In offering this recommenoation of approval, this Agency determined that the proposed petition is consistent with the Policies and Objectives of .the St. Lucie County Growth Management Policy Plan. As required under Chapter 163, Florida Statutes, County Staff has transmitted this amendment request to the FloriOa Department of Community Affairs for interagency review. In comments received back from the Department, concern was expressed about the the status of this project as a potential Development of Regional Impact. It is the opinion of St. Lucie County Staff, that this amendment does not meet the requirements for Development of Regional Impact Review. On September 22, 1986, the Treasure Coast Regional Planning Council reported that this proposed amenOment did not conflict with any regional plan or policy. As of t~is date, my office has not received any return comments from the Department about this petition. Proposals to convert large tracts of agricultural lands to semi-urban uses (e.a.,)tem 20) are of Some concern, however, and should not be cons)dered prior to a comprehensive reevaluation of the County's goals and objectives for the entire area (see attached letter). Prior to the approval of the land use amendments, the proposed changes should be tested aaainst the St. Lucie County transportation model, to assure that the affected roadways can accommodate the more intens~ land uses. Hook Page two September 23, 1986 The property described by Item I is close to the sites of the Treasure Coast Square Mall and the proposed Vista Plantation development in Martin County. The ability of U.S. 1 to accommodate additional traffic generatPd by Item 1 must be ensured. Adequate right-of-way should be dedicated for future expansion of the roadway network prior to thP development of this parcel. Considering "the proximity of Item 16 to the St. Lucie County Airport, the current land use designation of Lioht Industrial may be more appropriate than the proposed ResiOential land use designation. Consideration should be given to plans for future expansion of the airport facilities and increased levels of air traffic, as well as noise and safety'issues. The property described by Item 18 contains many ~acres of wetlands known as the Nonthern Savannas. ~ Care should be taken to minimize the impacts of any development on this environmentally sensitivj area. The property d~scribed by Item 20 is located on the border of Indian River County and is near the interface of the St. Johns River Water ~ana~ement District and South Florida Water Management District~ Since a development of such size in this location may have far reaching impacts, it is recommended that the land use amendment not be approved until both St. Lucie County and Indian River County a~ree that Such an action would not adversely affect the ability of ~ither county to realize · growth management and planning objectives. A primary concern is the relationship of the project with the existing urban/agricultural boundary. Development of the property as residential may create compatibility problems with existing agricultural development. Prior to considerino any change in land use, the County Should carefully conside~ its long range plans for this area, provision of infrastructure and services,, and the impacts of residential development on agricultural activities in the area. Additionally, a project of the size of this proposal would be a DRI. The following comments were approved by Council for transmittal to the State Department of Community Affairs pursuant to Sections 163.3184(1)(c) and (2), Florida Statutes, for consideration by the County prior to adoption of thedocument. Evaluation The proposed amendments to the Land Use Element have been reviewed in accordance with the requirements of Chaoter 163, Florida Statutes, Council's review procedures,, and Council's adopted plans_ and policies. The following comments are offered as a result of that r~view. The proposed amendments are not in conflict or incbnsistent with adopted Council plans or policies. Proposals to convert large tracts of agricultural lands to semi-urban uses (e.a., Item 20) are of some concern, however, and should not be considered prior to a comprehensive reevaluation of the County's goals and objectives for the entire area (see attached letter). Prior to the approval of the land use amendments, the proposed changes should be tested aaainst the St. Lucie County transportation model, to assure that the affected roadways can accommodate the more intense land uses. Council supports the efforts of St. Lucie County a~d the School Board of S~. Lucie County (see the attached letter) in imoroving educational opportunities through the use of d~dications and impact fees as discussed in the amendment request. Mr. Ralph K. Hook Page two September 23, 1986 The property described by Item 1 is close to the sites of the Treasure Coast Square Mall and the proposed Vista Plantation development in Martin County. The ability of U.S. 1 to accommodate