WHEREAS, the St. Lucie County Planning and Zoning Commissi
after ho%ding a public hearing of which due notice was publish
at least fifteen (15) days prior to said he'ring and all prope
owners within 300 feet were notified by mail of said hearing
recommend to the Board of County Commissioners of St. Lucie
County that the hereinafter described request for a change in
Zoning classification be granted or denied.
WHEREAS, the Board of County Commissioners held a public hz
on October 18, 1977 after first publishing notice of said hee
in the News Tribune on October 3, 1977.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commi
sioners of St. Lucie County, Florida in meeting assembled this
day of October, 1977 as follows:

The purpose of rezoning is to obtain a mining permit. There was
no recommendation from the Planning-& Zoning Commission as both motions
to approve and deny failed to pass.
Mr. Stewart was present and explained his reasons for requesting
rezoning and outlined his mining plans which are discussed further under
the Public hearing for approving a mining plan. '
Moved by Com. McCain to adopt 'Resolution No. 77-125 which authorizes
a change in zoning from B-3 to A-i, was seconded by Com. Green, and-
upon roll call, unanimously carried.

The Planning & Zoning Commission held a public hearing on
September 22~ lg77.
No one was present to speak for or against the petition.
Mr. Scott stated that they should take action on the t
despite the fact that no one was present.
Mr. Thomas Stated that the ultimate aim of the petition is -
secure a mining permit for that property~ which has a ridge tha-

Mr. Davis stated that he would prefer to Bee the property go
back to A-1 zoning. Mr. Scott stated that he saw nothing wrong w'

Planner is in favor of' the rezoning; ands mn his estimation the
property could be either B-3 or A-1.
Mr. McIver raised concern over the proximity of the property
to U.S.#1. Mr. Thomas stated that the reclamation will prohibit
Mr. Stewart from mining below the level of the road. Mr. Stewart
plans to use the materials commercially and that is why he has to
have the zoning change. His plans are to rezone back to B-3 once
he has mined the property.
The vote was polled and the motion failed to pass: Ayes:
Mr. Skeffington ~ Mrs. King. Nays: Mr. Scott ~ Mr. Davis~ Mr.
Mr. Thomas stated that in his opinion~ the petition should
go to the Board of County Commissioners in this manner.

currently vacant with a restaurant to the south of the
proposed rezoning adjacent to U. S. 1 and medium dens'it9
residential development (mobile homes) also to the south

elopment, and vacant.
COMMENTS: The proposed rezoning to A-1 does not appear to be inconsist~
with existing land use in the area or future land use plans
