'RZ-94-010 A RESOLUTION GRANTING A CHANGE IN ZONING FOR PROPERTY IN-ST. LUCIE COUNTY, FLORIDA WHEREAS, The Board of County Commissioners of St. Lucie County, Florida has made the following determinations: Cass·ns Land Enterprises, Inc. presented a petition, for a change in zoning fr~.AR-1 (Agricultural, ~sidential 1 du/ac) to AG-1 (Agridultural, 1 du/ac) for ~'~property described below. On April 21, 1994, the St. Lucie County Planning and Zoning Commission held a public hearing, of which due public notice was published in the Port St. Lucie News and mailed to all property owners within .500 feet at least 15 days prior to-the hearing, and recommended that this request for a change in zoning from AR-1 (Agricultural, Residential 1 du/ac) to AG-1 (Agricultural, 1 du/ac) be granted· On May 17, 1994, this Board held a public hearing on the petition after publishing a notice'of such hearing in the Port St.. Lucie News at least 15 days prior to the hearing, and notifying by mail all owners of property within 500 feet of the subject property. The proposed change in zoning is consistent with all elements of the St. Lucie County Comprehensive Plan and has satisfied the standards -of review as set forth in Section 11.06.03, St. Lucie County Land-Development Code. He stated the petitioner has requested that his property on the east side of Kings Highway, approximately one-half mile north of ~t. Lucie Blvd., be rezoned from AR-1 to AG-l, to make the property and the use the property conforming and to allow for rental of a portion of the existing building for agricultural services. He added that Mr. Cassens currently has an agricultural service building on the property that is not a conforming use in the AR-1 district. Mr. Kelly stated that the proposed amendment does not conflict with the Land Development Code, nor does it conflict with %~any~ element of the Compreheg~i~ve Plan. He added that there have been no changes in the area to bring about this ambndmen~-and staff does not anticipate any changes on the site. Staff recommends that this petition be forwarded to the Board of County Commi.~sioners with a recommendation of approval. Hearing no comments in favor or in opposition to the petition, Chairman Kle'm closed the public portion of the hearing.