additional traffic generated by Item 1 must be ensured. Adequate right-of-way should be dedicated for future expansion of the roadway,-network prior to the development of this parcel. Considering the proximity of Item 16 to the St. Lucie County Airport, the current land use designation of LiQht Industrial may be more appropriate than the proposed Residential land use designation. Consideration should be given to'plans for future expansion of the airport facilities and increased levels of air traffic, as well as noise and safety issues. _~ The property described by Item 18 contains many acre~' of wetlands known as the Nor£hern Savannas. Care should be taken to minimize the impacts of any development on this environment'ally sensitive area. The property described by Item 20 is located on the border of Indian River County and is near the interface of the St. Johns River Water Management District and South Florida Water Management District. Since a development of such size in this location may have far reaching impacts, it is recommended that the land use amendment not be approved until both St. Lucie County and Indian River-County agree that such an action would not adversely affect the ability of ~ither county to realize growth management and planning objectives. A primary concern is the relationship of the project with the existing urban/agricultural boundary. Development of the property as residential may create compatibility problems with existing agricultural development. Prior to considering any chanoe in land use, the County should carefully consider its long range plans fo~ this area, provision of infrastructure and services, and the 'impacts of residential development on agricultural activities in the area. Additionally, a project of the size of this proposal would be a DRI. Final consideration of the proposed land use change should, perhaps, wait until a report and recommendations can be developed that evaluate regional issues. Mr. Ralph K. Abernethy, Jr.) to amend the Future Land Use Maps of the St. Lucie County Growth Management Policy Plan from AG (Agricultural Productive) to RL (-LOw Density Residential Development) located on the north side of Angle Road between 1-95 and'the Florida Turnpike (north of Canal C-25). Joe Martek, representing the petition, explained that the property encompasses 280 acres on which they propose to build 950 attached housing units, with seven units per building, all one level. He mentioned the natural borders of 1-95, the Florida Turnpike, and canals providing security. He listed some of the planned amenities. Chairman Terpening asked if anyone was present to speak in favor or in opposition of the petition. There were none. He then closed the public portion of the hearing. Mr. Murphy, representing Staff, related Dept. of~Community Affairs comments that local approval of the Martek project should be deferred until specific impact issues have been sufficiently resolved under the DRI impact process pursuant to Section 380.06, Florida Statutes. It should be noted that this project exceeds 80% of the 1,000 dwelling unit threshold for St~ Lucie County, therefore the applicant should contact DCA Bureau of Resource Management for guidance in the DRI process. Treasure Coast Regional Planning Council had no direct references to this petition. County Staff has no objection to the proposed peti- tion. Mr. Sciturro made a motion that this petition be approved finding it consistent with the GMPP. Mr. Carman seconded the motion, and upon roll call, the Board unanimously voted in favor of the motion. The pettion-will be forwarded to the Board of County Commissioners with a recommendation of approval finding it consistent with the GMPP. St. Lucie County has submitted proposed land use amendments to the State Department of Community Affairs, which in turn is seeking Council,s comments. ~ackground St. Lucie County is considering 20 amendment~s to the Future Land Use Map. Locations of the properties under consideration are shown on the ~ccom- partying map, and the number of acres and proposed changes in land use designations are summarized in the attached list. Council supports the efforts of St. 'Lucie County and the School Board of St. Lucie County (see the attached letter) in improving educational opportunities through the use of dedications and impact fees as discussed in the amendment request. The property described by Item 1 _~s close to the sites of the Treasure Coast Square Mall and the proposed Vista Plantation de~elopmen~ in Martin ~ County. The ability of U.S. 1 to accormnodate additional traffic generated by Item 1 must be ensured. Adequate right-of-way should be dedicateo for future expansion of the roadway network prior to the development of this parcel. MCIntyre, County Attorney 86-373 DATE: July 29, 1986 SUBJECT: Revisions to Chapter 163.3184, Florida Statutes - Adoption of Comprehensive Plan, or Element or Portion thereof At the recent regular session of the Florida Legislature, Senate Bill 978, which amended