WHEREAS, the St. Lucie County Planning and Zonin¢
after holding a public 'hearing of Which 'due notice was publi
at least fifteen (15) days prior to said hearing and all
property within 300 feet were notified by mail of said hea
recommended~, to the Board of County Commissioners of St. Lucie
that the hereinafter described requests for changes in zoning

WHEREAS, the Board of County Commissioners held a public
on August 26, 1980 after publishing a notice of said hearing in:

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commi

PUBLIC HEARING:
Petition of Bill and Marlene Stewart, for a change in zoning el~ssi~
cation from A-1 (agriculture) and B-3 (arterial business) to B-4 (general
business) for property located on the west side of U. S #1 directly acre
from Torpey Road. ' '
Mr. Bill Stewart was present, and stated that the property had been
rezoned from B-3 to A-1 in order to obtain a mining permit, and that he we
now like to have the rezoning changed a~ain to B-4 for repair and sal~ of
farm and heavy equipment.
There was no opposition to the petition.
Mr. Ament's comments were read by ~he secretary.
Motion by Mr. Moore to deny the pe%ition.
Mr. Tiernan asked if Mr. Stewart could use a B-3 category, to
Mr. Thomas replied that the sale and display of this type of equi
first permitted in B-4; that B-3 prohibits anything first permitted
M~. Scott asked if he could use the present A-1 zoning, and Mr. Thoma
plied that no business is permitted in Afl zoning unless it is 100%
culturally oriented. Mr. Davis asked Mr. Stewart if he already had
property on U. S. #1 that was usable, to which Mr. Stewart replied th~
had been rezoned some 2 or 3 years ago.
Mr. Davis ~.~then offered a second to Mr. Moore's motion.
There was further discussion on using B-3
as Mr. Thomas pointed out, the sale and ~isplay zoning for Mr. Stewart

Mr. Moore Stated that he does not want to see 1200 feet of B-4

Mr. Stewart would consid%r some other le set zoning, to which Mm. Stew~
replied, not at the present time,, but wo' Id request it before the Boarc
County Commissioners if necessary. ·
The Board was polled with the foil, wing votes cast: Ayes: -.Mr. Gorhe
Mr. Tiernan, Mr. Skeffington, Mr. Moore, Mr. Davis, Mr. Scott and Mrs. Kin~
Nays: Mr. Ebner. The motion passed by a 7 to 1 vote.
The Planning and Zoning Commission will recommend denial of the petit
