PUBLIC HEARING: Petition of Ralph and Eunice Bunting for a change~ in zoning-from RM-11 (Residential, Multi-Family - 11 du/ac) to I (Institutional) zoning located on the south side of Weatherbee Road, approxi- mately 300 feet east of Oleander Boulevard. Mr. Ralph Bunting presented the petition explaining that the subject property is located next door to a skating rink on Weatherbee Road. Mr. and Mrs. Bunting propose to construct ~ day care center at that location. Mr. Everett Maheuron, owner of the skating rink adjacent to the subject petitioned property, stated that he had no objection to ~he rezoning. Robert Schwerer, Esq., representing .a group of residents that ither own adjoining lands or live in close proximity, presented me Board with a petition signed by 52 area residents in opposi- ion to the petition. He said that the area has historically een residential, and that although the surrounding zoning is RM- 1, almost predominantly the surrounding properties are single amily homes. Mr. Schwerer's clients' concerns involved the use of the property eventually being for purposes other than a day are center. Mr. Schwerer said that the combination of a skating ink and a day care center would create noise and traffic that .be inconsistent with the surrounding residential character. pointed out that .76 acres would be difficult to buffer from . He also said that an Institutional zoning would lower the of surrounding residential properties. Mr. Schwerer stated hat Mr. Bunting purchased the subject property within the last or two and was aware of its RM-11 zoning. Ferrick asked Mr. Murphy if the subject propg~ty is in the y of the Julia Economy property, which wa§ recently zoned 1. Mr. Murphy replied that Parcel 22 was part of the Julia petition heard a year or so ago. Mrs. Ferrick clarified ihat the rest of the property is RM-11 also. Jim Everington, Mr. and Mrs. William Buyers, M. M. Richard- , and Don Knispel spoke in opposition to the petition.