several sections of the Local Government Comprehensive Planning and Land Development Regulation Act_ (.also known as Chapter 163, Florida Statutes) was passed and signed into law. One of the many amendments to this Act dealt with the procedures to be followed for amending a Local Government,s comprehensive Plan. Under the previous statute, the board of County commissioners, only had to certify that the Local Planning Agency held a public hearing on the proposed comprehensive plan, element, or portion thereof prior to its transmittal to the State Land Planning Agency for review. Under the new law, the board of county commissioners is required to hold a public hearing on the proposed plan or plan amendment prior to the transmitting of that plan or amendment to the State Land Planning Agency for review. On July 24, 1986, Rhoda pl Glasco, an attorney for the State of Florida Department of Community Affairs opined that the County must follow_ the procedures as amended by Chapter 86-191, Laws of Florida, even tho~ugh all of the petitions were filed before the or regulations must be amended. this matter please let me know. July 1, 1986, effective date. A copy of Ms. Glasco's letter is attached to this memorandum. Apparently, the Department of Community Affairs is taking the position that the date of advertising determines whether the new law applies. In view of Ms. Glasco's July 24, 1986 opinion, I recommend that the Board immediately schedule a transmittal hearing(s) so that the July amendments may be transmitted to the Department of Community Affairs as soon as possible. Dear Mr. McIntyre: You requested over the telephone, an opinion as to whether the procedures in section 163.3184 as amended by Chapter 86-191, Laws of Florida, are applicable to your current local comprehensive plan amendments. You stated that your notice for a public hearing by the local planning agency was advertised on July 2, 1986, with hearings scheduled on July 23rd and 24th. It is my opinion that the County must follow the procedures as amended by Chapter 86-191, Laws of Florida, and effective July 1, 1986. Therefore, the local governing body will be required to hold at leas~ two public hearings, the first which must be held at the transmittal stage (See Section 9, Chapter 86-191, Laws of Florida). The second public hearing must be held at the adoption stage. As stated to you, the local planning agency must still hold at least one public hearing with due notice pursuant to s. 163.3174(4)(a), prior to making a recommendation to the governing body. There is no longer the requirement that the local governing body determine that the LPA held a public hearing with due public notice prior to transmittal. STAFF COMMENTS: The petitioner proposes to develop this site as a 950 unit Retirement Community. The property is presently in a reasonably natural state. It is not used for any agricultural activities. The proposed is below the numerical threshold for Development of Regional Impact. At this time, County Staff is not prepared to offer either a recommendation of approval or denial. We, at this time, defer a formal recommendation until the November hearings on this matter when it is anticipated that the developer will have his application for Planned Unit Development prepared for review. County Staff does not recommend this Agency table this matter. Rather, one of three actions would be appropriate at this time: approval denial forward with no recommendation. ' ' Joe Martek, president of H. F. Martek, Jr., Inc. was present along with his architect, engineer, staff attorney, contractor and mother. The proposed project was to construct a 950 unit retirement community. They plan to keep the area as natural as possible with no units facing each other. The property would be designed to offer everything a person would be looking for: security, clubhouse, swimming pools, tennis courts, shuffle board courts, automobile service area. An area for individual gardening plots would be set aside; community store would be owned and operated by the residents; a golf driving range and boat ramp would be available. He felt the project would be a tremendous asset to the Orange Blossom Mall. Mr. Terpening had a question about the project being below the numerical threshold for Development of Regional Impact. Mr. Murphy stated that we would not be required to get a binding letter from DRI. County Attorney McIntyre stated it would be up to the Agency whether or not to get a binding letter. Bill Shanley, one of the owners of Turn of the qentury M6bile Home park came forward and stated he was strongly in favor of this petition. His park was across the street from the proposed project. There was no opposition to this petition. Mr. Sciturro then closed the public portion of the hearing. Mr. Carman st.ated that he did not see where this project, even with 2000 residents, would have any impact on anything that would cause the County to have a regional study, because of the location of the proposed project.
