Please accePt my apology for not appearing at the public hearing
of July 6, 1971 on the petition of our client, Mr. Glen 31.ackburn,
for rezoning of certain lands in Section 17, Township 34 South,
Range 40 East and fronting on U. S. Highway No. 1. My a)sence
and the absence of Mr. Blackburn was not due to lack of Lnterest
on our part, but because of my miSunderstanding of when :he COm-
mission was to act on the petition.

Petition of Glen Blackburn for a change in zoning classification,
from B-3 (arterial business) to A-1 (agriculture), for the following
described property:
A strip of land approximately 170 ft. in depth on
the South side and 150 ft. on the North side,, fronting
on U. S. ~i Hwy., over and across the following
described property:
That portion of the S~ of the N~ of the SW~ Of SE~
of Section 17, Township 34 South,Range 40 East,
lying South of Indrio, unit 1, as per plat t~ereof
on file in Plat Book 5, at page 42 of the public
records of St. Lucie County, Florida, together with
that vacated portion of former State Road No.. 4 lying
East of the aforementioned property and West of the
West right-of-way line of State Road No. 5 (U- s. ~1
Hwy.) (see sketch attached)
The Plannding and Zoning Commission held a public hearinq on
this petition 'of May 27, 1971. Mr. Blackburn and his at~orney/~rt Lloyd
present. Mr. Lloyd said Mr. Blackburn is asking for A-1 zoning fo~ this
strip of land along U. S. ~1 so that it will be in the sa,me zoning class-
ification as the remainder of his property.. When this Nas been agcomplished
he proposes to go before the Board of Adjustment for a S~ecial Exception
which will permit him to mine sand from the entire tract~ which contains
about 14 acres. The property generally is higher th~n~'~the roadbed of
U. S. ~1, but it slopes Westward to the Savanna. Mr. Blackburn p~.ans
to m~ne the high area, then grade the entire property, and then de~elop
it for a purpose which was not stated.
Mr. Lloyd said Mr. Blackburn is aware that thei Bard of Ac
meLt will require an engineering plan for removing the Sahd and re~
proper slopes, but he has not secured this pending the action on hJ
petition for rezoning.
The County Attorney noted that if Mr. Blackburn wanted to
off the property with'out removing any sand he could do so without
change in zoning but, because he wants to remove sand and sell it,
needs A-1 zOning and a Special Exception.
The petition was opposed by Spencer Giblert, Atty, on beh~
of Robert Sweet on the premise that mining sand would resalt in th~
destruction of valuable land and adversely effect adjaCen~ propert~

Gibbons said she was undecided about the mining operation
