LIGHT); MAKING FINDINGS; PROVIDING FOR MAKING THE NECESSARY
CHANGES ON ~HE OFFICIAL ZONING MAP OF ST. LUCIE COUNTY;
PROVIDING FOR CONFLICTING PROVISIONS AND SEVERABILITY;
PROVIDING FOR FILING WI~H ~HE DEPARTMENT OF STATE AND
THE DEPARTMENT OF COMMUNITY AFFAIRS AND FOR AN
EFFECTIVE DATE AND ADOPTION.
WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. Bessie W. Minton, O.R. Minton, Sr. and Shirley Minton,
and Edwin J. and M~riel C. Minton presented a petition to amend
the future land use classification set forth in the St. Lucie
County Growth Management Policy Plan from SU (Semi Urban) to IL
(Industrial, Light) for the property described below.
2. The St. Lucie County Local Planning Agency, after
holding a public hearing on December 10, 1986 of which due notice
was published at least seven. (7) days prior to said hearing and
all owners of property within five hundred feet (500') were
notified by mail of said hearing, has recommended that the Board
amend the future land use classification set forth in the St.
Lucie County Growth Management Plan from SU (Semi Urban) to IL
(Industrial, Light) for the petitioned property in its entirety.
3. The Board held a public hearing on December 18, 1986,
after publishing a notice of such hearing in the Fort Pierce News
Tribune on December 9 and December 10, 1986.

Plan from SU (Semi Urban) to IL (Industrial
Light)
On Wednesday, December 18, 1986, you will be asked to
review a petition on behalf of Bessie W. Minton, et al, to amend
the Future Land Use Maps of the St. Lucie County GrOwth
Management Policy Plan from SU to IL. The petitioner is
proposing to ultimately develop this site as an Industrial Park.
This petition was presented to the St. Lucie County Local
Planning Agency for review on December 10, 1986, at which time,
this Agency voted 5 to 0 to recommend approval of this petition,
in its entirety. In offering this recommendation of approval,
this Agency determined that the proposed petition 'is consistent
with the Policies and Objectives of the St Lucie County Growth
Management Policy Plan. '
As required under Chapter 163, Florida Statutes, County
Staff has transmitted this amendment request to the Florida
Department of Community Affairs for interagency review. In
comments received back from the Department, specific reference is
made to this petition in which the Department recommends that any
approval action on this proposal be deferred until such time as
the petitioner has completed the Development of Regional Impact
review process identified in Chapter 380.06, Florida Statute. On
September 22, 1986, the Treasure Coast Regional Planning Council
reported that any action on this proposal shOuld include con-
sideration of any impact on the North Savannas Area in the
eastern 1/3 of this site.
Attached for your review is a copy of the original staff
comments on this petition transmitted to you on August 1, 1986,
and the most recent memorandum transmitted to the St. Lucie
December 15, 1986

Minton to amend the Future Land Use Maps of the

On August 7, 1986, the St. Lucie County Board of County
Commissioners held a public hearing for the purpose of
authorizing the transmittal ofthls petition to the Florida
Department of Community Affairs as required under Chapter
163.3184, Florida'.Statute. As of this date, my office has not
received any" return comments from theOepartment about this
petition. On September 22, 1986, the Treasure Coast Regional
Planning Council held a hearing on the proposed petition, and
reported that the proposal diO not conflict with any adopted
Council plans or policies.
At this transmittal hearing, the petitioner was requested
to amend their petition to exclude the area of NOrth Savannas
along the east half of this site. As of this date my office has
not receiveO any contact from the petitioner about this matter.
Therefore, County Staff recommends the following property be
excluded from any approval recommendation for th~s petition:
a.) The north 1/2 of the SW 1/2 of Section
17, Twp. 34 S, Range 40 E.
b.)The east 1/2 of the SW 1/2 os Section
17, Twp. 34 S, Range 40 E.
c.) The east 3000 feet of the west 3994 feet
(+-) of the north 1/2 of Section 20,

prepared to offer the following comments:
1. The subject property is located, at least in part,
within the area of potential acquisition fo~
development of the St Lucie County International
Airport. '
2. The proposed P~tition is generally consistent with the
goals and objectives of the St. Lucie County
International Airport Master Plan.
ApProximately the eastern 1/3 of this site contains an area,
of sensitive environmental lands known as the Northern Savannas. Duet
to this area's environmental importance, County Staff would,,
recommend that the petitioner provide a complete boundary survey of
this a.rea, including a minimum 75 foot upland buffer strip for the
purpose of deleting this' area from this petition. County Staff in no
way can support the requested petition, including this sensitive ares.

