WHEREAS, the Board of County Commissioners of St.
County, Florida, has made the following determinations:

1. Edgar A. Brown, Joseph E. Beale, Jr. and Jim Russakis,
presented a petition for a change' in zoning from AG
(Agricultural) to IX (Industrial, Extraction) for the property
described below.
2. The St~ Lucie County Planning and Zoning Commission,
held a Public hearing on the petition, after publishing notice at
least fifteen (15) days prior to the hearin~d
notifying

mail owners of property within five hundred feet (500') of the
subject property, and has recommended that the Board aoDrove the

petition on behalf of Edgar A. Brown, Joseph E. Beale, Jr. and
im Russakis, for a Change in zoning from AG to IX, for property
i~ocated on t~e east side of Trowbridge Road, approximately 1,300
feet south of Orange Avenue. The petitionBr is proposing to
establish an extractive operation on this site.

On wednesday, January 25, 1989, the St.
Planning and zoning Commission held a public hearing and voted
unanimously to recommend ~ of this petition.
c6unty staff has reviewed this petition and determined it to
be consistent with the General Land Use Policies of the St. Lucie
County Growth Management Policy Plan. County staff recommends
~ of the proposed change in zoning.
Attached, you will find a copy of the original staff report
on this matter and the minutes of the Planning and zoning
Commission/Local Planning Agency meeting. In addition, attached
you will find a copy of Draft Resolution No. 89-55, which would
grant approval to this requested change in zoning.

Regarding the Minutes of the November 9, 1988 Special Meeting of
the Local Planning Agency, Mr. Carman made a motion to approve
the subj.ect minutes. Mr. Pruitt seconded the motion, and upon
roll Call, the Board voted unanimously in favor of the motion
with the e. xce~tion of Mr. Flowers who had not arrived by roll
call.

Regarding the Minutes of the November 17, 1988 Special Meeting of
the Local Planning Agency, Mrs. King made a motion tO approve the
subject minutes. Mr. Skidmore seconded the motion, and upon roll

exception of Mr. Sciturro who was not present at that meeting,

property located on the east side of Trowbri~ge Road,

approximately ~300 ft. south of Orange Avenue.
Attorney Edward Becht presente~ the petition. He explained that
the subject property involves southern 34 acres of a 75 acre
tract. The intent is to use the Subject p~operty as fill for the
front acreage located on the southeast corner of the intersection
of Orange Avenue and Trowbridge Roa~. The front portion of the
property is intenaed for marketing. That proper~Y will be
presented before this Boar~ tomorrow night with a request for
land use change to IL. It is intended that some of the fill from
the subject property be used off-site; therefore, this requires
going through the rezoning prooeaure to IX (I~ndustriat,
Extraction).
In response to ~estioning by Mr. Flowers, Mr. Beoht said when
the fill is removed from the subject property a pona will most
likely be created. It may later be marketed as residential or
grove uses. If you take a pond out of a low area, you can create
residential homesites and provide someone with an opportunity to
write-off through depreciation of citrus groves, part of their
homes itc .....
Mr. Soiturro questionea how large the pona woula be aha how much
land will be left arouna the perimeter of-the pond? Mr. Bec'bt~
said that the intent is not to go into a large ~ning operation.
It will most likely be a short-term mine-that'-will be closed
within a year. He ooul~ only speculate on the size and depth of
the pond.
Regarding Staff Comments, Mr. Murphy said Staff found~ the request
generally consistent with the development policies Of the GMPP.
staff recommended approval of the petition, noting that should
the petition be ultimately approved by the Board of County~
Commissioners, prior to the commencing of any material removal or
any other mining activities all appropriate mining ~e~its must
be obtained.
After considering the testimony presented during the public
hearing, including Staff Comments, and the Standards of Review as
set in Section 5. 3. 300, St. Lucie County zoning ordinance, Mr.
Skidmore made a motion that the Planing and zoning Commission
recommend that the St. Lucie County Board of County Commissioners
grant approval to the petition of Edgar A. Bro~, Joseph E.
Beale, Jr. , and Jim Russakis for a change in zoning from AG
(Agricultural) to IX (Industrial, Extraction). Mrs. King
seconded the motion, and upon roll call, the Board unanimously
voted in favor of the motion.
Chairman Terpening informed the petitioners' agent that the
petition will be forwarded to the Board of County Commissioners
with a recommendation of approval.

it is your intention to seek the faster processing of the IX
portion of this petition, it Will be necessary fo~ a second,
separate application to be filed, if the IX applicakion.remains
with the IL application, this matter will not be resolved until
July 1989 at the earliest.
