Green Publish: October 31~ 1978 PLANNING AND ZONING COMMISSION OCTOBER 26, 1978 PUBLIC HEARING: Petition of the Board of County Commissioners to amend the Comprehensive Zoning Resolutions for B-3, A-1 and Section 15-A Mining. Mr. Thomas presented the petition as follows: Item #1: This ms to allow for mini-warehouses On a very limited scale in B-3~ zoning. It. will also combine wholesale sales in B-3 which is presently.not permitted. Item~#2: . This is for the purpose of doing away with inequities in the ~current setbacks where~there is a conflict hetween..agrieul- tural uses in A-l.and other residential zoning districts. Item #4: This does nothing to change the regulations, but does change the method of handling mining applications. The County AttOrney felt it should be submitted to the Engineering Department. This simply allows the miner to go directly to the Engineering Department, who de~ermined.that it 'meets with all County requirements. We do not change any r~gulation with which the miner must conform. Mr.. Scott asked for questions from the Commission members. Mr. Davis asked why the change in B-3. Mr. Thomas stated that.it was because of the demand in B-3 for this type of mini-storage, possibly behind shopping centers. This is really to permit storage of small items such as excess 'furniture, etc. Mr. Moore asked that on a small strip shopping center could they do this w~thout coming back to the Board. Mr. Thomas explained that they would have to go Site Development Plan. On the plans for the shopping center, they would have to show the mini-warehouses, or they will: not be allowed. There will be the same screening of the warehouse section as there is of the shopping center It is allowed in B-4, but there is no equlrements for paving or landscaping, but there will be with them in B-$ because it will be a Site Development Plan. Motion by Mr. Gorhan and seconded by Mr. Ebner to recommend to the Board of County Commissioners approval of the petition. Motion was passed by a unanimous voice vote. The Planning and Zoning Commissioj will recommend to the Board of County CommissioBers approval of the petition. (E) Safeguards to prevent loose sand from blowing onto adjacent property. (F)Procedure to be used to identify boundary lines on site. (G) (Amended 4/16/75) Location, extent, and machinery/equipment to be used in any screening, crushing or processing operation for materials mined or excavated on the premises. Public Hearing Before Board of Count~ Commissioners The Board of County Commissioners shall hold a public hearing after due public notice and shall approve, modify, or deny the application for mining. In addition to considering reclamation plan and other requirements and conditions of Section 15-A necessary for permit, the Board will consider establishing a time period for beginning and completion of reclamation and ample secur- ity to cover reclamation. B. Following approval, the applicant should be advised he must file security with the County ~Attorney. C. After obtaining approval of security by the County Attorney, applicant pays mining permit fee and receives mining permit from Building and Zoning. D. 'Mining permits may be revoked by the Board of county Commis- sioners for failure to adhere to.these regulations. E. Owners of all existing mines shall, within six months of the adoption of these regulations, file a mining plan and post a completion bond, both acceptable to the Board of County Commissioners, whereupon a mining permit shall be issued. F. The above requirements will not apply where excavations are made solely for drainage purposes or other similar improve- ments and where.material from said excavations is not sold as a commercial business. Where excavations are made on publicly owned property or easements, the Board of County Commissmoners may authorize an exception from these require- ments. M E M O R-A N D 'U M TO: County Attorney FROM: County Administrator RE: PROPOSED AMENDMENTS TO COMPREHENSIVE ZONING RESOLUTION DATE: July 25, 1978 On July 25, 1978 our Board approved a series of recommendations to the Planning & Zoning Commission for modification of the following segments of the Comprehensive Zoning Resolution: (1) Agricultural Zoning - Include the criterion that any structure for the housing of livestock or fowl in A-1 zoning shall be setback a minimum of one hundred feet (100') from any property line, with all other require- ments governing fencing setbacks in agriculturally zoned areas and setbacks of agricultural structures to be eliminated. (2) Recreational vehicles park districts (R-5RV)-Rezone the following parks: Bryn Mawr, Road Runner, Bob Riget's travel trailer park on Hutchinson Island. (3) Mining Regulations - Amend the procedure in accordance with recommendations previously presented by you and the Director of Building & Zoning.