Staff would remind the petitioner that, .although this
petition was filed prior to the effective date of Ordinance 86-08, any
development'contemplated-for.thts Site must be done in accordance with

Our review indicated that the August ll, 1986, proposed plan
amendments were generally consistent with the statutory requirements
except as noted in the attached comments. The Department believes
the County should continue to monitor the cumulative impact of such
plan amendments to ensure the internal consistency of the adopted
Growth Management Policy Plan pursuant to s.163.3177(2), Florida
Statutes. Additional comments from the Treasure Coast Regional
Planning Council and the Indian River County Board of County
Commissioners have been attached for your review and possible use
during the comprehensive plan amendment process.
Once the adoption process is complete, the Department
requests a copy of the amended comprehensive plan as required by

Pursuant to the requirements of the Local Government Comprehensive Planning
and Land Develooment Regulation Act, Chapter 163, Florida Statutes, the
Treasure Coast Regional Planning Council reviewed the amendments to the St.
Lucie County land use element at its regular meeting on Sep'.~ember 22, 1986.
The following comments were approved by Council for transmittal to the
State Department of Community Affairs pursuant to Sections I63.3184{1)(c)
and (2), Florida Statutes, for consideration by the County prior to
adoption of the document.
Evaluation
The proposed amendments to the Land Use Element have been reviewed in
accordance with the requirements of Chapter 163, Florida Statutes,
Council's review procedures, and Council's adopted plans and policies. The
following comments are offered as a r~sult of that r~view.
The proposed amendments are not in conflict or inconsistent with
adopted Council plans or policies. Proposals to convert large
tracts of agricultural lands to semi-urban uses (e.g., Item 20)
are of some concern, however, and should not be considered prior
to a comprehensive reevaluation of the County's goals and
objectives for the enti,e area (see attached letter).
Prior to the approval of the land use amendments, the proposed
changes should be tested aaainst the St. Lucie County
transportation model, to assure that the affected roadways can
accommodate the more intens~ land uses.
Council supports the efforts of St. Lu¢ie County and the School
Board of St. Lucie County {see the attached letter) in imoroving
educational opportunities through-the use of d:dications and
impact fees as discussed in the amendment request.

The property described by Item 1 is close to the sites of the
Treasure Coast Square Mall and the proposed Vista Plantation
development in Martin County. The ability of U.S. 1 to
accommodate additional traffic generated by Item I must be
ensured. Adequate right-of-way should be dedicated for future
expansion of the roadway network prior to the develnpment of this
parcel.
Considering 'the proximity of Item 16 to the St. Lucie County
Airport, the current land use designation of Lioht Industrial may
be more appropriate than the proposed ResiUential land use
designation. Consideration should be given to plans for future
expansion of the airport facilities and increased levels of air
traffic, as well as noise and safety'issues.
The property described by Item 18 contains many ~'~acres of
wetlands known as the Northern Savannas. } Care should be taken
to minimize the impacts of any development on this
environmentally sensitiv~ area.
The property d~scribed by Item 20 is located on the border of
Indian River County and is near the interface of the St. Johns
River Water Management District and South Florida Water
Management District. Since a development of such size in this
location may have far reaching impacts, it is recommended that
the land use amendment not be approved until both St. Lucie
County and Indian River County aqree that such an action would
not adversely affect the ability of ~ither county to realize
growth management and planning objectives. A primary concern is
the relationship of the project with the existing
urban/agricultural boundary. Development of the property as
residential may create compatibility problems with existing
agricultural development. Prior to considering any chanoe in
land use, the County should carefully consider its long range
plans for this area, provision of infrastructure and services,,
and the impacts of residential development on agricultural
activities in the area. Additionally, a project of the size of
this proposal would be a DRI. Final consideration of the
proposed land use change should, perhaps, wait until a report
and recommendations can be developed that' evaluate regional
issues.

