HomeMy WebLinkAbout1972RESOLUTION NO. 72-135 WHEREAS, the St. Lucie County Planning and Zoning Commission after holding a public hearing on October 26, 1972, of which notice was published at least fifteen (15) days prior to said hearing, has recommended to the Board of County Commissioners of St. Lucie CoUnty that the following amendments to the Comprehensive Zoning Resolution for St. Lucie County be adopted, and WHEREAS, said Board of County~Commissi°ners held a public hear- ing on said recommendation on December 5, 1972, after first publishing a notice.of said hearing in the News Tribune published in Fort Pierce, Florida on the 20th day of November, 1972, said date being at least fifteen (15) days prior to the date of said hearing. No mining excavation below adjacent"road grade shall be permitted within 150 feet of the right-Qf-way line of public road or street or within a dimension from adjoi property as determined by the Board of County Commissi~ Said dimension shall be a minimum of 15 feet except wh( adjoining property is being used, or has been used, mining, or is owned by the person making application. Step 2. Public Hearing~, The Board of County Commissioners shall hold a public hearing after due public notice and ~shall approve modify or deny the application for mining. Step 3. Performance Securityt The applicant shall post with the County a sui performance bond or other security to assure that said will be completed as planned and approved. Step 4. Issuance of Permit. A mining permit will be issued by the Director Building and Zoning upon payment of a $50.00 permit fee. Mining permits may be extended by approval of the Board of County Commissioners. Mining permits may be revoked by the Board of County Com- missioners for failure to adhere to these Reghlations. Owners of all existing operating mines shall, within 6 months of the adoption of these Regulations, file a minin~ plan and post a completion bond, both acceptable to the Board of County Commissioners, whereupon a mining permit shall be issued. The above requirements will not apply where excavations are made solely for drainage purposes or other similar improvements and where material from said excavations is not sold as a commercial business. On March 9, 1972 the Planning and Zoning Commission held a public hearing on the Revised Official Zoning Atlas. The County Attorney explained the revised atlas does not change the zoning of any lands now shown on the Official Zoning Atlas, but is drawn to a m~ch larger scale so that more detail may be shown The Revised Atlas is also reproducible. . No one appeam~d at the p & Z Com. hearing although notice had appeared three times in the News Tribune, on Feb. 17, Feb. 27 and March 2, 1972. A block ad was used, 3~" x 6", to be sure it came to the attention of everyone reading the newspaper. During this period the Revised Atlas was in the Building and Zoning office available to anyone who wished to examine it. By a 4 to 1 VOte the p & Z Com. recommended to the Board of County Col~missioners that the Revised Official ZOning Atlas be approved. (The Commission member casting the dissenting VOte felt the public should have more time to examine the Atlas but the majority felt there had been sufficient notice and time for examination). Since March 9, the Revised Atlas has been in the office of the Building & Zoning Department, available to the public, and the hearing to be held at this time was duly advertised.
