find that
this proposed amendment conflicted with any council plans or
policies. Staff recommends against this petition because the
GMPP, in 1981, indicated that there should not be any
commercially or industrially designated land use along Old Dixie
Highway, north of St. Lucie Blvd., with the exception of the
existing uses at the Treasure Coast Industrial Park and Harbour
Branch Oceanographic Institute. In 1984 the Board of County
Commissioners declined to extend the commercial zoning or land
use classification beyond its present position.
Mr. Sciturro further discussed with Mr. Murphy what enforcement would
be possible regarding the previously mentioned 1 ft. of property.
Mr. Terpening asked Mr. Murphy if the Board moved for approval,
would he feel more comfortable with the 1 ft. strip being amended
in the petition. Mr. Murphy replied that this strip does not
provide further protection for the County, and foresees future
problems if approved in the aforementioned manner.
Mr. Sciturro made a ~otion that the petition be recommended for
approval, amending the petition to encompass the 1 ft. strip
in its entirety as discussed, and determining that it is consis-
tent with the GMPP. Mr. Carman seconded the motion, and upon
roll call, Mrs. Ferrick voted against the motion and Mrs. King,
Messrs. Sciturro, Carman and Terpening voted in favor of the
petition. The petition will be forwarded to the Board of County
Commissioners with a recommendaiton 6f approval, amending the
petition to encompass the 1 ft. strip discussed, and determining
that it is consistent with the GMPP.

adjoining property and the permitted uses of CG would create an
extreme hardship to me. 1 have lived on this property for 66 years.
If this Planning Agency and Board of County Commissioners do permit
this change I expect protection from any annoyance this change
causes me.
No CG zoning should be permitted near any homes as there are multiple
problems created by this type of zoning in Saint Lucie County. (Just
visit homeowners that live near CG zoning if you doubt ~¥~'statement)'

Amendments to the St. Lucie County Land Use
Element
Introduction
Pursuant to the provisions of the Local Government Comprehensive Planning
and Land Development Regulation Act, Chapter 163, Florida Statutes, the
Council must be provided an opportunity to review and comment on plan
amendments prior to their adoption. St. Lucie County has- submitted
proposed land use amendments to the State Department of Community Affairs,
which in turn is seeking Council's comments.
Background
St. Lucie County is considering 20 amendments to the _Future Land Use Map.
Locations of the properties under consideration are shown on the accom-
panying map, and the number of acres and proposed changes in land use
designations are summarized in the attached list.
The County is also considering text amendments that would 1) add language
describing p~ans for new residential development to bear a portion of
educational costs through developer dedications and impact fees, 2) delete
the requirement for site development plans with all rezoning petitions, and
3) require a site development or concept plan for .proposals to amend the
Future Land Use Maps of the Growth Management Policy Plan {i.e., the
Comprehensive Plan).
Evaluation
The proposed amendments to the Land Use Element have been reviewed in
accordance wi th the requirements of Chapter 163, Florida Statutes
Council's review procedures, and Council's adopted plans and policies. The
following comments are offered as a result of that review.
The proposed amendments are not in conflict or inconsistent with
adopted council plans or policies. Proposals to convert large
tracts of agricultural la, ds to simi-urban uses (e.g., Item 20)
are of some concern, however, and should not be considered ~rior
to a comprehensi've re-evaluation of the county's goals and
objectives for the entire area.
Prior to the approval of the land use amendments, the proposed
changes should be tested against the St. Lucie County
t_ranspor~ation model, to assure that the affected roadways can
~'6-6mmodate the more intense land uses.
Council supports the efforts of St. %ucie County and the School
Board of St. Lucie County (see the attached letter} in improving
educational opportunities through the use of dedications and
impact fees as discussed in the amendment request.
The property described by ~k~J2~m.j,S close to the sites of the
Treasure Coast Square Mall and the proposed Vista Plantation
-development in Martin County. The ability of U.S. I to
acco~nodate additional traffic ge~lerated by Item 1 must be
ensured. Adequate right-of-way should be dedicated for future
expansion of the roadway network prior to the development of this
parcel.
Considering the proximity of ~to the St. Lucie County
Airport, the current land use designation of Light Industrial may
be more appropriate than the proposed residential land use
designation. Consideration should be given to plans for future
expansion of the airport facilities and increased levels of air
traffic, as well as noise and safety issues.
The property described by Item 18_ contains many acres of
wetlands known as the Northef~ "Savannas. Care should be taken
to mi~imize the impacts of any ~ development on this
environme)~tally sensitive area.
The property described by Item 20 is located on the border of
Indian River County and is near the interface 'of the St. Johns
River Water Management District' and South Florida Water
Management District. Since a development of such size in this
location may have far reaching impacts, it is recommended that
the land use amen.dment not be approved until both St. Lucie
County and Indian River County agree that such an action would
not adversely affect the ability of either c6unty to realize
growth management and planning objectives. A primary concern is
the relationship of the project with the existing
uroan/agricultural boundary. Development of the property as
residential may create compatibility problems with existing
agricultural development. Prior to considering any change in
land use, the County should carefully consider its long range
plans for this area, provision of infrastructure a~d services,
and the impacts of residential development on agricultural
activities in the area. Additionally, a project of the size of
this proposal would be a D.R.I. Final consideration of the
proposed land use change should, perhaps, wait until a report
and reco~,~nendations can be developed that evaluate regional
issues.