Indian River County staff has reviewed the petition of the
Strazzulla Brothers Company, Inc. and John B. Culverhouse etal to
amend the future land use maps of the St. Lucie County Growth
Management Policy Plan from AG (Agricultural) to-SU (Semi-Urban)
for the above referenced project. At this time '~taff's comments
are as follows: -'
I) The proposed project land use designation (SU Semi-Urban at
one unit per acre) is not compatible with Indian River
County's Land Use Plan (Agriculture at one unit per five
acres). The existing parcels in the surrounding area_ are
currently in agricultural production. Until such time that
the necessary urban services become available and th~
surrounding area infills with urban development, staff
believes that this project would create "leap-frog" develop-
ment and would be premature.
2) Staff has concerns regarding traffic impacts to local roads
entering into Indian River County that could result as the
project develops to its maximum buildout.capacity.
Please be advised that the Board of County Commissioners has not
considered these comments, however, upon direction from the
Treasure Coast Regional Planning Council, staff will present this
issue to the Board for their deliberation.

Pursuant to the requirements of the Local Government Comprehensive Planning
and Land Development Regulation Act, Chapter 163, Florida Statutes,'_the
Treasure Coast Regional Planning Council reviewed the amendments to the St.
Lucie County land use element at its regular meeting on September"22, 1986.
The following comments were a~proved by Council for transmittal to the
State Department of Community Affairs pursuant to Sections 163.3184{1)(c)
and (2), Florida Statutes, for consideration by the County prior to
adoption of the document.
Evaluation
The proposed amendments to the Land Use Element have been reviewed in.
accordance with the. requirements of Chapter 163, Florida Statutes,
Council's review procedures,_ and Council's adopted plans and policies. The
following comments are offered as a result of that rpview.
The proposed amendments are not in conflict or inc6nsistent with
adopted Council plans or policies. Proposals to convert large
tracts of agricultural lands to semi-urban uses (e.a., Item 20)
are of some concern, however, and should not be cons)dered prior
to a comprehensive reevaluation of the County's qoals and
objectives for the entire area (see attached letter). '
Prior to the approval of the land use amendments, the proposed "
changes should be tested aaainst the St. Lucie County
transportation model, to assure that the affected roadways can
accommodate the more intense land uses.
Council Supports the efforts of St. Lucie. County and the School
Board of St. Lucie County (see the attached letter) in improving
educational opportunities through the use of dndications and
impact fees as discussed in the amendment request.

The property described by Item 1 is close to the sites of the
Treasure Coast Square Mall and the proposed Vista Plantation
development in Martin County. The ability of U.S. 1 to
accommodate additional traffic generated by Item 1 must be
ensured. Adequate right-of-way should be dedicated for future
expansion of the roadway network prior to the development of this
parcel.
Considering the proximity of Item 16 to the St. Lucie County
Airport, the current land use designation of Liaht Industrial may
be more appropriate than the proposed Residential land use
designation. Consideration should be given to plans for future
expansion of the airport facilities and increased levels of air
traffic, as well as noise and safety issues.
The property described by Item 18 contains many acres of
wetlands known as the Northern Savannas. Care should be taken
to minimize the impacts of any development on this
environmentally sensitive area.
The property d~scribed by ~tem 20 is located on the border of
Indian River County and is near the interface of the St. Johns
River Water Management District and South Florida Water
Management District. Since a development of such size in this
location may have far reaching impacts, it is recommended that
the land use amendment not be approved until both St. Lucie
County and Indian River-~County aaree that such an action would
not adversely affect the ability of ~ither county to realize
growth management and planning objectives. A primary concern is
the relationship of the project with the existing
urban/agricultural boundary. Development of the property as
residential may create compatibility problems with existing
agricultural development. Prior to considering any change in
land use, the County should carefully consider ~ts long range
plans for this area, provision of infrastructure and services,
and the -impacts of residential development on agricultural
activities in the area. Additionally, a project of the size of
this proposal would be a DRI. Final consideration of the
proposed land use change should, perhaps, wait until a report
and recommendations can be developed that evaluate regional
issues.

