Entrada The Planning and Zoning Commission held a public hearing on December 8, 197-7. Mr. Bailey was present on behalf of the petition. He that the rezoning request was for the purpose of better ut: tion of the property for a shopping complex. The B-4 re is so mini-warehouses can be erected on the back of the for storage, which could be utilized by residents of Spani Lakes, many of whom have no adequate place for storage. He ther stated that a Site Development Plan would be submitted this. lted Mr. Roger Byrd~ Mr. Samuel Garofa!o, and Ms. Clara Re raised objections to the request citing reasons of noise~ t congestion and uses in the B-3 and B-4 classifications that be very detrimental to the area. Upon questions from Commission membems~ it was determi that a rezoning to B-3 only would not cause as strenuous ob: tions from opponents; however, Mr. Byrd remained opposed to zoning classifications as he feels Mr. Ross's business will terfere with both his business and private life. Mr. Bailey stated that a rezoning to B-3 alone would be satisfactory to them; they had only intended to stay within letter of the law with this request. However, with a B-3 fication, he will be able to erect accessory structures. Comments of the County Development Coordinator were read the secretary. Moved by Mr. Tiernan~ seconded by Mr. Gotham, to recomme~ to the Board of County Commissioners that the property be rez~ to B-3 only. Mr. Byrd stated that he objects to both zonings, but is not as strongly agaln~t B-3 as B-4. He feels that this is not the place for either zoning because of traffic congestion and noise. Mr. MeIver asked Mr. Bailey is he would object to a recommendation by this Board that the reclassification be to B-3 zoning alone. Mr. Bailey stated that they would go along with that. He further stated that the idea had been to s within the letter of the law and comply with the Zoning Ordinance. COUNTY DEVELOPMENT COORDINATOR'S COMMENTS (1) Existing Land Use: Future Land Use: COMMENTS: BAILEY (A-1 to B-3 and B-4)- Vacant with a real estate office to the east adjacent to U. S. 1. Land to the north, south, and east is vacant. Scattered highway commercial development is occurring adjacent to U. S. 1 with low density residen- tial development to the west across U. S. 1. Highway commercial uses adjacent to U. S. 1 on the east with low/medium density residential development to the east of the proposed rezoning. The portion of the proposed rezoning to B-3 deepens existing shallow strip commercial zoning thus permitting better designed utilization of U. S. 1 frontage. However, the rezoning to B-4 is totally inconsistent with existing zoning and future land use plans for the area. The rezoning of such a small parcel to B-4 (27,000 square feet) could easily be construed as spot zoning.
