Dear Local Government Official:
Provisions for the amendment of local comprehensive
under Section 163.3187, Florida Statutes, Provide that Plan
amendments may be made no more than two times Per calendar
unless it is an allowed exception.
The 1986 Legislature amended these provisions to allow
governments to exempt "small sca~e development- amendments.

BACKGROUND:
K. Scott Brown, 'john T. Mirisola, and Thomas j. Wolley have
petitioned to amend the St. Lucie County Growth Management Policy
Plan, Ordinance No. 86'01 by changing the land use designation of.
the property located at the southeast corner of North 41st.
Street and Avenue I from RL (Low Density Residential) to IL
(Industrial, Light). On January 22, 1987, the Planning and
Zoning Commission voted 7-1 to recommend that the Board approve
the petition. Consistent with Board policy, staff-has drafted an
ordinance approving the proposed amendment.

On Tuesday, February 24, 1987, you will be asked to review a
petition on behalf of K. Scott Brown, et al;, for an amendment to
the Future Land Use Maps of the St. Lucie County Growth
Management Policy Plan from RL to IL. The purpose of this
amendment is to allow the petitioners to open and operate a pest
control business. The petitioners presently operate a pest
control business in Palm Beach County. On Thursday, Sanuary 22,
1987 the St. Lucie County Local Planning Agency voted 7 1 to
recommend approval of this petition. -
Attached for your review are copies of the original staff
report on this matter. By separate cover the County Attorney,s
office will be forwarding a Draft Ordinance granting approval to
this request. County staff has no objections to this request and
recommends its approval.
This amendment is being presented to you under the
requirements of Chapter 163.3187(1)(c), Florida Statutes and St.
Lucie County Resolution #86-171, Small Area Comprehensive Plan
Amendments. This petition, if approved, wOUld bring our annual
acreage total for small area amendments to .6 acres. Their
remains 29.4 acres of unincorporated area eligible for a Small
Area Comprehensive Plan Amendment Review.

your P&Z & LPA hearings held on January 22, 1987.
Therefore at this time let me stress the oposit~on of the
above named person to both the Plan Amendment & Re-Zoning.
For the following reasons:
The Plan Amendment is inconsistent with St. Lucie County's
Growth Management Plan.
Inconsistent with GMPP, Page 32, Industrial Development.~$~
Inconsistent with GMPP, Philosophy Page 14.

In Addition let me point out that 544 Acres is presently
Zoned Industrial, with only 2% of the Industrial zoning

Mr. Sciturro questioned if this property was utilized for a pest
control facility at one time, and were the ~etitioners trying to
bring it into compliance. Mr.-Brown answered affirmatively to
both questions.
There were no others present to speak in favor of the ~etition,
nor were there any present to speak in opposition of the
petition. Chairman Terpening closed the public portion of the
hearing.
Regarding Staff comments, Mr. Murphy explained that this petition
is being heard by the Local Planning Agency. It is presented
under the Small Area Amendment Guidelines of the State of
Florida. County Staff found the petition to be consistent with
the policies and objectives of the St. Lucie County GMPP, had no
objection, and recommended approval.
Mr. Sciturro asked Mr. Murphy about a past petition involving
39th St. and Avenue j (where someone had some old cars), which
petition was denied because the surrounding area was residential.
Mr. Sciturro questioned if there could be a problem of inconsis-
tency. Mr. Murphy recalled the Potter/Cleghorn petition of
December, 1986. He further explained that Staff does not feel
that there is an inconsistent position taken in this petition.
The Petition involved property that was further
into residential areas than the present petition.
Based upon that, Staff feels this petitio~ is an appropriate
req~u~es~, and recommends approval.
Finding that the proposed amendment does not conflict with public
interest in this area, and it is consistent with the GMPP, Mr.
Sciturro made a motion to recommend approval of ~his petition.
Mrs. King second,ed the motion, and upon roll call, Mrs.. Ferrick
voted against the motion, and Mrs. Fawsett, Mrs. Harris, Mrs.
King, and Messrs. Carmaa, Sciturro, Myers, and Terpening voted in
favor of the motion. The petition will be forwarded to the Board
of County Commissioners with a recommendation of approval, ~
finding it consistent with the GM. PP.