Dear Mr Merritt-
Indian River County staff has reviewed' the petition of the
Strazzulla Brothers Company, Inc. and John B. Culverhouse etal to
amend the future land use maps of the St. Lucie County-Growth--
Management Policy Plan from AG (Agricultural) to SU-(Semi-Urban)
for the above referenced project. At this time staff's comments
are as follows:
1) The proposed project land use designation (SU Semi-Urban at
one unit per acre) is not compatible with Indian River
County's Land Use Plan (Agriculture at one unit per five
acres). The existing parcels in the surrounding ~area are
currently in agricultural production. Until such time that
the necessary urban services become available and th~
surrounding area infills with urban development, staff
believes that this project would create "leap-frog- develop-
ment and would be-p~emature. ...........
2) Staff has concerns regarding traffic impacts to local roads
entering into Indian River County that could result as the
project develops to its maximum buildout.capacity.
Please be advised that the Board of County Commissioners has not
considered these comments, however, upon direction from the
Treasure Co&st Regional Planning Council, staff will present this
issue to the Board for their deliberation.

Petition of Bessie W. Minton, O. R. Minton, Sr., and Shirley
Minton and Edwin J- %Minton & Mariel C. Minton to amend the Future
Land USe Maps of the St. Lucie County Growth Management Policy
Plan from SU (Semi Urban) to IL (Industrial Light) generally
located southwest of Indrio Road/u.s. 1 intersection and north-
northeast of St. Lucie County International Airport.
Mr. Edwin Minton, representing the ~etitioners, reminded the
Board that the property being petitioned is on a major artery
going to 1-95, and is adjacent with the airport.-
Chairman Terpening asked if anyone was present to speak in favor
or in opposition to the petition. There were none. He then
closed the public portion of the meeting.

have to be acquired by the County. Staff expressed concerns
regarding the area of the north Savannas, requesting the buffer
zone of approximately 75 ft. from that be deleted from the
petition. This property should not be reclassified into any kind
of use that Could potentially lead this area being Used for
retention ponds. The Savannas are a unique environmental system,
and Staff Would like to see it protected as much as possible.
The description attached to a memorandum dated December 2, 1986
is a rough estimate of the area involved. A finer description
Could be provided by the petitioner and Staff would have no
objection to going back to its original recommendations. In the
absence of such a description, Staff would recommend, if the
Board decides to approve the Petition, that those specific prop-
erties be lessed out of any recommendation to the Board of
County Commissioners.
Mr. Sciturro questioned Staff if the deletion of the Savannas was
in the previous hearing. Mr. Murphy indicated that it was and
made the following quote from

Mr. Terpening had some lengthy discussion ........ ·

are zoned. Mr. McIntyre stated that there may be a problem with
having an aCcess to a residentially zone property, even though
the right-of-way probably isn't zoned. The COncept is that you
shouldn,t be going through residential property to an industrial
property.
Mrs. King made a motion that the petition be recommended for
approval determining that it is consistent with the GMPp, and to
note for the record that the Savannas will be protected pursuant
to ex/sting State regulations. Mr. Carman seconded the motion.

Amendments to the St. Lucie County Land Use
Element
Introduction
Pursuant to the provisions of the Local Government Comprehensive Planning
and Land Development Regulation Act, Chapter 163, Florida Statutes, the
Council must be provided an opportunity to review and comment on plan
amendments prior to their adoption. St. Lucie County has- submitted
proposed land use amendments to the State Department of Community Affairs
which in turn is seeking Council,s comments. ,

St. Lucie County is considering 20 amendment'-s to the Future Land Use Map.
Locations of the properties under consideration are shown on the Qccom-
partying map, and the. number of acres and proposed changes in land use
designations, are summarized in the attached list.
The County is also considering text amendments that would 1) add language
describing plans for new residential development to bear a portion of
educational costs through developer dedications and impact fees, 2) delete
the requirement for site development plans with all rezoning petitions, and
3) require a site development or concept plan for proposals to amend the
Future Land Use Maps of the Growth Management Policy Plan {i.e., the
Comprehensive Plan).
Evaluation
The proposed amendments to the Land Use Chapter Element have been reviewed in
accordance, with the requirements of 163, Florida bt--atutes,