Council should adopt the comments~ outlined above wit~ respect to the Land
Use Element and approve their transmittal to the State Department of
Community Affairs in fulfillment of the requirements of Chapter 163,
Florida Statutes.

On Thursday, Oune 24, 1986, the St. Lucie County Local Planniog
Agency held a public hearing on Petitions Number 7, 12, and 17 of the.
attached agenda. These hearings were held in accordance to statutory
requirements in effect prior to Ouly l, 1986. On August 7, 1986,
St. Lucia County Board of County Commissioners certified that the
Local Planning Agency did in fact hold this heari'ng.
On Thursday, August 7, 1986, the St. Lucie County Board of County
Commissioners held a public hearing pursuant to Chapter 163.3184 (l~)
Florida Statute, for the purpose of transmitting the balance of the
attached agenda to the State Land Planning Agency for review. TheSe
amendments are scheduled to be presented to the St. Lucia County Loc~

SUBJECT: Revisions to Chapter 163.3184, Florida Statutes -
Adoption of Comprehensive Plan, or Element or
Portion thereof
At the recent regular session of the Florida Legislaturew
Senate Bill 978, which amended several sections of the Local
Government Comprehensive Planning and Land Development Regulation
Act (also known as Chapter 163, Florida StatUtes) was passed and
signed into law. One of the many amendments to this Act dealt
with the procedures to be followed for amending a Local
Government's Comprehensive Plan. Under the previous statute, the
board of county commissioners, only had to certify that the Local
Planning Agency held a public hearing on the proposed
comprehensive plan, element, or portion thereof prio{ to its
transmittal to the State Land Planning Agency for review. Under
the new law, the board of county commissioners is required t~
hold a public hearing on the proposed plan or plan amendment
prior to the transmitting of that plan or amendment to the State
Land Planning Agency for review.
On July 24, 1986, Rhoda P. Glasco, an attorney for the State
of Florida Department of Community Affairs opined that the County
must follow the procedures as amended by Chapter 86-191, Laws of
Florida, even though all of the petitions were filed before tke
or regulations must be amended.

July 1, 1986, effective date. A copy of Ms. Glasco's letter is
attached to this memorandum. Apparently, the Department of
Community Affairs is taking the position that the date of
advertising determines whether the new law applies.
In view of Ms. Glasco's July 24, 1986 opinion, I recommend
that the Board immediately schedule a transmittal hearing(s) so
that the July amendments~maY be transmitted to the Department of
Community Affairs as soon as possible. Since the Board had no
meeting scheduled for July 29 (Fifth Tuesday), staff, after
discussions with the Board Chairman, scheduled the transmittal
hearing for Thursday August 7, 1986, at 5:30 p.m. By copy of
this memorandum to the County Administrator, I am requesting that
he-place this item on the August 5, 1986 agenda for "after the
fact" permission to advertise.
. . The Development Coordinator and I will continue to review
the amendments to this act and hope to present to you in the near
future a summary report on what, if any, present county policies

