In compliance with the provisions of the St. Lucie County Zoning
Ordinance you are hereby advised that the City of Ft. Pierce, by
Agent: John T. Brennan, City Attorney, has petitioned the Board
of County Commissioners for a change in zoning from U (Utilities)
to IL (Industrial, Light) zoning for the following described
property:
(SEE ATTACHED LEGAL DESCRIPTION)
(Location: On Hammond Road, 1/2 mile north of St. Lucie Blvd.)
The Board of County Commissioners will hold a public hearing on
this petition at 1:30 P.M. on Tuesday, June 23, 1987 in Room 101,
St. Lucie County Administration Building, 2300 Virginia Avenue,
Fort Pierce, Florida. All interested persons will be given an
opportunity to be heard at that time. The petitioner wishes the
property rezoned for possible future sale or development.
Please note that all proceedings before the Board of County
Commissioners of St. Lucie County, Florida, are electronically

PUBLIC HEARING:
Petition of City of Ft. Pierce (by Agent, John T. Brennan, City
Attorney) for a change in zoning from U (Utilities) to IL (Indus-
trial, Light) zoning for property located on the west side of
Hammond Road, opposite the new Air Traffic Control Tower at St.
Lucie County International Airport.
Mr. John T. Brennan, City Attorney, presented the petition. In
addition, he mentioned that City Manager, Frank Blackwell and
Community Development Director for the City of Ft. Pierce, Doug
Ballard were in the audience should the Board wish to question
them. He explained that previous to the 1984 comprehensive
rezonings, the subject property was zoned Industrial and its
former use was a sanitary landfill. The property has adequate
drainage.
In response to Mr. Carman's questioning, Mr. Brennan informed the
Board that this property would fall under DER regulations.
Chairman Terpening asked for public comment in favor of the
petition. There were none.
Mrs. Betty Selph asked Mr. Brennan what the City planned to do
with the property. Mr. Brennan responded that the City hoped to
sell the property, and explained that it is located across from
the airport tower.
There being no further public comments in favor of or in
oPPosition to the petition, Chairman Terpening closed the public
portion of the hearing.
Representing Staff, Mr. Murphy explained to the Board that,the
property was designated under Utilities zoning because of its
proximity to the airport and its former use as a landfill. Staff
had no objection, but cautioned that Industrial uses may nqt'be
the best use for an abandoned landfill area.
After considering the testimony presented during the pUblic hear-
ing including Staff comments and the standards of review )se:t out
in Section 5.3.300 of the St. Lucie County Zoning Ordinanc~, Mr.
Carman made a motion that the Planning and Zoning Commission
recommend that the Board of County Commissioners grant the peti-
tion of the City of Ft. Pierce for a change in zoning from b
(Utilities) to IL (Industrial, Light) zoning. Mrs. King seConded
-the motion, and upon roll call, the Board voted unanimously in
favor of the motion. Chairman Terpening informed the petitioner
that the petition Would be forwarded to the Board of County
Commissioners with a recommendation of approval.

Notice of all pUblic hearings which are required by a
of this Ordinance shall be given as follows, unless
stated otherwise:

in the dffice of the Development Coordinator during

Mailing notice to specific real property owners shall be

Five (5) Percent of Land

5.l.100(2)(a), in the case of a public hearing
regarding an amendment to the Official Zoning Atlas
that applies to less than five (5) percent of the
land in the unincorporated area of the County,
applications for Planned 'Unit Developments,
applications for conditional use approval,
applications for variances, and applications
reque'sting a Class A Mobile Home be defined as a
detac.hed single family dwelling uni t, notice shall
also be provided by the Development Coordinator by
mail to all property owners who own real property
directly affected by the proposed action and whose
address is known by reference to the latest approved
ad valorem tax roll, and to all property owners who
own real property within five hundred (500) feet of
the property directly affected by the proposed
action whose address is known by reference to the
latest ad valorem tax rolls, not more than thirty
(30) days nor less than fifteen (15) days before the
date Of the hearing.

An amendment to' the Official Zoning Atlas or an
amendment to the fext of this Ordinance that affects
five (5) percent or more land in the County's juris-
diction does not require notice by mail.
(5) Posting of Notice
(a) The petitioner shall erect and conspicuouSly place
upon the subject property at least one notice which
shall contain the following information:
(i) Present zoning and requested rezoning classifi-
cation; and
(ii) ,Dates of scheduled hearings.
(b) The petitioner shall also provide an affidavit
sign~d by the petitioner and notarized stating that
the ~otice was posted at the initiation of the
adver~ising period. Failure to maintain a conspic-
uous notice on the property shall not affect any
chang~ or amendment of said Zoning Ordinance.
Section 5.1.200 H~aring Procedures
(1) Setting the Hearing
When the Development Coordinator determines that an appli-
cation for~n amendment to the Official Zoning Atlas, an
- application' for an amendment to the text of this Or-
dinance, an ,application for a Planned Unit Development, an
application ifor conditional use approval, an application
for a major adjustment to a co~ditional use, an
application irequesting a Class A Mobile Home be defined as
a detached ~ingle-family dwelling unit, or an applicatic~
for a vari~nce is completed, or that a petition for an
administrati~e appeal has been filed, he shall notify the
appropriate I decision making bOdy so a public hearing may
be set and hotice given in accordance with the provisions
of this Ordihance.
(2) Examination and Copying of Application and Other Documents
Any time after the provision of notice, as required by
this Ordina~ce in Section 5.1.100, any person, upon
reasonable tequest, may examine the application or
petition in question, and the material submitted in
support or opposition to the application or petition in
the Office qf the Development Coordinator during regular

Dear Weldon:
The City or Fort Pierce owns 70+ acres on Hammond Road near the
county airport.
Not too long ago, the City discovered that this property had been
zoned utilities (U) rather than light industrial (IL), and I have
verified that under the comprehensive plan this property would be
considered for IL uses. The City has instructed me to proceed
to have the zoning changed back to IL and I have prepared a Petition,
a copy of which is enclosed with this letter, and will ,be filing
this on behalf of the City.
I am writing this letter to request that the County waive the $300

Ordinance, you are hereby advised that the City of Ft. Pierce, by
Agent: John T. Brennan, City Attorney, has petitioned the Plan-
ning and Zoning Commission for a change in zoning from U (Utili-
ties) to IL (Industrial, Light) zoning for the following
described property:

(Location: On Hammond Road, 1/2 mile north of St. Lucie Blvd.)
The first public hearing on the petition will be held at 7:00
P.M. on Thursday, May 28, 1987, in Room 101, St. Lucie County
Administration Building, 2300 Virginia Avenue, Fort Pierce,
Florida. All interested persons will be given an opportunity to
be heard at that time.

Dear Weldon:
The City of Fort Pierce owns 70+ acres on Hammond Road near the
county airport.
Not too long ago, the City discovered that this property had been
zoned utilities (U) rather than light industrial (IL), and I have
verified that under the comprehensive plan this property would be
considered for IL uses. The City has instructed me to proceed
to have the zoning changed back to IL and I have prepared a Petition,
a copy of which is enclosed with this letter, and will be filing
this on behalf of the City.