Prior to the approval of the land use amendments, the Proposed
changes should be tested against the St. Lucia County
t~?a_nsp.ortation model, to assure that the affected roadways can
.accommodate the mor~ intense land uses.
Council supports the efforts of St. 'Lucia County and the School
Board of St. Lucia County {see the attached letter) in improving
educational opportunities through the use of dedications and
impact fees as discussed in the amendment request.
The property described by Itmm l~s close to the sites of the
Treasure Coast Square Mall and the proposed Vista Plantation
development in Martin County. The ability of U.S. 1 to
accommodate additional traffic ge~erated by Item I must be
ensured. Adequate right-of-way should be dedicateo for future
expansion of the roadway network prior to the development of this
parcel.
Considering the proximity of ~to the St. Lucia County
Airport, the current )and use ~es~gnation of Light Industrial may
be more appropriate than the proposed residential )and use
designation. Consideration should be given to Plans for future
expansion of the airport faci.)ities and increased levels of air
traffic, as well as noise and safety issues.
The property described by Item 18 contains many acres of
wetlands known as .the Northe~ Savannas. Care Should be taken

Enclosed you will find, for review by the State Land Planning
Agency, ten copies of 22 proposed amendments to the St. Lucie County
Growth Management Policy Plan. The amendments are being transmitted
to you pursuant to the requirements of Chapter 163o~184 (3) Florida
Statute.
On Thursday, June 24, 1986, the St. Lucie County Local Planning
Agency held a public hearing on Petitions Number 7, 12, and 17 of the
attached agenda. These hearings were held in accordance to statutory
requirements in effect prior to Ouly l, 1986. On August 7, 198~, the
St. Lucie County Board of County Commissioners certified that the
Local Planning Agency did in fact hold this hearihg.
On Thursday, August 7, 1986, the St. Lucie County Board of County
Commissioners held a public hearing pursuant to Chapter 1~].~184 (15)
Florida Statute, for the purpose of transmitting the balance of the
attached agenda to the State Land Planning Agency for review. These
amendments are scheduled to be presented to the St. Lucie County Local
Planning Agency and Board of County Commissioners for final
disposition in December of 198~. This will complete the second Plan
Amendment cycle for 198~, as permitted under Florida Statute and the
St. Lucie County Board of County Commissioners amendment schedules.

Revisions to Chapter 163.3184, Florida Statutes -
Adoption of Comprehensive Plan, or Element or
Portion thereof
At the recent regular session of the Florida Legislature,
Senate Bill 978, which amended several sections of the Local
Government Comprehensive Planning and Land Development Regulation.
Act (also known as Chapter 153, Florida Statutes) was passed and
signed into law. One of the many amendments to this Act dealt
with the procedures to be followed for amending a Local
G°vernment's Comprehensive Plan. Under the previous statute, the
board of county commissioners, only had to certify that the Local
Planning Agency held a public hearing on the proposed
comprehensive plan, element, or portion thereof prior to its
transmittal to the State Land Planning Agency for review. Under
the new law, t~ board of county commissioners is required to
hold a public hearing on the proposed plan or plan amendment
prior to the transmitting of that plan or amendment to the State
Land Planning Agency for review.
On July 24, 1986, Rhoda P, Glasco, an attorney for the State
of Florida Department of Community Affairs opined that the County
must follow_ the procedures as-amended by Chapter 86-191, Laws of
Florida, even though all of the petitions were filed before the
July 1, 1986, effective date. A copy of Ms. Glasco's letter is
attached to this memorandum. Apparently, the Department of
Community Affairs is taking the position that the date of
advertising determines whether the new law applies.
In view of Ms. Glasco's July 24, 1986 opinion, I recommend
that the Board immediately schedule a transmittal hearing(s) so
that"the July amendments may~.be transmitted to the Department of
Community Affairs as soon as possible. Since the Board had no
meeting scheduled for July 29 (Fifth Tuesday), staff, after
discussions with the Board Chairman, scheduled the transmittal
hearing for Thursday August 7, 1986, at 5:30 p.m. By copy of
this memorandum to the County Administrator, I am requesting that
he place this item on the August 5, 1986 agenda for "after the
fact" permission to advertise.
The Development Coordinator and I wilt continue to review
the amendments to this act and hope to present to you in the near
future a summary report on what, if any, present county policies
or regulations must be amended. If you have any questions on
this matter please let me know. ..

