Butch, Joseph S. Butch, and Lena Butch for a Change in Zoning from AR-1 (Agricultural, Residential - 1 du/ac) to IL (Industrial Light). ..... On Tuesday, December_l, 1987, you will be asked to review a petition on behalf of Selby R. Butch, et al, for a change in zoning from AR-1 to IL for property located along the west side of South Kings Highway, approximately 1300 feet south of Orange Avenue. The intended use of this property is as an industrial park, with most probable uses being warehouse and storage activities. Please note, that since this petition was initially filed with the~County, property ownership has transferred %o Mr. Robert Spain. However, since this petition was accepted under the heading referenced in the SUBJECT portion of this memorandum, the Butch's name is being maintained for consistency purposes. On Tuesday, November 10, 1987, this petition was presented to the St. Lucie County Planning and Zoning Commission for review and recommendation. At that hearing, comment was offered requesting approval of this petition citing this properties proximity to the interchanges of 1-95 and the Florida Turnpike and the fact that other properties in this area are designated for industrial use. In reviewing this petition, and as indicated in our review comments to the Planning and Zoning Commission, staff generally agrees that the designation of this property for residential development at a density of one unit to the acre may not be the highest and best use of this property. However, from a land planning point of view, we cannot confine our review to the issue November 24, 1987 Page 2 Petition: Burch, S. et al, File No.: RZ-87~026 of "hig:hest and best use." It is generally agreed that in most cases commercial/industrial property will offer a greater "higher and best use" value than residential property. But in reviewing this particular petition request, we must question whether industrial development is the best use for this particular area. In studying this area, beyond the bounds of the petitioned property, it is commonly acknowledged that the Kings Highway corridor is, and will continue to be, a major traffic corridor for this region of the County. However, we also note, that at the present time, there is little nonresidential/nonagricultural development in this area, except for limited citrus related activities and the Ft. Pierce Jai-Alai Fronton, a sport/recreation facility. The properties immediately ad3acent to this tract are designated for medium intensity (11 du/ac) residential development or are a part of the University of Florida Agricultural Research Farm facility. In our opinion the introduction of additional industrial property in this area is not necessary and could constitute a spot application of incompatible land uses. Following a public hearing on this petition, the St. Lucie County Planning and Zoning Commission voted 7 to 1, to recommend approval of this petition, through the attached Draft Resolution #87-236. In addition to Draft Resolution #87-236, please find attached copies of our original staff report to the Planning and Zoning Commission on this petition, as well as the minutes of that meeting. November 2, ±987 Page 4 Petition: Burcn, S.R., et al File No.: RZ-87-026 COMMENTS The subject property is locateO approximately 1300 feet south of the intersection of Orange Avenue ano Kings Highway. Staff acknowledges that these two roadways are among the most heavily traveled in this part of the County. If this fact alone was considereo, then Industrial 0evelopment Policy #46 would be sufficient reason to grant approval to this petition. However, staff does not agree tnat because the property happens to nave frontage onto a major roadway, it should automatically be reclassified t'o in0ustrial/commercial development. One of the basic premises of the St. Lucie County Growth Management Policy Plan is to support a logical and efficient development pattern for the County. Our community is an automooi!e orientate0 community. As such, nigher intensity uses of land should De locate0 at points of nighest access. Staff recognizes that the Kings Highway CorriOor is a major north/south route for the County. We further recognize that the best use of this property may not De as single family residential. However, when surrounding land uses are taken into account, is industrial development the best use for this property. To further support the position--of a gradient development pattern at major intersections within the County, is the plan for the Interchange Area of 1-95 and Orange Avenue (Reference page 54 - GMPR). Although tnis property is outsioe of the immediate area inoicateo by tnis plan, through interpolation of tne logical extension of these areas, it can De inferred that the petitioned property woulo be in a MeOium to Low intensity oevelopment areas. In staff's opinion, this woulO not be compatible with industrial development. As indicated above, there presently exist approximately 300 acres of vacant industrially designated property in this immediate area. Along the Kings Highway corridor, in the past 18 monthS, 180 acres has been added to this industrial inventory, along ~itn current pending applications for an additional 100 acres. The continued speculative reclassification of property along this roadway could result in the complete development of this roadway as a linear industrial/commercial development. If this is ultimately the intention of the community, staff recommends careful objective consideration over the long term service