Dear Mr. McIntyre:
You requested over the telephone, an opinion as to whether
the procedures in section 163.3184 as amended by Chapter 86-191,
Laws of Florida, are applicable to your current local
comprehensive plan amendments. You stated that yqur notice for a
public hearing by the local planning agency was advertised on
July 2, 1986, with hearings scheduled on July 23rd and 24th.
It is my opinion that the County must follow the
procedures as amended by Chapter 86-191, Laws of Florida, and
effective July 1, 1986. Therefore,~ the local governing body will
be required to hold at least two public hearings, the first Which
must be held at the transmittal stage (See Section 9, Chapter
86-191, Laws of Florida). The second public hearing must be held
at the adoption stage.
As stated to you, the local planning agency must still
hold at least one public hearing with due notice pursuant to s.
163.3174(4)(a), prior to making a recommendation to the governing
body. There is no longer the requirement that ~he local"
governing body determine that the LPA held a public hearing with
due public notice prior to transmittal.
The Department will make every effort to expedite the
review and comment once the amendments are received. Should you
have ~any additional questions or concerns, please contact Dana

STAFF COMMENTS:
The subject property is located on North U.S. #!, approxi-
mately ¼ mile north of Indrio Road~ The property runs
from U.S. #1 to Old Dixie Highway. The Petitioner is
proposing to extend the Commercial Land Use Classification
from its present depth of approximately 225 feet to take
in all of this site. Along U.S. ~1 in this area are several
scattered businesses.
As some members of this Commission/Agency may recall,
during the Comprehensive Rezoning of.St. Lucie County
in 1984, it was recommended by Staff that significant
portions of the commercial property along U.S. #1 be recla: si-
fled to a residential designation. This proposal was
based on cohcerns over the sensitive environmental lands
west of U.S. #1 and the relatively shallow building areas
east of U.S. #1 before the land dropped off to Old Dixie
Highway. Both this Commission/Agency and the Board of
County Commissioners saw merit to what was proposed.
However, both bodies agreed that at least the frontage
for average depth of 200 feet along U.S. #1 should remain
commercial. Several members of the various Boards indicated
that they could accept some extension of commercial property
to Old Dixie Highway but only at the intersection of major
roadways (i.e. Indrio Road).
At this time, County Staff cannot support this petition
for the following reasons:

1. When developed in 1981, the St. Lucie County Growth
Management Policy Plan specifically indicated that there
should not be any commercial land use or zoning along
Old Dixie Highway, North of St. Lucie boulevard. This
position was reaffirmed again in 1984 by the Board of
County Commissioners declining to extend commercial zoning
or land use beyond a point appoximately 200 feet east
of the east right-of-way line of North U.S. #1.
2. The proposed petition does not meet the commercial
location requirements identified in the Growth Management
Policy Plan.
Attorney Bruce Abernethy addressed the Board on behalf of the petitionsr
Dorothy L. Foster and stated she wanted her entire parcel to be brought
under one classification, either CG or CH, which he understood from
Staff was essentially the same for purposes of the plan. He referred
to Policy #43 in the GMPP in support of his client's petition, which
dealt with highway commercial development. He stated there was a
buffer on the east end of the property which would isolate the property
from the RS-2 zoned area on the east, being Old Dixie Highway and
the FED Railroad. He did not feel the savannahs on the W~st side
of U.S. #1 would be an environmental problem as his client's proper~y
was located on the east side of U.S. ~1. He also stated there would
be no problem with the drop off of the property exposed to the south.
His client was also willing to come up with a solution to prevent
access to her property from Old Dixie Highway, as there had been
some concern about that. In conclusion, he asked the Agency to conSider
his client's request to amend the GMPP to make either the entire
tract classified as CG or CH or all but the eastern one foot. He
stated he would like to reserve time for rebuttal, if necessary.
Mrs. Fawsett asked Mr. Abernethy how much of a buffer his client
would leave. He replied that legally only one foot was required.
Mr. William J. Neale, attorney from Melbourne~was present on behalf
of his mother Beatrice Neale who owned property immediately south
of the subject property. He stated that they were strongly in favor
of this petition.
There was no opposition to this petition.
Mr. Sciturro then closed the public portion of the hearing.
A motion was made by Mr. Carman to approve the petition. The motion
was seconded by Mr. Wetherington and upon roll call the motion was
unanimously approved by the Board.