Dear Mr. McIntyre:
You requested over the telephone, an opinion as to whether
the procedures in section 163.3184 as amended by Chapter 86-191,
Laws of Florida, are applicable to your current local
comprehensive plan amendments. You stated that your notice for a
public hearing by the local planning agency was advertised on
July..2, 1986, with hearings scheduled on July 23rd and 24th.
It is my opinion that the County must follow the
procedures as amended by Chapter 86-191, Laws of Florida, and
effective July 1, 1986. Therefore, the local governing body will
be required to hold at least two public hearings, the first which
must be held at the transmittal stage (See Section 9, Chapter
86-191, Laws of Florida). The second public hearing must be held
at the adoption stage.
As stated to you, the local planning agency must still
hold at least one public hearing with due notice pursuant to s.
163.3174(4)(a), prior to making a recommendation to the governing
body. There is no longer the requirement that the local -'
governing body determine that the LPA held a public hearing with
due public notice prior to transmittal.
The Department will make every effort to expedite the'
review and comment once the amendments are received. Should you
have any additional questions or concerns please contact Dana

As this Commission/Agency is aware, St. Lucie County is
presently involved with a series of studies in regard
to appropriate land uses around the airport. Because
of the proximity of this property to the airport and the
apparent desire of the petitioner to exploit this resource,
Staff, at this time, will defer any fOrmal recommendation

Mr. Rick Minton was present on behalf of'the petitioners and stated
that they have for a long time been planning to develop their property
in much the same manner as the Strazzulla Bros. but because the future
land use in this area did not seem to be compatible for residential
development, they decided a light industrial business park would
be more compatible to the concept of this area of St. Lucie County
in the years to come. He presented a color-coded map which indicated
how the property would be developed.
Mr. Carman asked if the proposed project fell in the flight path
of the airport. Planner, Dennis Murphy replied that portions of
the property were in the flight path.
Mr. Minton stated· that their property was boarded completely on the
south by the County Airport and industrial property.
Mr. Carman asked Mr. Minton if the outcome of the airport study would
have any effect on their proposed project.. Mr. Minton replied that
they would have liked to have had the study as well, but because
of the twice per year considerations of plan amendments, they had
to go on with their plans.
Mr. Edwin Minton addressed the Agency and stated that after watching
the airport, they felt it would be most beneficia~l to them to develop
in the direction of light industrial.
The following people were in opposition to this petition: Charles
Ronayne, David Crow and Steve Thorton. They were basically all in
agreement with their opposition because of encroachment of industrial
development into a residential area and the increase of'~raffic.
Mr. Sciturro then closed the public portion of the meeting.
A motion was made by Mrs. Fawsett to deny this petition. The motion
was seconded by Mrs. Ferrick in view of the Florida Administrative
Code Section 9J-5.010 and 9J-5.003 that states we are supposed to
protect our airport clear zones until a pattern has been established.
Mr. Sciturro stated he understood the concern, but that industrial
parks were compatible with airports.
Upon roll call, Mrs. King, Mr. Terpening, Mr. Wetherington, Mr. Carman
and Mr. Sciturro voted against the motion, and Mrs. Fawsett and Mrs.
Ferrick voted in favor of the motion. The motion failed.
A motion was made by Mr. Carman to approve the petition. The motion
was seconded by Mr. Terpening and upon roll call, Mrs. Fawsett and
Mrs. Ferrick voted against the motion, and Mr. Carmah, Mr. Terpening,
Mrs. King, Mr. Wetherin§ton and Mr. Sciturro voted in favor of the
motion.
Mr. Sciturro stated that the petition would be sent to the Board
of County Commissioners with a recommendation for approval.
Mr. Sciturro announced that the meeting would recess for five minutes.