demands of this type development pattern, in addition to subjective questions of aesthetic appeal. The reclassification of this property into industrial uses would in our opinion be contrary to the spirit and intent of the St. Lucie County Growth Management Policy Plan. Staff recommends that this Commission vote to recommend denial of this Resolution, c'iting the reasons and standards contained in this memorandum. Mr. Robert M. Lloyd, Esquire, presented the petition. He chose to incorporate his comments from the previous Petition (including the advisement that the property had been sold to Robert ~. Spain.) Regarding Staff comments, Mr. Murphy said that Staff chose to incorporate comments Staff's comments from the previous petition Staff recommended denial of the petition. ' Chairman Terpening then closed the public portion of the hearing~ After consideration of the Petitioner,s Presentation an4 Staff's comments, Mr. Carman made a motion that Resolution No. 87-236 be forwarded to the Board of County Commissioners with a recommenda- tion of approval for the reasons cited in the previous ~etition's motion. Mr. Sciturro seconded the motion. Upon roll call, Mr, Sciturro, Mr. Carman, Mrs. Ferrick, Mrs. King, Mrs. Allen, Mr. Russakis and Mr. Terpening voted in favor of the motion. Mrs. Fawsett voted against the motion. This resulted in seven votes in favor and one vote against the motion' Chairman Terpening informed the petitioner that the Petition will be forwarded to the Board of County Commissioners with a recommendation of approval. PeLH.XS~ September 14, 1987 ~'f'"~** Honorable Jim Minix Chairman Board of County Commissioners St. Lucie County 2300 Virginia Avenue Fort Pierce, Florida 33482-5652 Dear Mr. Minix: Pursuant to section 163.3184, Florida-Statutes, the Department of Community Affairs has reviewed the amendments proposed for the Growth Management Policy Plan for St. Lucie County. Our 'review indicated that the proposed amendments met the requirements of section 163.3177(6)(a), Florida Statutes, however, the amendments were not all internally consistent with the plan as required by section 163.3177(2), Florida Statutes. Amendment f, which proposes to change a semi-urban area to commercial tourist, does not appear to be internally consistent with urban growth,policies 34, 83 and 84, in that commercial uses should be located on arterial, roads or controlled access road- ways. Internal. consistency is required by section 163.3177(2), Florida Statutes. The proposed use for this property of a 700 unit recreational vehicle park exceeds the DRI threshold for this use. Comments from the Treasure Coast Regional Planning Council along with other review agencies are enclosed for your consideration and use. Evaluation The proposed amendments to the Future Land Use Element have been reviewed in accordance with the requirements of Chapter 163, Florida Statutes, Council's review procedures, and Council's adopted comprehensive plan. Based on the information provided, the proposed amendments do not appear to be )in conflict or inconsistent with the policies containea in the Regional Comprehensive Policy Plan. Prior to the approval of the land use changes associated with Items A and B), the appropriate analysis should be completed demonstrating that U.S. 1 has the available capacity to accomodate the additional highway trips. The analysis should also demonstrate that an ~acceptable level of service can be maintained on U.S. 1,at buildout of the area. Also, Indian River County has expressed concerns over increased strip commercial development along U.S. 1 (see attached letter). Prior to approving' the land use change associated with Item H, St. Lucie County should work with the City of Port St. Lucie and Martin County to assure that all multijurisdictional transpor- tation impacts are adequately addressed (see the attached letter County). A letter from the DNR is attached which expresses concerns over the~possible development of a marina on this parcel. The proposed 700 space Recreational Vehicle Park associated with Item F exceeds.the DRI threshold. The 100 percent DRI threshold is 5UO spaces~ Because of public objections to the proposed project (see a~tached letters) and because regional issues have not been identified, final consideration of the proposed land use change to Commercial Tourist should, perhaps, wait until a report and recommendations can be developed that evaluate regional issues. For Item F, so~e of the regional issues of concern are related to land use compatibility, the provision of services, and the impact on water resources. The proposed density of up to 9 units/acre may not be compatible with the surrounding agricultural land use. The 76.7 acre parcel does not seem large enough to allow this density and p~ovide adequa~e~ buffers from noise and pesticides associated with nearby agricultural activities. Regional concerns are also warranted with regard to water supply and sewage disposal. This is especially important when recreational vehicles are involved, because an overnight visitor to the park may leave behind several days worth of wastewater and take several days ~orth of fresh water when leaving. Finally, this site is very close to Tenmtle Creek which drains into the North Fork of theS: . Lucie River. Depending on the.design of the drainage syste~ and wastew~ter facilities, a development of this intensity may ))ave an adverse impact on the quality and quantity of water entel'lng the North Fork of the St. Lucie River and Aquatic Preserve.
