WHEREAS, St. Lucie County Planning and Zoning Commission, :~
after holding a Public hearing of which due notice was Published
at least fifteen (15) days prior to said hearing and all owners of
property within 300 feet were notified by mail of said hearing, ha
recommended to the Board of County Commissioners of St. Lucie Coun.
that the herei'nafter described requests for changes in zoning

WHEREAS, the Board of County Commissioners held a public
hearing on September 23, 1980, after ~ublishing a nOtice of said

Mr. Ben Bryan, Jr.,.~attorney for Petitioner, was present and stated
Store.purpose of this rezoning, is to be able to put in a Zippi Mart Convenie
The secretary read into the record the comments of Gary Ament, in
he stated in part, "The proposed rezoning is inconsistent with existing
use, existing zoning patterns, and future land use plans for the area."
Mr. Bryan then stated Mr Montgomery had spoken with people in the
neighborhood '
and they had no objection to this rezoning. He stated this
woUldstore, not be a big shopping center, hut merely a neighborhood convenience
Mr. Moore stated that the people residing in Lakewood Park have to
to Kings Highway for milk and bread and felt it would be good to have a
convenience store in there.
Mr. Davis stated 700 some odd feet is more than enough for a conveni~
store and this might open it up for a lot of things.
Mr. Ebner stated he felt it was too much B-3 and that it was too lar~
parcel for any type of convenience store.

Mr. William White, an adjacent property owner, stated he had no objec'
to this and that Mr. Montgomery had spoken to him about his plans. He ssi,
he would like to see the whole thing mn there·
Mr. James Oppedisano, also an adjacent property owner, asked what the~
are going to put in there besides the store, gas stations or what.
Chairwoman King stated Petitioner had said it would put in what the
neighbors desired or demanded.
Mr. Ebner asked Petitioner if he would be willing~to ~educe it all to
B-Z, to which he replied he would, but gas pumps would be needed.
Mr. Thomas stated this is a permitted use in B-2 zoning·
Moved by Mr. Ebner, to appmove the petition under the reduction to B-
zoning, and second by Mr. Moore. The motion passed by unanimous vote.
The Planning and Zoning Commission will recommend to the Board of
County Commissioners approval of this petition.

Existing Land Use: Vacant with citrus to the south and west and low density
residential development_across Indrio Road to the nor. th.
Future Land Use: Semi-urban.
COMMENTS:
The proposed rezoning is inconsistent with existing land use,
existing zoning patterns, and future land use plans for the area.
The proposed rezoning is only 200 feet deep and contains approximately
3.4 acres. Rezoning of such a tract to B-3 is inconsistent with
commercial development and location criteria of the proposed
Growth Management Plan.
In June, 1978, the Planning and Zoning~Commission recommended
denial for rezoning of a parcel to the east at the intersection
of King's Highway and Indrio Road to B-3. The County Commission
subsequently approved rezoning of this smaller parcel to the
east to B-1 rather than the requested B-3.
Rezoning of this parcel to B-3 should be considered premature
at this time. At such time as the Planning and Zoning Commission
recommendation for mandatory site plan review at the time of
rezoning ~;~ implemented, consideration of a rezoning such as this
might be appropriate.
