Request of Bob Constantine
Attached is a copy off some documents provided to me by Bob Constantine. Mr
Constantine's concern is that the maps attached to the 19-92 agenda package reflect
that the parcel which ~;s the subject of Resolution No. 92-006 is landlocked.
According to Mr. Constantine' this problem was supposed to have been resolved in

2 and the maps corrected to reflect that the subject property had access to North
53 Street, Please review your files and let me know if you find anything on this issue.

Phone Mr. & Mrs. Edward J. Bernard regarding the right-
of-way status of the missing 35' for N. 53rd Street.
Mrs. Bernard stated that they have spoken with Mrs.
Hamilton, stating that the elder. Mrs. Hamilton and one of
the sons had passed away and that they could not sign any
documents for at-least 15 years, as there is a problem
with the probate.
She stated that Mrs. Hamilton would be more than happy to
Deed over the missing 35' to the Bernards via St. Lucie
County for the road frontage if they could.
The Bernards' will bring in their surveys and Warranty
Deed for our review to see if their may be a mistake an
our assessment map.
January 3, 1992
Mr. & Mrs. Bernard visited office, brought in a copy of
survey, Warranty Deed and Title Policy. Everything
appears that all the Deeds lessed out the 25' from the
Legal Description leaving the Bernards' landlocked.
They are to re-contact the Hamilton's so that this
portion can be deeded to them and contact Commonwealth
Land Title f/k/a Abstract and Title Company.

The right-of-way needs determination is needed in our office by
January 10, 1992 for submission to Planning and Zoning for their
deadline of January 13, 1992.
According to the Assessment Map the property owner does not have
any county road frontage on N. 53rd Street. The property owned by
Mr. Bernard is completely surrounded by the property owned by the
Hamiltons'. According to the Plat to the East of the property the
35' for N. 53rd Street was dedicated to the Public by virtue of
platting. On November 25, 1985, a letter was sent to Mrs. Hamilton
asking for the dedication of the remaining 35' for N. 53rd Street
with a rejection response.

Pursuant to the recent petition filed for mobile home appoval on
the above referenced property, Engineering's determination for
ultimate right-of-way needs in this area is 60' per the
Comprehensive Thoroughfare Network Plan. Currently there is 35' of
right-of-way in this area, therefore being deficient 25' However,
reasonable connection cannot be made between the dedication and the
anticipated need for right-of-way created by the mobile home
application.

Certificate of Capacity.
The petitioner, Edward J. Bernard, is requesting authoriza~il~n
to install a mobile home meeting the definition of a Class A Mobi].e
Home as set forth in Section 2.00.00 of the St. Lucie County Laird
Development Code. The Class A Mobile Home will replace a mobi].e
home that was placed on the property in 1969 and has been report~d
to have reached the limits of its useful life.
The proposed new dwelling unit will be located on a 2.33 acute
parcel, with a setback of approximately 557 feet from 53rd Stre~t
right-of-way. As can be seen from the attached property descripti~)n
maps, this parcel does not have a contiguous property with
North 53rd street right-of~way- The right-of-way in this area is
substandard. Under normal conditions such an issue of substandamd
right-of-way would be addressed through the required dedication Df
the deficient area. However, since the subject propert-y does not
have direct access to North 53rd Street such a dedication is not
practical and is not recommended as a matter of this petition s
review.
In order to bring North 53rd Street up to minimum Coun ~y
design codes, the surrounding property owner would have to convey
to the County the necessary right-of-way. In 1985 this Board
directed that inquiries be made as to the willingness of the
adjacent property to accommodate such a dedittti~n- ~t tha~
the request was declined. There have beenno ezIor~s a~ acquxsl~on
since that time.
The County staff has reviewed the application and determined
the proposed residential unit complies with the Standards
Review of a Class A Mobile Home as set out in Section 11.05. D)
of the St. Lucie County Land Development Code.
Attached you will find a copy of draft Resolution 92-0t~6,
which would grant approval to this requested Class A determinati~n.

WHEREAS, the Board of County Commissioners of
County, Florida, has made the following determinations:

On January 28, 1992, this Board held a public hearing

WHEREAS, the Board of County Commissioners of St. LuciE
County, Florida, has made the following determinations:
1. The Board held a public hearing on April 1, 1986, afte
first publishing a notice of that hearing in the News Tribune a'
Fort Pierce, Florida, on March 14, 1986, on closing, vacating
and abandoning that portion of the following described publi
road (N. 53rd Street) and renouncing and disclaiming any right o

COMMENTS:
The petitioner, Edward J. Bernard, is requesting authorizat
to install a mobile home meeting the definition of a Class A Mob:
Home as set forth in Section 2.00.00 of the St. Lucie County L~
Development Code. The Class A Mobile Home will replace a mob~
home that was placed on the property in 1969 and has been repot'
to have reached the limits of its useful life.
The proposed new dwelling unit will be located on a 2.33 a
parcel, with a setback of approximately 557 feet from 53rd Str
right-of-way. As can be seen from the attached property descript
maps, this parcel does not have a contiguous property with
North 53rd street right-of-way. The right-of-way in this area
substandard. Under normal conditions such an issue of substand
right-of-way would be addressed through the required dedication
the deficient area. However, since the subject property does
have direct access to North 53rd Street such a dedication is
practical and is not recommended as a matter of this petiti¢
review.
In order to bring North 53rd Street up to minimum Cou
design codes, the surrounding property owner would have to con
to the County the necessary right-of-way. In 1985 this Bc
directed that inquiries be made as to the willingness of
adjacent property to accommodate such a dedication. At that ti
the request was declined. There have been no efforts at acquisi~
since that time.
The County staff has reviewed the application and determJ
the proposed residential unit complies with the Standards
Review of a Class A Mobile Home as set out in Section 11.05.02
of the St. Lucie County Land Development Code.
