PUBLIC HEARING
petition of Robert Blahut for a-change in zoning
ification, from B-3 (arterial business) to B-2 (limited
for a tract of land at the ~ntersection of U. S. ~1 and
(see legal description and sketch of area attached).
The Planning and zoning commission held a public

he had not applied for R-2 zoning which is a classificat
for duplex structures, he replied he preferred B-2 and t

Mr. Tozour, adjacent property owner, opposed the petition
would prefer the property to be developed for business feels
the number of duplexes proposed woutd be too great for proper~y
available.
Mrs. Tozour told of children who lived-in Mr. ~ .ahut's~
building coming into the area of the Tozour swimming po)l, even
thoughit is fenced.
Bill Hearn, son-in-law to Mr. and Mrs. Tozour, onfirmed
the incidents of the children in the pool area and cal ed atten ~ion
to the lake on the Tozour property which could be dang~ ous for
children living in Mr. Blahut's property.
Mrs. Barbara Houston, adjacent property owner, in
opposition to the petition.
By a 4 to 3 vote the Planning and zoning Commission reco
to the Board of county commissioners that the petition denied
~ecause granting it would result in spot zoning in vie~ of the f
the highway frontage on both sides of U. S. ~1 is B-3.
Prior to the public hearings, notice of same ~s sent b~
first class mail to adjacent property owners, as liste on attached
sheet, below sketch.
On Jan. 14, 1972, following the public hearin held by ~he
P & Z Com. letter was received from Jacob & Barbara zi opposing
the petition.
On Jan. 17, 1972 letter received from Bill He~ with the
request that it be read at the public hearing held by the Board of
County commissioners. (Copy of the Hearn letter is ttached)

Dear Sirs:
Due to business committmentSI am unable to attend this commission
am writing this letter as .I wish to go on record opposing this req~
change.
Last night, January 13, 1972,'at 7:30, I attended the Zoning Boar~
spoke against the zoning change. I did so because, being John Toz
law, I verY often visit with the Tozours.at their home adjacent tc
property. The Tozour's 13 acre property includes their home whict
directly across the road from a house that Mr. Blahut purchased i~
Tozour home has a fensed swimming pool, and a large fish stocked
ducks, alligators and many other wild ~irds and animals which att~
people to their property. Since Mr. Blahut purchased this house
the~Tozours, he has used it to rent out to families with various
sf children. These children have many times become quite a haza~
of the Tozour home.
P.lease don't misunderStand, children are welcome'at the Tozours'
accompanied by theirparents, ~ut I am referring to the~constant
'unattended children wandering throughOut the neighborhood in sea~
to occuply their time. I have many times .seen small children crc
and come right into the pool and lake area of the Tozours properl
unnerving to Mrs. Tozour, who. must constantly be looking out for
who don't realize the danger of pools, lakes ~nd animals. '
If Mr. Blahut was granted this change,, the duplexes ~e proposes
extremely COnjest his property and very much add to the above me
