Green, Chairman RESOLUTION NO. 78-114 WHEREAS, THE St. Lucie County Planning and Zoning Commission after holding a public hearing of which due notice was published at least fifteen (15) days prior to said hearing and all owners of property within 300 feet were notified by mail of said hearing, has recommended to the Board of County Commissioners of St. Lucie County that the hereinafter described requests for changes in zoning classification be GRANTED, and WHEREAS, the Board of County Commissioners held a public hearing on November 21, 1978 after first publishing notice of said hearing in the News Tribune on November 6, 1978. Ud .n,,~,',' ... -'~ f>;,L-'; -h~..:--~ BOOK BOARD OF COUNTY COMMISSIONERS NOVEMBER 21, 1978 Petition of Peter and Brenda Leaming from R-lC (residential - single family), to R'4C (multiple.dwellings) for property located on Tumbtin Kling 595' East of U.S.-#1 for the purpose of constructing apartments. The Planning & Zoning Commission recommended approval of the petition. Mr. Leaming was present and stated he has had the property for 5 years, was turned down for M-2 and is now requesting this zoning to permit apartments He said the area was run down now and thought his development would improve Mrs. Mary Mason who lives east, wanted to know how many units were planned and Mr. Ament said that 50'units could be constructed although there would have to be a public hearing on a site development plan. Mrs. Marie Crosswell, property owner on Tumblin Kling Road objected, saying they wish the area to stay in s~ngle family dwellings. Moved by Com. Enns to adopt Resolution No. 78-114 which grants this rezoning as well as the previous one (John B. Jackson) was seconded by Com. Price, and upon roll call, unanimously carried. BOARD 0F COUNTY COMMISSIONERS NOVEMBER 14, 1978 ZONING - PUBLIC HEARINGS - SITE DEVELOPMENT PLANS Proof of Publication presented for the following: Petition of Peter and Brenda Leaming for approval of Site Development Plan for apartments located on the North side of S. Lake Drive apprx. 70' east of W. Lake Drive. Mr. Leaming was present and submitted his site plan and a topography of his property to the Board. He stated that the building is to be 2 stories and will have 8 apts. Upon a question, he stated that since there is not much drainage in the area, he assumed the Co. Health Dept. will require the top of the septic tank to be 24" above the crown of the road. He added that he can provide drainage as the Brdo wishes, either to the road or to the lake which is a natural- body of water. Mr. Kagan, Mrs. McDona!d~ Mrs. Brobel, Mrs. Baker and.Mr. Richter, all area residents, appeared to object to the site plan for the following reasons: t) poor existing drainage will worsen if the complex is built; 2) the existing pooY condition of the roads will worsen with more traffic~ especially since there is only one way into and out of the S/D; and 3) the character of the S/D is basic- ally single family and duplex residences, not multi-family. It was pointed out to objectors that the zoning is for multi-family dwel- lings and that Mr. Leaming's plan meets all County requirements. Mr, Ament confirmed this and added that he is now in the process of doing an overall study of zoning in the County to determine if the character of different ~reas adequately reflect the zoning classifications they carry. As to drainage, Eng. Baggett stated that he has received many complaints in the area, has checked the situation and has recommended some ditches be dug to alleviate the problem of trapped water, It was determined that the lake has no outfa!l and residents stated that it overflows after a heavy rain. Mr. Bag~ gett stated that a solution might be to take the water to the 7th St. canal, but he would have to do some study before making a final determination. Com. McCain asked Mr. Leaming when he planned to start construction and if a couple of weeks delay, in order to get the Eng. 's report, would affect his plans. Mr. Leaming stated that he hadn't planned to start for 6 - 8 months so such a delay would pose no problem. Moved by Com. McCain, seconded by Com. Park and, upon roll call, carried unanimously, to table the public hearing until December 12th, at which time Mr. Leaming~s site plan is to be the first item on the agenda. Leaming, for'a change in zoning.claSsi- fication from R-1C'(residential, single-family), to R-4C (multiple dwellings) for property located on Tumbling Kling Road, approximately 595 ft. East of U. S. #1. Mr. Leaming was present and stated that he had~come before the Commission asking .for an M-2 zoning for this piece of property and it was turned down. After that meeting he had met with Mr. Ament and it was decided that a buffer zone between this property and the residences in the area and- Bill Schuttz Chevrolet would be ideal. He stated that the residents of the area felt this was a good thin~g and that he also had a letter in his office from Mr. Lennard, the developer of the residential area. There was no one present to speak in opposition to the petition. There were two letters received by'mail from adjoining property owners stating their opposition to the rezoning. Motion to approve the petition was made by Mr. Davis and seconded by Mrs. King. The Board wa~polled and the following votes were cast: Ayes: Mr. Moore,Gotham.
